Dear Mr. Vick:
You have our approval, in accordance with the attached conditions, to dredge 1,393 square feet of waters
and place fill material in 395 square feet of waters for the purpose of expanding the Cape Hatteras Ferry Dock
area at Cape Hatteras Ferry and Dock, as you described in your application dated 13 May 1997. After
reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 3112. In addition, you should get any other federal, state or local permits before you go ahead with
your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-
Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying
404 or CAMA permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water

8. PROJECT SUMMARY: NCDOT would like to expand the basin at the Cape Hatteras Ferry Dock by
moving a 248' bulkhead 14' landward of its present alignment on the northwest side of the basin. The
project will include the reconstruction and relocation of an existing high ground wooden walkway
adjacent to the bulkhead in question. On the southeast side of the basin 1,600 s.f. of asphalt will be
removed and replaced with stone backfill.

SITE DESCRIPTION
The site in question is located at the NCDOT Hatteras Ferry Dock Facility adjacent to the U.S. Coast
Guard Station, Hatteras Island, Dare County. The property is developed and contains several
maintenance buildings and offices with a basin that can moor up to ten vessels. Three Ferries are
actively operated from the site and run several times a day to Ocracoke Island. The section of
bulkhead of particular interest is immediately adjacent to the Coast Guards Facility on the northwest
side of the basin. The bulkhead consists of two sections, one constructed. out of steel sheet piles that
are severely corroded and a second section constructed out of treated wood. Approximately 58 linear
feet of the wooden bulkhead has completely failed resulting in the erosion of approximately 1,393 s.f.
of land. Tie backs for the old bulkhead are still in place making boater access in the eroded area
difficult. The high ground area near the water averages approximately five feet above NWL. The
average depth of the water in the eroded section is approximately two feet. A few small sprigs of
Spartina patens have slumped down along the bank, but constitute no more than a total of three square
feet.
Adjacent to the bulkhead is a wooden walkway that is in disrepair and unusable. There are signs of
erosion behind and under the walkway that extends to the Coast Guard property. A chain link fence
located between the Hatteras Ferry site and the Coast Guard Station is approximately 26' to 30' from
the old bulkhead alignment. Primary vegetation found in the project area includes, but is not limited to
a variety of yard grasses, Spartina patens, and Gaillardia pulchella.
The overall impervious surfaces on the property exceed the maximum of 30%. In 1996 NCDOT
requested a CAMA Minor Permit to expand the ferry maintenance facility and would include additional
impervious surfaces in the Estuarine Shoreline AEC. The plans submitted for the Minor Permit
indicated that existing development on the site exceeds the maximum impervious surface allowed, and
the additional work would raise the amount. NCDOT requested a Variance and agreed to install an
engineered system that would offset the proposed increase in impervious surfaces. On March 5, 1997,
the Coastal Resource Commission approved the Variance.
PROJECT DESCRIPTION
The Department of Transportation would like to move a 248' section of bulkhead 14' landward of the
old alignment to provide additional space to maneuver vessels in the basin, at the Cape Hatteras Ferry
Dock adjacent to Austin Creek, off Pamlico Sound. Crowded conditions make access in and out of the
basin difficult. An existing dilapidated walkway located next to the existing bulkhead will be
reconstructed and placed next to the new bulkhead. Relocation of the bulkhead will require some
dredging along the eroded pocket to obtain a suitable depth for the vessels that will be harbored in the
basin. NCDOT would also like to remove 1,600 s.f. of asphalt adjacent to the bulkhead on the
southern end of the basin and replace it with stone (See Drawing Labeled Section Q.
Due to a failure in the old bulkhead system a 58 linear foot section has washed out resulting in severe
erosion on the northern end. Based on the erosion the average distance that the bulkhead will be
moved landward is approximately 6.5'. Approximately 1,974 s.f. of high ground will be excavated
and will result in 1,129 cubic yards of material. The area of Shallow Water Habitat/ Estuarine Water
that will be dredged will be approximately 1,393 square feet and will result in 361 cubic yards of spoil
material. The proposed (average) depth along the bulkhead on the interior side of the basin will be 10
feet below NWL while the average depth on the northern (outside) end adjacent to Austin Creek will
be -8 below NWL.

A section of high ground 106' long has eroded an average of 18' landward of the original bulkhead
alignment resulting in a need for approximately 395 s.f. of fill behind the proposed alignment. The
total area of upland disturbance from the relocation of the bulkhead and associated backfill will be
2,130 s.f. The total area of disturbance between the old alignment and the proposed alignment will be
3,367 square feet.
The spoil material that will result from this project will be taken to an NCDOT owned (upland) site at
the Buxton Maintenance Yard. The spoil material will be excavated by drag line or an excavator and
silt curtains will be placed around the site to prevent sediments from entering the basin. The
application states that all dredge activity will be conducted outside the established moratorium.
No archeological sites, remnant species or geological formations are known to be associated with this
property. A recorded archeological site is located southwest of the site along the sound and noted as
being DR 9.

Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to

SUBJECT: Application for CAMA Major Permit: Dare County, TIP No. F-3303
The Department of Transportation is proposing to replace a section of old,
deteriorating steel and timber bulkhead at the Hatteras North Dock Ferry Terminal
located at the south end of Hatteras Island in Dare County. The Department proposes
to replace the old bulkhead at a new location, 14 feet landward and parallel with the
existing wall. The resulting spoil, approximately 975 cubic yards of sand and silt
(mostly sand) will be trucked to a Department-owned, upland site at Buxton.
The Department also proposes to stabilize the old fill behind a section of the
existing bulkhead located on the south side of the same ferry basin. Differential settling
has been occurring in this area over time. This operation will involve the removal of a 3-
4 foot width of asphalt pavement that abuts against the existing bulkhead. The
resulting asphalt spoil, estimated to be +/- 20 cubic yards, will be hauled to one of the
Dare County landfills (US-64 or US-264). Following removal of the asphalt, voids in the
subgrade will be filled with Class VI granite stone.
The activities proposed will occur within Estuarine Shoreline, Estuarine Waters
and Public Trust Waters AECs. The enclosed CAMA Major Permit application (forms
MP-1 and MP-5), engineer's drawings and a check for $250.00 are being submitted for
your consideration. Please note that no adjacent riparian notifications are necessary
since the Department's right of way includes the entire basin shoreline.
Although the proposed expansion of the basin will eliminate 3,318 square feet of
non-impervious surface within the 75 foot Estuarine Shoreline AEC, the same project
proposes to eliminate approximately 1,600 square feet of impervious surface (asphalt
pavement) on the south side of the basin. The effects of this removal of impervious
surface, when factored into the required stormwater retention plan for the proposed
ferry maintenance facility (CAMA Permit No. 970305), reveals that the proposed 5,000
gallon retention capability exceeds the required retention by 1,859 gallons. This
surplus retention is more than adequate to offset the additional loss of 3,318 square
feet of non-impervious surface based upon the 30% rule (3,318 sq. ft X 30% = 515 sq.
ft = 930 gallons for a 1.5 inch rainfall event).

The Department intends to let a construction contract for the work described
herein on June 17, 1997, although the contractor's date of availability will be identified
in the contract documents as November 1997. The Department is aware of the
construction moratorium that extends until October 31. No work within waters will be
authorized by the Department until after the moratorium period.
Your assistance in expediting the public notice process would be appreciated.
The Department was originally advised by the Division of Coastal Management (DCM)
in February 1997 that the project could be processed and approved under a General
Permit if certain design changes were made. The design changes were subsequently
made and the revised drawings were submitted to the DCM on March 10, 1997. At
that time, the Department was proceeding on a schedule that would have allowed
ample turn around time for General Permit approval. However, in a March 18, 1997,
letter the DCM informed the Department that the project could not be approved under a
General Permit.
The Department is concerned that less than two months remain before the
scheduled construction letting. The permit and its conditions must appear in the
contract documents during the time that bids are solicited from prospective contractors.
The letting can not be delayed because of fiscal year constraints. In view of the
mitigating circumstances, your assistance in expediting the processing of this
application would be appreciated. If you can identify any way that the Department can
assist you in "fast-tracking" the processing of the application please call M. Randall

construction of a finger pier at the NE End of existing Park
Service dock to provide crew access to the Ocracoke-Swanquarter
ferry. (New ferry terminal offices on Ocracoke Island - south

Parcel B; Approximately 24.8 acres of land and water on the HE
end of Ocracoke island as outlined on attached site plan, labeled
"Hatteras Ferry South, Project 6.051024," dated July 20, 1954,
(For a ferry basin and related facilities).
Hatter 4a INLET FERRY TERMINAL NORTH DOCK TRACT V F Vim: ;?-1 area of
land at the SW end of Hatteras Island, as outlined on attached
contract Documents L1, labeled "Hatteras Inlet Ferry Terminal
North Dock," (Location of sewer field, equipment shop and
parking). This area of land may be used only if a catastrophic
failure of the existing field occurs and emergency correction is
required.
10. Tideland Electric Membership Corporation has authority to run service
lane along existing pole alignment and maintain the line as shown on sketch.
(Ref. SUP 6000-004, Ocracoke Sanitary District).
11. Permittee will maintain a 3/4" underground water line from the new ferry
terminal building to the ticket booth located in the center of the entrance
road and a 4" PVC underground sewage line from the ticket booth to connect to
the sewage line at the old terminal building as shown on attached sketch
(attachment #1).
12. The Permittee shall maintain and operate the areas in a neat and orderly
manner. The provision of litter and trash receptacles and the pickup and
disposal of all refuse or trash generating from use and operation of the
facilities shall be the responsibility of the permittee.
13. Any changes or additions to use of these land areas must first be
approved by the Superintendent.
14. In consideration for obtaining privileges granted herein, permittee
agrees to indemnify and save harmless the United States from any loss to it,
including not only damage to government property and injury to government
employees but also judgments, settlements, or compromises for property damage
or injury to all persons for which the United States may be liable, resulting
from the exercise by the permittee and its employees of the privileges granted
herein.
15. This permit will expire an JUNE 15, 2015. Renewal must be requested by
letter to the Superintendent 30 days prior to expization.
CONDITIONS OF THIS PERMIT
1. The permittee shall exercise this privilege subject to the supervision of the Superintendent, arid shall comply with all applicable laws arid
regulations of the area.
2. Damages - The permittee shall pay the United States for any damage resulting from this use which would not reasonably be inherent in the
use which the permittee is authorized to make of the land described in this permit.
3. Benefit • Neither Members of, nor Delegates to Congress, or Resident Commissioners shall be admitted to any share or part of this permit or
derive, either directly or indirectly, any pecuniary benefit to arise therefrom: Provided. however, that nothing herein contained shall be construed
to extend to any incorporated company, it the permit be for the benefit of such corporation.
4. Assignment - This permit may not be transferred or assigned without the consent of the Superintendent, in writing.
5. Revocation - This permit may be terminated upon breach of any of the conditions herein or at the discretion of the Superintendent.
6. The permittee is prohibited from giving false information, to do so will be considered a breach of conditions and be grounds for revocation:

7. Permittee will comply with applicable public health and sanitation standards and nodes.
8. The following provisions constitute Condition 4 In accordance with
Executive Order No. 11246 of September 24, 1965, as amended by

SUBJECT: Application for CAMA Major Permit: Dare County, TIP No. F-3303
The Department of Transportation is proposing to replace a section of old,
deteriorating steel and timber bulkhead at the Hatteras North Dock Ferry Terminal
located at the south end of Hatteras Island in Dare County. The Department proposes
to replace the old bulkhead at a new location, 14 feet landward and parallel with the
existing wall. The resulting spoil, approximately 975 cubic yards of sand and silt
(mostly sand) will be trucked to a Department-owned, upland site at Buxton.
The Department also proposes to stabilize the old fill behind a section of the
existing bulkhead located on the south side of the same ferry basin. Differential settling
has been occurring in this area over time. This operation will involve the removal of a 3-
4 foot width of asphalt pavement that abuts against the existing bulkhead. The
resulting asphalt spoil, estimated to be +/- 20 cubic yards, will be hauled to one of the
Dare County landfills (US-64 or US-264). Following removal of the asphalt, voids in the
subgrade will be filled with Class VI granite stone.
The activities proposed will occur within Estuarine Shoreline, Estuarine Waters
and Public Trust Waters AECs. The enclosed CAMA Major Permit application (forms
MP-1 and MP-5), engineer's drawings and a check for $250.00 are being submitted for
your consideration. Please note that no adjacent riparian notifications are necessary
since the Department's right of way includes the entire basin shoreline.
Although the proposed expansion of the basin will eliminate 3,318 square feet of
non-impervious surface within the 75 foot Estuarine Shoreline AEC, the same project
proposes to eliminate approximately 1,600 square feet of impervious surface (asphalt
pavement) on the south side of the basin. The effects of this removal of impervious
surface, when factored into the required stormwater retention plan for the proposed
ferry maintenance facility (CAMA Permit No. 970305), reveals that the proposed 5,000
gallon retention capability exceeds the required retention by 1,859 gallons. This
surplus retention is more than adequate to offset the additional loss of 3,318 square
feet of non-impervious surface based upon the 30% rule (3,318 sq. ft X 30% = 515 sq.
ft - 930 gallons for a 1.5 inch rainfall event).

The Department intends to let a construction contract for the work described
herein on June 17, 1997, although the contractor's date of availability will be identified
in the contract documents as November 1997. The Department is aware of the
construction moratorium that extends until October 31. No work within waters will be
authorized by the Department until after the moratorium period.
Your assistance in expediting the public notice process would be appreciated.
The Department was originally advised by the Division of Coastal Management (DCM)
in February 1997 that the project could be processed and approved under a General
Permit if certain design changes were made. The design changes were subsequently
made and the revised drawings were submitted to the DCM on March 10, 1997. At
that time, the Department was proceeding on a schedule that would have allowed
ample turn around time for General Permit approval. However, in a March 18, 1997,
letter the DCM informed the Department that the project could not be approved under a
General Permit.
The Department is concerned that less than two months remain before the
scheduled construction letting. The permit and its conditions must appear in the
contract documents during the time that bids are solicited from prospective contractors.
The letting can not be delayed because of fiscal year constraints. In view of the
mitigating circumstances, your assistance in expediting the processing of this
application would be appreciated. If you can identify any way that the Department can
assist you in "fast-tracking" the processing of the application please call M. Randall

construction of a finger pier at the NE and of existing Park
Service dock to provide crew access to the Ocracoke-Swanquarter
ferry. (New ferry terminal offices on Ocracoke Island - south
end).

Matter AS INLET FERRY TERMINAL NORTH DOCK TRACT V & y1: An area of
land at the SW end of Hatteras island, as outlined on attached
cont=act Documents L1, labeled "Hatteras Inlet Ferry Terminal
North Dock," (Location of sewer field, equipment shop and
parking). This area of land may be used only if a catastrophic
failure of the existing field occurs and emergency correction is
required.
10. Tideland Electric Membership Corporation has authority to run service
line along existing pole alignment and maintain the line as shown on sketch.
(Ref. SUP 6000-004, Ocracoke Sanitary District).
il. Permittee will maintain a 3/4" underground water lire from the new ferry
terminal building to the ticket booth located in the center of the entrance
road and a 4" PVC underground sewage line from the ticket booth to connect to
the sewage line at the old terminal building as shown on attached sketch
(attachment #1).
12. The Permittee shall maintain and operate the areas in a neat and orderly
manner. The provision of litter and trash receptacles and the pickup and
disposal of all refuse or trash generating from use and operation of the
facilities shall be the responsibility of the permittee.
13. Any changes or additions to use of these land areas must first be
approved by the Superintendent.
14. In consideration for obtaining privileges granted herein, permittee
agrees to indemnify and save harmless the United States from any loss to it,
including not only damage to government property and injury to government
employees but also judgments, settlement9, or compromises for property damage
or injury to all persons for which the United States may be liable, resulting
from the exercise by the permittee and its employees of the privileges gratlted
herein.
15. This permit will expire on JUNE 15, 2015. Renewal must be requested by
letter to the superintendent 30 days prior to expiration.
CONDITIONS OF THIS PERMIT
1. The permiltee shall exercise this privilege subject to the supervision of the Superintendent, arid shall comply with
regulations of the area. all applicable laws and

2. Damages • The permittee shall pay the United States for any damage resulting from this use which would not reasonably be inherent in the
use which the permiltee is authorized to make of the land described in this permit.
3. Genelit • Neither Members of, nor Delegates to Congress, or Resident Commissioners Shall be admitted to any share or part of this permit or
drive, either directly or Indirectly, any pecuniary benefit to arise Ihe'refrom: Provided, however, that nothing herein contained shall be construed
to extend to any incorporated company, if the permit be for the benefit of such corporation.
4. Assignment • This permit may not be transferred or assigned without the consent of the Superintendent, in writing.
5. Revocation • This permit may be terminated upon breach of any of the conditions herein or at the discretion of the Superintendent.
6. The permittee Is prohibited from giving false information, to do so will be considered a breach of conditions and be grounds for revocation:
