Dear Mr. Vick:
You have our approval, in accordance with the attached conditions, to fill in 0.001 acres of wetlands or
waters for the purpose of bridge replacement on U.T. to St. Clair Creek as you described in your application
dated November 7, 1997. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3103. This Certification allows you to use Nationwide Permit
Number 14 when it is issued by the Corps of Engineers. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion
Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval
will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions
listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act. If you have any questions, please telephone John Dorney at 919-733-1786.

On October 8, 1997 the Division of Water Quality (DWQ) was notified by receipt of
September 24,1997 letter regarding your plan to fill wetlands for the purpose of replacing
bridge No. 246 on SR 1738 in Beaufort County. Approval from DWQ is required to
disturb these wetlands. The enclosed application needs to be completed and returned to us
with 7 copies of the application, supporting maps and documentation. In particular as
described in 15A NCAC 2B .0502, we will require you to locate all streams and ponds on
the property. Please show these on maps of suitable scale (for instance 1"=100 feet) so we
can begin to determine your projects' compliance with 15A NCAC 2H.0500.

SUBJECT: APPLICATION FOR A NATIONWIDE 14 PERMIT TO REPLACE
BRIDGE NO. 246 OVER AN UNNAMED TRIBUTARY TO ST. CLAIR
CREEK ON SR 1738 IN BEAUFORT COUNTY.
Attached for your information is the application packet for the subject project.
NCDOT proposes replacing the existing bridge with a headwall and four 36 inch
corrugated metal pipes. The tributary is best described as a ditch with an average daily
flow less than 1.0 cfs. The wetlands involved in this project are in the bottom of the ditch
and contain hydrophytic vegetation including elderberry (Sambucus canadensis),
woolgrass (Scirpus cyperinus), soft rush (Juncus effusus), and water starwort (Callitriche
heterophylla).
After an onsite meeting with Mr. David Gossett of the NC Division of Coastal
Management, it was determined the subject area is beyond CAMA jurisdiction. NCDOT
biologists visited the site and determined there were no endangered oar ffi eatened species
or critical habitat in the permit area.
Construction is expected to commence in the summer of 1998. The project
should be completed in three days. It is anticipated that these activities will be permitted
under a Nationwide 14 Permit. By copy of this letter, we are also requesting a 401

General Water Quality Certification from the NC Division of Water Quality. If you have

The following provides descriptions and biological conclusions for federally protected
species with regard to the proposed project. Plants and animals with federal classifications of
Endangered, Threatened, Proposed Endangered and Proposed Threatened are protected under
provisions of Section 7 and Section 9 of the Endangered Species Act of 1973, as amended. As of
01 May 1997 the U.S. Fish and Wildlife Service (FWS) lists seven protected species for Beaufort
County (Table 1.).

The red wolf is a medium-sized canid smaller than the gray wolf and larger and hardier
than the coyote. The red wolf can be identified by its more elongated head and shorter coarser
pelage than the gray wolf. It has a coloration similar to that of the coyote. but with a darker
element. Habitat requirements for the red wolf are not specific. The red wolf does need heavy
vegetation to provide adequate shelter and denning materials.
BIOLOGICAL CONCLUSION NO EFFECT
The red wolf has been re-introduced into a National Wildlife Refuge near the Alligator
River in the northeastern region of Beaufort County. The project study area lies in the
southeastern portion of the county where human activity, largely agricultural, is much greater.
No impact to the red wolf will result from construction of the subject project.
Haliaeetus leucocephalus (bald eagle) Threatened

Date Listed: 11 March 1967
Adult bald eagles can be identified by their large white head and short white tail. The
body plumage is dark-brown to chocolate-brown in color. In flight bald eagles can be identified
by their flat wing soar.
Eagle nests are found in proximity to water (within a half mile) with a clear flight path to
the water, in the largest living tree in an area, and having an open view of the surrounding land.
Human disturbance can cause an eagle to abandon otherwise suitable habitat. The breeding
season for the bald eagle begins in December or January. Fish are the major food source for bald
eagles. Other sources include coots, herons, and wounded ducks. Food may be live or carrion.
BIOLOGICAL CONCLUSION NO EFFECT
The landscape within the vicinity of the project is dominated by agricultural fields with
no large trees present. Large water resources. which would include the Pamlico river, are more
than 1.6 km (1.0 mi) away from the project area. Therefore, it is determined that nesting and
foraging habitat for the bald eagle is not present within the project area. Additionally, the
Natural Heritage Program database of rare species and unique habitats contained no listing of the
bald eagle in vicinity of the project. Therefore, project construction will not affect the bald eagle.
disturbed soils and/or plant material that has been deposited on the bank. Full sun and bare
substrates are thought to significantly enhance germination.
BIOLOGICAL CONCLUSION NO EFFECT
A plant by plant survey for sensitive joint-vetch was conducted by NCDOT biologist
Bruce Ellis on 27 August 1997. A known population was examined prior to the survey. Plants
within the known population were in flower on this date. No sensitive joint-vetch was observed
during the survey. Additionally, the Natural Heritage Program database of rare species and
unique habitats did not contain any listing of sensitive joint-vetch within the project area.
Therefore, project construction will not affect sensitive joint-vetch.
Lysimachia asperulaefolia (rough-leaved loosestrife) Endangered

Rough-leaved loosestrife is a perennial herb having slender stems and whorled leaves.
This herb has showy yellow flowers which usually occur in threes or fours. Fruits are present
from July through October.
Rough-leaved loosestrife is endemic to the coastal plain and sandhills of North and South
Carolina. This species occurs in the ecotones or edges between longleaf pine uplands and pond
pine pocosins (areas of dense shrub and vine growth usually on a wet, peat, poorly drained soil),
on moist to seasonally saturated sands and on shallow organic soils overlaying sand. It has also
been found to occur on deep peat in the low shrub community of large Carolina bays (shallow,
elliptical. poorly drained depressions of unknown origins). The areas it occurs in are fire
maintained. Rough-leaved loosestrife rarely occurs in association with hardwood stands and
prefers acidic soils.
