APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS
N.C. Department of Transportation
P.O. Box 250
North Wilkesboro, NC 28659
Dear Sirs:
You have our approval to place fill material in 0.07 acres of wetlands or waters for the purpose of
repairing SR 1355, as you described in your application dated 2 May 1996. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Number
3026. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps
of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. Applicant is
reminded that High Quality Waters sediment and erosion control measures shall be used for this project.
In addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786.

Subject: Nationwide Permit No. 3 to replace existing pipe
along SR 1355 adjacent to small stream trib, to
South fork of Reddies river (WS II trout)
Dear Mr. Thomas,
The Department of Transportation is scheduled to grade, drain
base, and pave primarily along the existing roadway of SR 1355
(White Oak Rd)., in Wilkes County during the 1996-1997 fiscal
year. Due to the proximity of a small stream being a trib to
South fork of Reddies river Class-WS II-trout we are requesting a
404 Nationwide permit no. 3 to allow us to upgrade the 10 existing
cross line drainage structures that will need replacing, and or
extending.
Attached is a straight line sketch with proposed erosion control,
stream, stream embankment, pipe crossing, and marked county map.
By copy of this letter I am asking Ms. Stephanie Goudreau Mt.
Region Coordinator with the North Carolina Wildlife Resources
Commission to comment directly to you concerning the 404
Nationwide Permit request.
A request will be made on this project for a Temporary
Encroachment in the Trout Water Buffer Zone of South fork of
Reddies River, and I am asking Ms. Goudreau to comment directly to
me concerning the Trout water buffer zone encroachment.
Also by copy of this letter, I am requesting authorization to
proceed under Section 401 of the Clean Water Act from the Division
of Environmental Management.
We would like to begin construction as soon as possible. If
further information is required, please let me know. Your early
review and consideration will be greatly appreciated.
Sincerely,
D. K. Bennett

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS
Mr. Danny Tolar
N.C. Dept. of Transportation
P.O. Box 3279
Asheville, NC 28802
Dear Mr. Tolar:
You have our approval to place fill material in 0.1 acres of wetlands or waters for the purpose of
improving the road at SR 1396 with a change from station 25 & 80 to station 27 & 80, as you described in
your application dated 9 August 1996. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2735. This certification allows you to use Regional
General Permit Number 031 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. This Certification replaces one issued on 15 August 1995. In
addition, you should get any other federal, state or local permits before you go ahead with your project
including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water
Act. If you have any questions, please telephone John Domey at 919-733-1786.
Sincerely,
L KU4-

We are providing a package of design sketches concerning wetlands that
will be impacted by this project. We have enclosed a completed N. C. D. E. M.
application for your use.
We are proposing a channel change in Simms Fork Creek from Station
25+80 to Station 27+80 along West side of roadway. This stream is a designated
trout stream. We will be working within the twenty five foot buffer zone of this
stream but will not be encroaching past the existing shoulder of roadway except
for this channel change.
By copy of this letter, we are seeking comments from Ms. Stephanie
Goudreau, Mt. Region Coordinator and Mr. Ed Ingle, Area Roadside
Environmental Engineer concerning this project.
If you have any comments or questions concerning this project, please
contact J.N. Jarrett or myself of this office at 704-298-2741.
Sincerely yours,
