APPROVAL of 401 Water Quality Certification

Dear Mr. Vick:
You have our approval to place temporary fill in waters for the purpose of replacing a bridge at Bridge
#89 over High Rock Lake on SR 2168, as you described in your application dated 14 June 1996. After.
reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 2727. This certification allows you to use Nationwide Permit Number 33 when it is issued by the
Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

SUBJECT: Rowan County - Bridge No. 89 over High Rock Lake Backwater
and Approaches on SR 2168; T.I.P. No. B-2611; State Project
No. 8.2632201; DOA Action ID. 199302545
Reference Nationwide Permit No. 23 (Categorical Exclusion) issued June 16, 1993
by the Corps of Engineers for this bridge replacement. The project is ready for
construction, and involves placement of a new structure on existing location. No wetland
fill or channel change is required. Traffic will be maintained on local secondary roads
throughout construction.
The contractor hired to construct this project has requested permission to use
temporary work platforms to construct each end of the new bridge, but not the middle
span. Attached herein is a drawing submitted by the contractor, showing the proposed
work platform design, construction materials, and schedule. A single platform would be
placed on each end of the new bridge during construction, and will be removed as soon as
possible after construction is completed.
NCDOT does not anticipate any permanent impacts to High Rock Lake as a result
of the proposed work. Please review this material and inform us of any concerns you may
have regarding the proposed work platform.

Application is hereby made for Nationwide Permit No. 33 for Temporary
Construction, Access and Dewatering. By copy of this letter, we are also requesting
issuance of 401 Water Quality Certification by the North Carolina Division of
Environmental Management.
