The Town of Elm City appreciates the opportunity to respond to NOV-2020-DV-0246
dated May 19, 2020. This letter shall serve as Elm City's response and it is our hope
that the additional information provided will result in no further action by the Division.
The Sanitary Sewer Overflow was due to very substantial rainfall. The operator was
proactive as he quickly stopped and cleaned up the overflow. The town received more
than 3+ inches of rainfall in an exceptionally brief time -period. Because of the size if the
channels the measure of precipitation was beyond what the framework could deal with.
The flood was because of extreme conditions which were outside our ability to control.
We believe the WWTP's history of compliance demonstrates the towns commitment to
operating this facility in a responsible manner. Therefore, we respectfully request that
the Division considers these efforts and take no further action. The Town of Elm City
has limited resources and we would much rather dedicate these resources to address
utility operations versus civil penalties. If we can be of any further assistance or

Mayor Smith:
The self -reported Sanitary Sewer Overflow (SSO) 5-Day Report submitted by Town of Elm City indicates violations
of permit conditions stipulated in the subject permit and North Carolina G.S. 143-215.1. Violations include failing to
effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or
surface waters and making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a
permit is required.

a written response to this Notice of Violation. Your response is to be received by the regional office within 60
business days following receipt of this violation. Please include any additional documentation about this incident(s)
in the response. The submittal will be considered in determining whether the Division will assess a civil penalty for
the cited violations.
