Any violation of these terms may be subject to a fine, imprisonment or civil action; or may cause the permit to be null and void. 1) In order to protect juvenile shrimp and finfish populations, no excavation or filling will be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with the Division of Marine Fisheries. 2) All fill material will be clean and free of any pollutants, except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 3) All fill material will be confined behind the permitted head walls. 4) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance, as the case may be. This permit must be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Departmental approval. All work must cease when the permit expires on December 31, 1999 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee . it NC Dept. of Transportation Permit #7-96 Page 2 of 2 ADDITIONAL CONDITIONS 5) No excavated or fill material will be placed at any time in any marsh or surrounding waters outside of the alignment of the fill area indicated on the work plans. 6) All excavated materials will be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 7) The riprap must be positioned so as not to exceed a maximum of 5 feet waterward of the normal water level contour at any point along its alignment. 8) The riprap material must be free from loose dirt or other pollutant. It must be of a size sufficient to prevent its movement from the site by wave or current action. 9) The riprap must consist of clean rock or masonry materials such as, but not limited to, granite or broken concrete. Protection of Architectural Resources 10) To assure the proposed project will have no effect on the Lake Landing Historic District, which is listed in the National Register of Historic places, no bridge railing or additional landscaping is authorized without the prior approval of the Division of Coastal Management, in consultation with the Division of Archives and History. General 11) A silt screen will be placed downstream of the proposed area to be excavated and a 24-hour period will elapse prior to removal of the silt screen to prevent unnecessary siltation downstream of the activity. NOTE: The permittee is urged to meet with a representative of the Division of Coastal Management prior to project initiation. NOTE: Future development or changes in the proposed replacement structure at the project site may require a modification of this permit. Contact a representative of this Division at (919) 946-6481 prior to commencement of any such activity for this determination. NOTE: The N. C. Schecter, Director MEMORANDUM TO: John Parker THROUGH: Terry Moore FROM: Jeff Schaffer J ?S DATE: 18 December 1995 SUBJECT: NCDOT Request to Modify an Existing Major Permit Application Currently in Process to Replace Bridge #7 In their application dated 3 October 1995, NC DOT had initially proposed to replace Bridge #7 by mucking out or undercutting an area approximately 45' X 30' and then filling the same area to provide a bedding surface for the installation of three 103" (or 8.5') X 71" (or 5'11 ") X ±44' long metal culverts. The original proposal was also for excavation and filling of approximately 1,350 ft2 of canal bottom. The applicant's proposal has now been modified to replace Bridge #7 by mucking out or undercutting an area approximately 45' x 24' and then filling the same area to provide a bedding surface for the installation of a 24' X 5' 9" X 45' long corrugated aluminum box culvert. The modified proposal calls for the excavation and filling of approximately 1,080 ft2 of canal bottom. All other aspects of the initial application have not changed except as described above. A permit was required, because the unnamed canal at.the site of bridge # 7 was determined to be an Estuarine Water and a Public Trust Water Area of Environmental Concern per Administrative Code Subchapters 7H.0206 and 7H.0207. The Division of Coastal Management (DCM) acknowledged receipt of the application on October 25, 1995. The original design for the proposed project required the installation of a multi- pipe arch structure (3 @ 103" x 71 "). Subsequently, the Bridge Maintenance Unit concluded that an alternate design, utilizing an aluminum box culvert (1 @ 24.0 ft x 5.75 ft), would be more appropriate at this location. Revised drawings, reflecting the new design and revised application forms MP-1 and MP-5 are attached for your consideration. Riparian landowner notification verifications are also provided. The NCDOT assumes that the design changes will be viewed by the DCM as a positive change and that no delays in processing of the permit application will be necessitated by this revision. Z FILE COPY The Division of Environmental Management, Water Quality Section has reviewed your plans for the discharge of fill material into 2,700 square feet of waters located at SR 1110 at Bridge No. 7 in Hyde County for bridge replacement with culverts. Based on this review, we have identified significant uses which would be removed by this project. These uses are use of the channel by anadromous fish. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2B.0109. , Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to placing fill in- these waters and/or wetlands. Specifically can you construct your road crossing by constructing a bridge rather than using culverts? Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification. The NCDOT proposes to replace an existing 35' long by 19' wide bridge with three 8.8'h by 6'd culverts. The culverts are "' long. The canal is a Primary Nursery Area that connects to Wysocking Bay. Depth of the canal is approximately 2 112'. The NCDMF prefers that bridges be replaced with bridges. This preference is based on the potential negative impacts constricted opening have on the passage of both adult, larval and post larval marine organisms. Round structures significantly reduce the potential volume specification of the structure which could also impact normal distribution of marsh detritus (the basis of estuarine food chains). The NCDMF approves of the proposed project with the following stipulations: • 1. An alternative design, such as a single box culvert, that maintains the current flow passage be required. The proposed 3 culvert design and associated fill will constrict the flow volume by over 50% (18' versus current 351. 2. A construction moratorium be required April-September- The area is a designated Primary Nursery Area and a moratorium will lessen potential impacts the bridge replacement will have on juvenile finfish and crustaceans. Habitat Conservation Program DATE: November 21, 1995 SUBJECT: CAMA/Dhadge and Fill Permit Application for NCDOT bridge project on SR 1110, adjacent to Gray Dkeb, Hyde County. Staff biologists with the Wildlife Resourevs Commission have completed, a review of the project with regards to associated impacts on wildlifo and Adwrics resourccs in the area. A site visit was conducted on November 9. 1995. Our comments are provided in accordance with provisions of the Coastal Arcs Management Act (G.S.113A-100 through 113A-128), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended: 16 U.S.C. 661 et seq.). The applicant proposes to replace Bridge No. 7 located on SR 1110, Hyde County, with thrtt culverts. Bridgc No. 7 is located over an unnamed canal at its confluence with Gray Ditch (Lake Landing Canal). The proposed project would result in the excavation and ball of approximately 1,350 fe of canal bottom. The spoil material associated with tho mucking out of the canal will be transported off site. . Gray Ditch and the unnamed canal are designated as joint waters by the NC Division of Marine Fisheries, and the project is located in Arras of Environmontal Concern designated as Estuarine Water (EW), Estuarine Shoreline (ES) and Public Trust Area (PTA). Waters at the project sitc arc classified as SC and arc olosed to shellfishing. The proposed area is also clawif ed as an anadromous fish spawning area, primary and/or secondary nursery area, and high quality and/or outstanding resource water. --DEC-18-195 MON 10:12 ID: TEL N0: #950 P03 1-. ! The shallow water habitat in Gray Ditch and adjacent canals provide, for numerous species of anadromous and estuarine fish spawning, rearing, feeding and escape areas. Incxcawd turbidity in these areas could result in the destruction of spawning habitat, and diminish egg and fty survival. The mucking out of the canal would increase localized turbidity in Gray Ditch. Additionally, bridge replacement with three culverts will reduce available habitat in the canal, and may affect fish passage. NCDOT biologists have classified this project as being located in a primary nursery area. The proposed CAMA general permit for replacement of existing bridges and culverts (section 7H .2305, h 1) lists as a specific condition: Replacing bridges with culverts shall not be allowed in primary nursery areas. Because the potential exists for habitat destruction due to localized turbidity, and because primary nursery areas exist in the proximity of the unnamed canal and in Gray Ditch, we will not object to the project if the existing bridge is replaced with a bridge- We appreciate the opportunity to review this permit application.
