Dear Mr. Tolar:
This is to confirm that we have reviewed your proposed modifications to the subject permit. It is our
understanding that excavation will now be limited to the culvert site and a segment of previously excavated stream
channel (approximately 80 feet) parallel to the roadway, and that the small tributary will not be excavated in the
vicinity of its confluence with Shelton Laurel Creek. We have discussed your project with the N. C. Division of
Environmental Management, and we understand that the attending 401 Water Quality Certification has been issued
for the project as now proposed.
Based on your proposed modifications of the project, the NCWRC does not object to issuance of a Corps 404
permit, provided sedimentation and erosion control measures are maintained during construction. In particular, a rock
or sandbag check dam should be employed at the downstream end of the work site to prevent excessive movement of
suspended sediments into trout waters.
Thank you for the opportunity to review and comment on this project. Pending availability of field staff, the
NCWRC may inspect the work site during or after construction. If there are any questions regarding these comments,

APPROVAL of 401 Water Quality Certification

Dear Mr. Tolar:
You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose
of eliminating flooding problems and building drainage at SR 1314, as you described in your
application dated 28 September 1995 and revision dated 3 January 1996 which refers to a reduction in
dredging from 160 to 80 feet. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2735. This certification allows you to use
General Permit Number 031 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Dorney:
This is in response to your recent letter concerning dis-
charge of fill material into 0.02 acres of water located at
SR 1314 in Madison County, Project 951052.
An unnamed tributary to Shelton Laurel Creek crosses SR 1314
through a 24" corrugated steel pipe. The outlet end of the
pipe is partially closed with silt. When we have a normal
rain the pipe will not carry the flow of the creek. The
creek backs up and floods a tobacco field, and will eventu-
ally overflow the roadway.
We need to put in a larger pipe (48") to carry the creek
flow. We also need to clean the creek of silt for approxi-
mately 80 ft. below the outlet end of the pipe to prevent the
flooding of the tobacco field and the i^oadway.
As you requested, we have reviewed any alternative to dredg-
ing the creek. We have concluded we can reduce the length of
the creek that will require dredging from 160 feet to 80
feet. However, to not impede the flow of the creek through
the proposed 48" pipe, we will need to dredge approximately
80 feet of the unnamed tributary to Shelton Laurel Creek be-
low the outlet end of the pipe.

SUBJECT: NCDOT Nationwide 404 Permit Application
Spot improvement on SR 1314 over unnamed tributary to Shelton Laurel Creek
Madison County, North Carolina
Dear Mr. Johnson:
I have reviewed information provided by the applicant regarding a 404 permit for stream crossings, and I
am familiar with habitat values of the project area. A site inspection was conducted on September 25, 1995 to
assess potential impacts of the project on trout waters. These comments are provided in accordance with
provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.) and the Fish and Wildlife Coordination Act (48
Stat. 401, as amended; 16 U.S.C. 661-667d).
The proposed work involves dredging of a tributary to a trout stream to control flooding in adjacent
floodplain areas, and possible repositioning or replacement of associated culverts. We do not approve dredging of
stream channels to reduce flooding. Any flooding incidents that are not directly related to blockage or inadequate
sizing of culvert pipes are the result of natural characteristics of the floodplain, particularly stream gradient.
While we recognize that the stream channel in question has been altered in the past, continued dredging
will provide no long-term solution to flooding problems and will eliminate existing fish habitat values in
Designated Public Mountain Trout Waters. Furthermore, we are concerned about public perception of government
activities that destroy trout habitat. Recent projects sponsored by the Natural Resources Conservation Service, in
addition to devastating significant reaches of trout streams, have encouraged many private individuals in the
Madison-Yancey-North Buncombe area to excavate in trout waters to "control" flooding. Many of these private
landowner actions were in violation of Federal law, and notices of violation have been given to many of the
individuals involved. We are concerned that use of unapproved flood control methods by a state agency will
encourage a similar behavior by the public, with widespread and often catastophic effects on public fishery
resources.
- For the reasons discussed above, the NCWRC recommends that all channel dredging activities be
removed from the project proposal, and we would consider any such activity as a violation of permit
conditions.
We have no objection to hand cutting of vegetative growth or removal of loose woody debris and
household garbage from the stream channel in question, although rooted tree stumps should only be cut to ground

level and not grubbed. We also have no objection to enlarging or changing elevation of culverts, provided the
following guidelines are strictly followed:
1. The culverts should be placed with the floor of the barrels approximately one foot below the level of
the stream bottom to allow natural stream bottom materials to become established in the culvert
following installation. This may require increasing the size of the culvert to meet flow conveyance
requirements.
2. Under no circumstances should rock, sand, or other materials be dredged from the stream channel
under authorization of this permit, except in the immediate vicinity of the culvert. Channel
relocations have catastrophic effects on aquatic life, and disturbance of the natural form of the stream
channel will likely cause downstream erosion problems, possibly affecting adjacent land owners.
3. If possible, culverts should be placed in a dry work area. Where multiple barrels are involved, stream
flow may be directed through one barrel while other barrels are installed. Where one barrel is placed,
flexible pipe or other diversion structures should be used where possible to minimize excavation in
flowing water.
4. Grading and backfilling should be minimized, and tree and shrub growth should be retained where it
does not obstruct water flow. Backfill materials should be obtained from upland sites.
5. Adequate sedimentation and erosion control measures must be implemented and maintained on the
project site to avoid impacts to downstream aquatic resources.
6. If concrete is used during culvert installation, a dry work area should be maintained to prevent direct
contact between curing concrete and stream water. Uncured concrete affects water quality and is
toxic to fish and other organisms.
7. All culvert replacement activities should occur before November 1 or be postponed until after April
15 to minimize sedimentation impacts on trout reproduction.
The NCDOT should note that mitigation will be required for the upcoming I-26 project in Madison
County(A-10). While permitting of this project will not occur for sometime, it is likely that the NCWRC will
recommend that the NCDOT identify, acquire, restore, and protect specific segments of floodplain adjacent to trout
streams in the Laurel Creek and Ivy Creek watersheds. flood-prone areas such as the one involved in this project
should be considered. Acquisition and restoration of frequently flooded agricultural lands would partially fulfill
the NCDOT's mitigation requirements for highway projects and would also compensate local landowners for
impacts to land use. We encourage the NCDOT to consider such options over trout stream destruction in project
areas such as this one.

The Division of Environmental Management, Water Quality Section has reviewed your plans
for the discharge of fill material into 0.02 acres of waters and/or wetlands located at SR 1314 over
Shelton Laurel Creek in Madison County for alleviation of flood problems. Based on this review, we
have identified significant uses which would be removed by this project. These uses are water storage
in the floodplain and subsequent pollutant removal. Furthermore, insufficient evidence is present in
our files to conclude that your project must be built as planned in waters and/or wetlands. Therefore,
we are moving toward denial of your 401 Certification as required by 15A NCAC 2B.0109. Until we
receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of
Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold.
Please provide us with information supporting your position that your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters
and/or wetlands. Specifically can you construct your project without dredging the creek? Any
documentation such as maps and narrative that you can supply to address alternative designs for your
project may be helpful in our review of your 401 Certification. Please respond within two weeks of
the date of this letter by sending a copy of this information to me.
