APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Vick:
You have our approval to impact 3.285 acres of wetlands and 2.839 acres of waters for the purpose
of constructing the Pittsboro Bypass in Chatham County, as you described in your application dated 16
June 1995 and revised 18 October 1995. After reviewing your application, we have decided that this fill
is covered by General Water Quality Certification Numbers 2671, 2732, 2727 and 2735. These
certifications allow you to use Nationwide Permit Numbers 26, 14, 33 and General Permit 31 when they
are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. The following
conditions are required: only riprap is acceptable for the causeway in the Haw River; and weep holes
shall not be installed directly over rater. In addition, you should get any other federal, state or local
permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 davs of the date that you receive this letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

The North Caroline Department of Transportation.(NCDOT) applied for the
Section 444 permits required for the proposed Pittsboro Bypass by letter dated June 16,
1995. All of the Information provided on the history, planning, and permit rcquiraments of
the project are accurate. However, NCDOT staff have discussed this application with
your Raleigh Field Ofrleo, and it has been determined that an item included in the
application is in error.
Section AB of the project extends from just east of US 15/501 to existing US 64.
and Is described in plan shrcts 7 -11 of the permit application. The impact summary table
provided on sheet 9 contains an error. Site I impacts 0,116 acres of wetlands, instead of
1.16 acres as given on sheet 9. Since the site occurs below headwaters and impacts Isar
than 0.33 acres, it qualities for Nationwide 14 with notitlcation to your agency required.
Enclosed you will find a revised sheets 9 depicting this correction.
As already discussed, it is anticipated that all sections of this project can be
authorized under Nationwide or General Permits. Although only six of the impact sites
require formal notification, complete information on the project has been provided to

SUBJECT: Chatham County, US 64 Pittsboro Bypass, from SR 1514 to Jordan
Lake, State Project No. 8.1520801, T.I.P. No. R-2219.
The North Carolina Department of Transportation (NCDOT) proposes to improve
US 64 from Manco Dairy Road (SR 1514) to west of B. Everett Jordan Lake including a
bypass of the town of Pittsboro. Existing US 64 will be widened from two lanes to four
lanes beginning at the existing four-lane section west of Jordan Lake and extending to the
Haw River. A new bridge will be constructed over the Haw River adjacent to the existing
bridge. West of the Haw River, a bypass will be built on new location north of Pittsboro
extending to the Old Siler City Highway (SR 1564). The bypass will be a four-lane
roadway with a 60-foot median and full control of access. From the bypass terminus,
existing US 64 will be widened to four lanes extending to the project limits at Manco
Dairy Road (SR 1514). The two sections of the project which involve widening along
existing US 64 will have 46-foot medians.
The potential impacts of this project were evaluated in a Final Environmental
Impact Statement which was signed by the Federal Highway Administration on June 3,
1994. This document discusses the alternatives which were considered for the new
location and widening sections of the project. The proposed alternatives were selected for
a variety of reasons. The alignment of the new location section was selected because it
had the lowest impacts to surface water, the lowest cost, less impact to Duke Forest,
fewer relocations, no historic or archeological sites, and was most compatible with the
future development plans of the Town of Pittsboro.

The sections east and west of the bypass will be widened to the south of existing
US 64. West of the bypass, this is due to the presence of a historic property north of the
road and the anticipated tie-in to NCDOT project R-2218 to the west, which also widens
to the south. The section east of the bypass will be widened to the south because it
minimizes the disturbance of natural areas at the Haw River. It also has fewer adverse
effects to adjacent property owners, and ties-in to the existing four-lane section of US 64
at Jordan Lake.
For construction purposes, the project has been divided into three sections. This
notification includes the materials for all sections. The impact summaries and plan
drawings have been prepared in four packages for agency review.

Section R-2219AA begins at the western project lirnit and extends to just east of
US 15-501. It includes the western part of the bypass on new location. This section of
the project crosses waters of the United States at 19 sites, all of which are located above
headwaters. The location of all 19 sites is indicated on Sheet 3, and a summary of impacts
listed on Sheet 4. Only one site is greater than 1/3 of an acre, and therefore requires
notification to permit agencies. This site consists of a bottomland hardwood community
adjacent to a tributary of Roberson Creek west of SR 1515. The project will impact 1.66
acres at this site, which is depicted on Sheet 5. It is anticipated that all of the impacts of
R-2219AA section can be authorized under Nationwide Permit No. 26.
Section R-2219AB is the eastern part of the bypass. This section crosses wetlands
at five sites, all of which require notification (Sheet 8). One site is located above
headwaters„ and involves 0.54 acres of wetland impact (Sheet 10). The remaining four
sites are located below headwaters. These sites can be generally described as small
bottomland wetlands associated with tributary channels. It is anticipated that this section
of the project can be authorized under Nationwide Permits No. 14 and No. 26.,;
Section R-2219B consists of the widening of existing 64 east of Pittsboro and the
construction of the new Haw River Bridge. The permit information for Section B has been
prepared in two parts: the US 64 widening without the bridge, and the bridge structure
itself. The widening of the road in this section will require impacts at 24 sites (excluding
the Haw River). All of these sites are located above headwaters, and none involves
impacts of greater than 1/3 of an acre. The location of each of these sites is given on Sheet
12, and a summary of impacts on Sheet 13. It is anticipated that all impacts for this
section can be authorized under Nationwide Permit No. 26.
A new bridge will be constructed adjacent to the existing bridge over the Haw
River. This will require the construction of a temporary access road in the waterway.
This road is necessary to support the equipment for constructing the bridge bents. The
flaw River at this location is too shallow for barges to be used for this purpose.
Construction of the road will involve the placement of 2,188 cubic yards of fill in 0.40
acres of Waters of the United States. The fill will be removed after construction of the
bents and bridge deck. The proposed bridge construction is depicted in Sheets 13 through
22. It is anticipated that the new bridge and temporary access road can be authorized by
General Permit No. 31 and Nationwide Permit No. 33.
As already discussed, it is anticipated that all sections of this project can be
authorized under Nationwide or General Permits. Although only six of the impact sites
require formal notification, complete information on the project has been provided to
expedite your review. Please review all sections of the project for authorization under

Dear Sir:
SUBJECT: Chatham County, US 64 Pittsboro Bypass, from SR 1514 to Jordan
Lake, State Project No. 8.1520801, T.I.P. No. R-2219.
The North Carolina Department of Transportation (NCDOT) proposes to improve
US 64 from Manco Dairy Road (SR 1514) to west of B. Everett Jordan Lake including a
bypass of the town of Pittsboro. Existing US 64 will be widened from two lanes to four
lanes beginning at the existing four-lane section west of Jordan Lake and extending to the
Haw River. A new bridge will be constructed over the Haw River adjacent to the existing
bridge. West of the Haw River, a bypass will be built on new location north of Pittsboro
extending to the Old Siler City Highway (SR 1564). The bypass will be a four-lane
roadway with a 60-foot median and full control of access. From the bypass terminus,
existing US 64 will be widened to four lanes extending to the project limits at Manco
Dairy Road (SR 1514). The two sections of the project which involve widening along
existing US 64 will have 46-foot medians.
The potential impacts of this project were evaluated in a Final Environmental
Impact Statement which was signed by the Federal Highway Administration on June 3,
1994. This document discusses the alternatives which were considered for the new
location and widening sections of the project. The proposed alternatives were selected for
a variety of reasons. The alignment of the new location section was selected because it
had the lowest impacts to surface water, the lowest cost, less impact to Duke Forest,
fewer relocations, no historic or archeological sites, and was most compatible with the
future development plans of the Town of Pittsboro.

The sections east and west of the bypass will be widened to the south of existing
US 64. West of the bypass, this is due to the presence of a historic property north of the
road and the anticipated tie-in to NCDOT project R-2218 to the west, which also widens
to the south. The section east of the bypass will be widened to the south because it
minimizes the disturbance of natural areas at the Haw River. It also has fewer adverse
effects to adjacent property owners, and ties-in to the existing four-lane section of US 64
at Jordan Lake.
For construction purposes, the project has been divided into three sections. This
notification includes the materials for all sections. The impact summaries and plan
drawings have been prepared in four packages for agency review.

Section R-2219AA begins at the western project limit and extends to just east of
US 15-501. It includes the western part of the bypass on new location. This section of
the project crosses waters of the United States at 19 sites, all of which are located above
headwaters. The location of all 19 sites is indicated on Sheet 3, and a summary of impacts
listed on Sheet 4. Only one site is greater than 1/3 of an acre, and therefore requires
notification to permit agencies. This site consists of a bottomland hardwood community
adjacent to a tributary of Roberson Creek west of SR 1515. The project will impact 1.66
acres at this site, which is depicted on Sheet 5. It is anticipated that all of the impacts of
R-2219AA section can be authorized under Nationwide Permit No. 26.
Section R-2219AB is the eastern part of the bypass. This section crosses wetlands
at five sites, all of which require notification (Sheet 8). One site is located above
headwaters„ and involves 0.54 acres of wetland impact (Sheet 10). The remaining four
sites are located below headwaters. These sites can be generally described as small
bottomland wetlands associated with tributary channels. It is anticipated that this section
of the project can be authorized under Nationwide Permits No. 14 and No. 26.
Section R-2219B consists of the widening of existing 64 east of Pittsboro and the
construction of the new Haw River Bridge. The permit information for Section B has been
prepared in two parts: the US 64 widening without the bridge, and the bridge structure
itself. The widening of the road in this section will require impacts at 24 sites (excluding
the Haw River). All of these sites are located above headwaters, and none involves
impacts of greater than 1/3 of an acre. The location of each of these sites is given on Sheet
12, and a summary of impacts on Sheet 13. It is anticipated that all impacts for this
section can be authorized under Nationwide Permit No. 26.

A new bridge will be constructed adjacent to the existing bridge over the Haw
River. This will require the construction of a temporary access road in the waterway.
This road is necessary to support the equipment for constructing the bridge bents. The
Haw River at this location is too shallow for barges to be used for this purpose.
Construction of the road will involve the placement of 2,188 cubic yards of fill in 0.40
acres of Waters of the United States. The fill will be removed after construction of the
bents and bridge deck. The proposed bridge construction is depicted in Sheets 13 through
22. It is anticipated that the new bridge and temporary access road can be authorized by
General Permit No. 31 and Nationwide Permit No. 33.
As already discussed, it is anticipated that all sections of this project can be
authorized under Nationwide or General Permits. Although only six of the impact sites
require formal notification, complete information on the project has been provided to
expedite your review. Please review all sections of the project for authorization under

Lake, State Project No. 8.1520801, T.I.P. No. R-2219.
The North Carolina Department of Transportation (NCDOT) proposes to improve
US 64 from Manco Dairy Road (SR 1514) to west of B. Everett Jordan Lake including a
bypass of the town of Pittsboro. Existing US 64 will be widened from two lanes to four
lanes beginning at the existing four-lane section west of Jordan Lake and extending to the
Haw River. A new bridge will be constructed over the Haw River adjacent to the existing
bridge. West of the Haw River, a bypass will be built on new location north of Pittsboro
extending to the Old Siler City Highway (SR 1564). The bypass will be a four-lane
roadway with a 60-foot median and full control of access. From the bypass terminus,
existing US 64 will be widened to four lanes extending to the project limits at Manco
Dairy Road (SR 1514). The two sections of the project which involve widening along
existing US 64 will have 46-foot medians.
The potential impacts of this project were evaluated in a Final Environmental
Impact Statement which was signed by the Federal Highway Administration on June 3,
1994. This document discusses the alternatives which were considered for the new
location and widening sections of the project. The proposed alternatives were selected for
a variety of reasons. The alignment of the new location section was selected because it
had the lowest impacts to surface water, the lowest cost, less impact to Duke Forest,
fewer relocations, no historic or archeological sites, and was most compatible with the
future development plans of the Town of Pittsboro.

The sections east and west of the bypass will be widened to the south of existing
US 64. West of the bypass, this is due to the presence of a historic property north of the
road and the anticipated tie-in to NCDOT project R-2218 to the west, which also widens
to the south. The section east of the bypass will be widened to the south because it
minimizes the disturbance of natural areas at the Haw River. It also has fewer adverse
effects to adjacent property owners, and ties-in to the existing four-lane section of US 64
at Jordan Lake.
For construction purposes, the project has been divided into three sections. This
notification includes the materials for all sections. The impact summaries and plan
drawings have been prepared in four packages for agency review.

Section R-2219AA begins at the western project limit and extends to just east of
US 15-501. It includes the western part of the bypass on new location. This section of
the project crosses waters of the United States at 19 sites, all of which are located above
headwaters. The location of all 19 sites is indicated on Sheet 3, and a summary of impacts
listed on Sheet 4. Only one site is greater than 1/3 of an acre, and therefore requires
notification to permit agencies. This site consists of a bottomland hardwood community
adjacent to a tributary of Roberson Creek west of SR 1515. The project will impact 1.66
acres at this site, which is depicted on Sheet 5. It is anticipated that all of the impacts of
R-2219AA section can be authorized under Nationwide Permit No. 26.
Section R-2219AB is the eastern part of the bypass. This section crosses wetlands
at five sites, all of which require notification (Sheet 8). One site is located above
headwaters„ and involves 0.54 acres of wetland impact (Sheet 10). The remaining four
sites are located below headwaters. These sites can be generally described as small
bottomland wetlands associated with tributary channels. It is anticipated that this section
of the project can be authorized under Nationwide Permits No. 14 and No. 26.
Section R-2219B consists of the widening of existing 64 east of Pittsboro and the
construction of the new Haw River Bridge. The permit information for Section B has been
prepared in two parts: the US 64 widening without the bridge, and the bridge structure
itself. The widening of the road in this section will require impacts at 24 sites (excluding
the Haw River). All of these sites are located above headwaters, and none involves
impacts of greater than 1/3 of an acre. The location of each of these sites is given on Sheet
12, and a summary of impacts on Sheet 13. It is anticipated that all impacts for this
section can be authorized under Nationwide Permit No. 26.
A new bridge will be constructed adjacent to the existing bridge over the Haw
River. This will require the construction of a temporary access road in the waterway.
This road is necessary to support the equipment for constructing the bridge bents. The
Haw River at this location is too shallow for barges to be used for this purpose.
Construction of the road will involve the placement of 2,188 cubic yards of fill in 0.40
acres of Waters of the United States. The fill will be removed after construction of the
bents and bridge deck. The proposed bridge construction is depicted in Sheets 13 through
22. It is anticipated that the new bridge and temporary access road can be authorized by
General Permit No. 31 and Nationwide Permit No. 33.
As already discussed, it is anticipated that all sections of this project can be
authorized under Nationwide or General Permits. Although only six of the impact sites
require formal notification, complete information on the project has been provided to
expedite your review. Please review all sections of the project for authorization under

SUBJECT: Chatham County, US 64 Pittsboro Bypass, from SR 1514 to Jordan Lake, State
Project No. 8.1520801, T.I.P. No. R-2219. COE Action ID No. 199400457,
DEM Project No. 95649.
The North Carolina Department of Transportation (NCDOT) is improving US 64 from Manco Dairy
Road (SR 1514) to west of B. Everett Jordan Lake including a bypass of the town of Pittsboro in
Chatham County. The Corps of Engineers authorized this project using Nationwide Permits No. 14, 26
and 33 (Action ID No. 199400457). Project impacts to waters of the United States are described in
detail in NCDOT's permit application of June 16, 1995.
As you are aware, the "old" Nationwide permits expired on January 21, 1997, with an automatic one
year extension for ongoing projects. Projects that will not be completed by January 21, 1998 require
renewal of Nationwide permit authorization. In addition, the "new" Nationwide Permit No. 26 will
permanently expire on December 13, 1998. The NCDOT believes that it is appropriate to pursue
reauthorization of this project due to these expiration dates.
The project was authorized under Nationwide Permits No. 14, 26, and 33. It is expected that the sites
authorized under Nationwide 14 and 33 can be renewed without complications. Only two of the project
sites were authorized under Nationwide 26. The first of these is Site 4 of R-2219AA This site involved
the construction of a new culvert approximately 300 feet long, and placement of fill in 1.66 acres of
wetlands. The culvert at this site has been constructed. It is anticipated that all fill activities at this site
will be completed by January 21, 1998, although additional construction in uplands will take place. The
second Nationwide 26 site is Site 2 of R-2219AB. This site involves the placement of fill in 0.541 acres

of wetlands. Although project construction is just beginning, it is expected that placement of fill in this
wetland area can also be completed by January 21, 1998, although additional project work will continue
in uplands. Consequently, the NCDOT requests that the previously issued Nationwide Permits No. 14
and 33 for this project be renewed to allow construction to extend beyond January 21, 1998.
In addition, the contractor for project section R-2219B has requested authorization to use three disposal
areas for excess material. These areas were all investigated for impacts to wetlands and waters of the
United States by Dr. J. H. Carter and Associates, Inc. These sites were also inspected in the field on
June 17, 1997 by NCDOT staff, the contractor, and Ms. Cyndi Bell of the N.C. Division of Water
Quality (DWQ). Intermittent streams were identified at all three sites, but no wetlands will be impacted.
At Site 1, the limits of fill were adjusted to eliminate encroachment on the perennial section of the
stream. Ms. Bell determined in the field that the three sites would not require authorization under
General Water Quality Certifications and that stream mitigation would also not be required. Maps of

The North Carolina Department of Transportation (NCDOT) is improving US 64 from Manco Dairy
Road (SR 1514) to west of B. Everett Jordan Lake including a bypass of the town of Pittsboro in
Chatham County. The Corps of Engineers authorized this project using Nationwide Permits No. 14, 26
and 33 (Action ID No. 199400457). Project impacts to waters of the United States are described in
detail in NCDOT's permit application of June 16, 1995.
As you are aware, the "old" Nationwide permits expired on January 21, 1997, with an automatic one
year extension for ongoing projects. Projects that will not be completed by January 21, 1998 require
renewal of Nationwide permit authorization. In addition, the "new" Nationwide Permit No. 26 will
permanently expire on December 13, 1998. The NCDOT believes that it is appropriate to pursue
reauthorization of this project due to these expiration dates.
The project was authorized under Nationwide Permits No. 14, 26, and 33. It is expected that the sites
authorized under Nationwide 14 and 33 can be renewed without complications. Only two of the project
sites were authorized under Nationwide 26. The first of these is Site 4 of R-2219AA This site involved
the construction of a new culvert approximately 300 feet long, and placement of fill in 1.66 acres of
wetlands. The culvert at this site has been constructed. It is anticipated that all fill activities at this site
will be completed by January 21, 1998, although additional construction in uplands will take place. The
second Nationwide 26 site is Site 2 of R-2219AB. This site involves the placement of fill in 0.541 acres

of wetlands. Although project construction is just beginning, it is expected that placement of fill in this
wetland area can also be completed by January 21, 1998, although additional project work will continue
in uplands. Consequently, the NCDOT requests that the previously issued Nationwide Permits No. 14
and 33 for this project be renewed to allow construction to extend beyond January 21, 1998.
In addition, the contractor for project section R-2219B has requested authorization to use three disposal
areas for excess material. These areas were all investigated for impacts to wetlands and waters of the
United States by Dr. J. H. Carter and Associates, Inc. These sites were also inspected in the field on
June 17, 1997 by NCDOT staff, the contractor, and Ms. Cyndi Bell of the N.C. Division of Water
Quality (DWQ). Intermittent streams were identified at all three sites, but no wetlands will be impacted.
At Site 1, the limits of fill were adjusted to eliminate encroachment on the perennial section of the
stream. Ms. Bell determined in the field that the three sites would not require authorization under
General Water Quality Certifications and that stream mitigation would also not be required. Maps of
these sites are enclosed for your information. The NCDOT hereby requests approval by the Corps of
Engineers for the contractor to use these sites.

The North Carolina Department of Transportation (NCDOT) applied for the
Section 404 permits required for the proposed Pittsboro Bypass by letter dated June 16,
1995. The project was authorized under Nationwide provisions of Section 404 on
November 22, 1995. The NCDOT received approval of the 401 Water Quality
Certification on February 29, 1996.
Since the permits were received, it has been determined that the plans for
construction of the bridge over the Haw River need to be modified. It will be necessary to
build lateral extensions of the temporary construction causeway in order to construct the
drilled shafts for the bridge. This will require additional fill in waters of the United States.
Enclosed you will find a modified set of drawings for the eastern section of the project
(TIP No. R-2219B). The modifications are shown on sheets 2 through 4, and summarized
on sheet 8. The modified design will require that approximately 3602.5 cubic yards of fill
be placed in the river, affecting 0.608 acres of surface waters. This material will be
removed following construction.

Construction Sequence
Phase I
Step 1
Place Class II Riprap for construction causeway.
Build 6.1 meter causeway for Bents 2, 3, 4 and 5.
Install substructures for Bents 1, 2, 3, 4 and 5.
Install girders and bridge deck supported by Bents 1, 2, 3, 4 and 5.
Step 2
Once Step 1 is completed, remove construction causeway.
Phase H
Step 1
