This letter transmits notice of a civil penalty assessed against Waterfront Group NC, LLC in the amount
of $3,596.70, which includes $596.70 in investigative costs. Attached is a copy of the assessment
document explaining this penalty.
This action was taken under the authority vested in me by delegation provided by the Secretary of the
Department of Environment and Natural Resources and the Director of the Division of Water Quality.
Any continuing violation(s) may be the subject of a new enforcement action, including an additional
penalty.
Within thirty days of receipt of this notice, you must do one of the following three items:
1. Submit payment of the penalty:
Payment should be made to the order of the Department of Environment and
Natural Resources. Payment of the penalty will not foreclose further enforcement
action for any continuing or new violation(s). Do not include the attached waiver

Submit a written request for remission or mitigation including a detailed
justification for such request:
A request for remission or mitigation is limited to consideration of the reasonableness of the
amount of the penalty and is not the proper procedure for contesting the accuracy of any of
the statements contained in the assessment letter. Because a remission request forecloses the
option of an administrative hearing, such a request must be accompanied by a waiver of your
right to an administrative hearing and a stipulation that there are no factual or legal issues in
dispute. You must execute and return to this office the attached waiver form and the attached
"Justification for Remission Request" which should describe why you believe:
(a) one or more of the civil penalty assessment factors in G.S. 143B-282.1(b) were
wrongfully applied to the detriment of the petitioner;
(b) the violator promptly abated continuing environmental damage resulting from the
violation;
(c) the violation was inadvertent or a result of an accident;
(d) the violator had been assessed civil penalties for any previous violations;
(e) payment of the civil penalty will prevent payment for the remaining necessary

Acting pursuant to delegation provided by the Secretary of the Department of Environment and
Natural Resources and the Director of the Division of Water Quality, I, Al I -lodge, of the Division
of Water Quality (DWQ), make the following:
FINDINGS OF FACT:
A. ' Waterfront Group NC, LLC is a Corporation organized and existing under the laws of
the State of North Carolina, which owns and has developed a site known as Riversound
Development in Chowan County, North Carolina.
B. 15A North Carolina Administrative Code (hereby known as NCAC) 021-1.1003 (b)
requires that "To ensure the protection of surface waters of the State in accordance with
G.S. 143-214.7, a permit is required in accordance with the provisions of this Section for
any development activities which require a CAMA major development permit or a
Sedimentation/Erosion Control Plan and which meet any of the following criteria: (1)
development activities located in the 20 coastal counties as defined in Rule .1002 (4) of this
Section;"
C. Chowan County is a Coastal County as defined by 15A NCAC 214 .1002(4).
D. The land disturbances associated with the Riversound Development site required an
Erosion & Sedimentation Control Plan.
E. The Division of Land Resources received an Erosion & Sedimentation Control Plan for
the Riversound Development - first phase on July 27, 2006 and approved the plan on
August 1, 2006. This plan was revised on November 20,�2007.
F. On September 12, 2006, DWQ Washington Regional Office issued a State Stormwater
Management Permit, number SW7060729, to Waterfront Group NC, LLC for the
construction of the first phase of Riversound Development.
G. On October 30, 2007, DWQ staff from the Washington Regional Office inspected the
first phase of the Riversound Development site and observed the following:
1. The two bioretention stormwater treatment systems were not completed in
accordance with the approved plans and permit prior to construction of impervious
surfaces.
2. Many of the road side swales were constructed with side slopes steeper than the
approved and permitted 3:1 (H:V) side slopes.

H. Condition Il.l .of permit SW7060729 states that "The stormwater management system
shall be constructed in its entirety, vegetated, and operational for its intended use prior to
the construction of any built -upon surface,.per the approved plans."
I. Condition 11.5.of permit SW7060729 states that "The facilities shall be constructed as
shown on the approved plans."
J. On October 30, 2007, DWQ staff from the Washington Regional Office inspected a
second phase 2 of the Riversound Developement site and observed that the graveled
access drive to the waste treatment facilities had been constructed. The drive isle
resulted in an increase in impervious surface at this site or otherwise decreased the
infiltration of precipitation into the soils.
K. The Division of Land Resources received an Erosion & Sedimentation Control Plan for
the second phase of Riversound Development on November 7, 2007 and approved those
plans on November 28, 2007.
L. DWQ Washington Regional Office file review indicated that a State Stormwater
Management Permit has not been issued for the second phase of Riversound
Development.
M. On November 21, 2007, DWQ issued a Notice of Violation to Waterfront Group NC,
LLC for violations of G.S. 143-215.1, failing to obtain a State Stormwater Management
Permit for the second phase of Riversound Development and for permit conditions
violation of SW7960519 for the first phase of Riversound Development.
N. The cost to the State of the enforcement procedures in this matter totaled $ 596.70.
Based on the above Findings of Fact, I make the following:
I1. CONCLUSIONS OF LAW:
A. Waterfront Group NC, LLC is a "person" within the meaning of G.S. 143-215.6A
pursuant to G.S. 143-212(4).
B. Waterfront Group NC, LLC held a valid Stormwater Management Permit, Number
SW7060729, issued on September 12, 2006, for the construction of the first phase of
Riversound Development,
C. Waterfront Group NC, LLC violated Condition 11. Lof permit SW7060729 by failing to
construct the stormwater management system in its entirety, vegetated and operational
for its intended use prior to the construction of any built -upon surfaces.
D. Waterfront Group NC, LLC violated Condition I1.5.of permit SW7060729 by failing to
construct the facilities in accordance with the approved plans.
E. Waterfront Group NC, LLC violated 15A NCAC 21-1 .1003 by failing to secure a
Stormwater Management Permit prior to the start of development of the second phase of
the project known as Riversound Development.

F. Waterfront Group NC, LLC may be assessed civil penalties in this matter pursuant to
G.S. 143-215.6A(a)(2), which provides that a civil penalty of not more than twenty-five
thousand dollars ($25,000) per violation per day may be assessed against a person who is
required but fails to apply for or to secure a permit required by G.S. 143-215.1, or who
violates or fails to act in accordance with terms, conditions, or requirements of such
permit or any other permit or certification issued pursuant to authority conferred by this
Part.
G. Waterfront Group NC, LLC may be assessed civil penalties pursuant to G.S. 143-215.6A
(a)(6) which provides that a civil penalty of not more than twenty-five thousand dollars
($25,000.00) dollars per violation may be assessed against a person who violates a rule
of the Commission implementing this part, Part 2A of this Article, or G.S. 143-355(k).
H. The State's enforcement cost in this matter may be assessed against Waterfront Group
NC, LLC pursuant to G.S. 143-215.3(a)(9) and G.S. 143B-282.1(b)(8).
I. Al Hodge, of the Division of Water Quality, pursuant to delegation provided by the
Secretary of the Department of Environment and Natural Resources and the Director of
the Division of Water Quality, has the authority to assess civil penalties in this matter.
Based upon the above Findings of Fact and Conclusions of Law, I make the following:

Accordingly Waterfront Group NC, LLC is assessed a civil penalty of:
$ for violating Condition I1.1. of permit SW7060729 by failing
to construct the stormwater management system in its entirety,
vegetated and operational for its intended use prior to the
construction of any built -upon surfaces.
$ for violating Condition 11.5. of permit SW7060729 by failing
to construct the facilities in accordance with the approved
plans.
$ 3,000.00 for violating 15A NCAC 214 .1003 by failing to obtain a
stormwater management permit from the Division of Water
Quality for the development of the impervious areas within the
second phase of Riversound Development.

set out in G.S. 143B-282.1(b), which are:
(1) The degree and extent of harm to the natural resources of the State, to the. public health, or to
private property resulting from the violations;
(2) The duration and gravity of the violations;
(3) The effect on ground or surface water quantity or quality or on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by noncompliance;
(6) Whether the violations were committed willfully or intentionally;
(7) The prior record of the violator in complying or failing to comply with programs over which
the Environmental Management Commission has regulatory authority; and
(8) The cost to the State of the enforcement procedures

Enforcement Recommendation against: Waterfront Group NC, LLC for the construction of impervious
area without a valid State Stormwater Permit and for Permit Condition violations of the existing State
Stormwater Permit SW7060729 for the site known as Riversound Development in Chowan County,
NC. The following violations are noted:
• Violations of G.S. 143-215.1 & 15A NCAC 2H .1003 by failing to obtain a stormwater
management permit from the Division of Water Quality for the development of the roads within
the unpermitted second phase of Riversound Development.
• Permit violation of Condition II.1. of SW7060729 by failing to construct the stormwater
management system in its entirety, vegetated and operational for its intended use prior to the
construction of any built -upon surfaces. The parking lot and portions of the roads were
constructed prior to the final construction of the stormwater management systems (2 bioretention
areas and multiple 3:1 sloped grassed swales) in accordance with the approved plans.
• Permit violation of Condition II.5. of SW7060729 by failing to construct the facilities in
accordance with the approved plans.
On October 30, 2007, I performed a site inspection to determine compliance on the project known as
Riversound Development located on Drummonds Point Road, Edenton, within Chowan County, North
Carolina. During the site inspection it was noted that approximately 36,000 square feet (0.83ac) of gravel
road had been constructed without a valid state stormwater permit. The gravel road is located in the
southwest corner of the property and leads back to the newly constructed waste infiltration ponds. This
land area is located in phase 2 of the development, which does not have a valid State Stormwater Permit.
The stormwater runoff from this impervious area drains to Middleton Creek (30-8-2), class C; Sw, and to
an unnamed tributary to Middleton Creek. Middleton Creek drains to the Yeopim River (30-8), class SC
in the Pasquotank River Basin.
During the site inspection of the permitted phase 1 of Riversound, it was discovered that Waterfront
Group NC, LLC violated condition I1.1. of their permit by failing to construct both bioretention areas, in
their entirety, prior to the development of the parking lot and roads that drain into them. One bioretention
area had not been properly bermed up on each end and allowed the runoff from the parking lot to drain
directly out and into the road side swales without proper treatment and neither bioretention area had been
properly planted with the required trees, shrubs and groundcovers as required in the approved plans and
permit. It was also discovered that Waterfront Group NC, LLC had violated condition 11.5. of their permit
by failing to construct the road side swales in accordance with the approved plans. Many of the road side
swales located throughout phase I of the development were constructed with side slopes of 2:1, or steeper
in some areas. The approved plans require that all road side swales should have side slopes of 3:1, or
flatter. Stormwater runoff from these areas drains to the Yeopim River in the Pasquotank River Basin.

On September 12, 2006 the State Stormwater Permit SW7060729 was issued to Waterfront Group NC, ITC
for the construction of Phase l of this development. The permit did not include the additional graveled drive
that was discovered on October 30, 2007. There were also additional violations discovered in the permitted
development that were not in accordance with the approved plans. Construction of the parking and drives
were started without the completion of the stormwater treatment system as required in the permit.
Construction of the streets were also completed without properly sloped 3:1 roadside swales as required in the
permit. Therefore it is believed that these violations were committed willfully and intentionally.
7) The prior record of the violator in complying or failing to comply with programs over which the
Environmental Management Commission has regulatory authority;

Per request of Mr. Scott Vinson, we are submitting the following response to the Notice of
Violation letter for the Riversound Development dated November 21, 2007.
Item 1: Phase 2 development without a permit
Erosion and Sedimentation Control Plans for Phase II A and Phase lI B have been approved and
a stormwater plan is in the process of being developed,
Item 2: Bioretention areas were not fully planted
The bioretention areas are in the process of being planted according to the approved Stormwater
permit SW7060729 dated September 12, 2006.
Item 3: Roadside swales were not properly constructed
Because of the difficulty in establishing vegetation during this time of the year, the roadside
swales will be reconstructed according to the approved plan sometime before the end of April
2008.

As requested by Mr. Scott Vinson, we are submitting the following response to the Notice of
Violation letter dated November 19, 2007 for the Riversound development. This NOV was
specific to the wetlands impacts during construction. The following violations were noted:
1) Failure to secure 401 Water Quality Certification
2) Wetland Standard Violation
3) Removal of Best Use
4) NCG0100000 Condition violation
These violations will be addressed by December 20, 2007 and will include a wetlands restoration
plan and stream restoration plan. Phase 11 A and B Erosion and Sediment Control Plans have
since been approved along with Phase I Amendment that includes the additional disturbed
acreage not covered under the original Erosion and Sediment Control permit

The application packages for the referenced project were delivered to this office after 12- noon on October 19, 2007.
We regret to inform you but we are unable to accept the project into the express permitting review process due to the
applications being incomplete. The original applications and fees are being returned to Shield Engineering.
Yesterday, October 25, 2007, representatives of the Division of Water Quality & Land Quality held a conference
call with Mr. Keith Anthony of Shield Engineering to explain the reasons for not accepting the applications into the
express review process. Additional guidance was provided to help with the permit applications.
The express program is designed to improve the permitting process by accepting high quality applications into the
process through a submittal meeting. Not all projects will be candidates of the express review process due to its
complexity. To improve communication and expedite this program as it is intended, it is required for the consultant
and the applicant to attend the submittal meetings together with the Divisional review staff. Therefore, for any
future request for express permitting will require your attendance along with your consultant to the submittal
meetings.

This letter is to notify you that the Washington Regional Office of the Division of Water Quality
is considering taking an enforcement action for violations of 15A North Carolina Administrative Code
2H .1000, This regulation states that a stormwater permit is required for any development activities in
a Coastal County in which a Sedimentation/Erosion Control Plan is required. A file review has
confirmed that the new development covered under Phase 2 requires an erosion and sediment
control plan approval, is located in a coastal County, and is therefore required to have a State
stormwater permit.
On October 30, 2007 Mr. Scott Vinson of this office inspected the site of Riversound
Development, Phase 1 & Phase 2, located ,off Drummonds Point Road, near Edenton, in Chowan
County, North Carolina. At that time it .was found that the proposed gravel drives to the waste
infiltration basins and other un-permitted roads had been constructed. This office received a
stormwater permit application for this Phase 2 project on October 19, 2007 to be submitted into the
Express Review Program and was returned on October 26, 2007 due to insufficient applications. As
of this date a State Stormwater Permit has not been issued for this project.
Please be advised that this development activity without a valid permit is a violation of 15A
NCAC 2H .1003 and may subject you to appropriate enforcement actions in accordance with North
Carolina General Statute 143-215,6A which provides that a civil penalty of not more than twenty-five
thousand dollars ($25,000.00) per violation may be assessed against a person who fails to secure a
permit.
Also on. October 30, 2007 Mr. Scott Vinson conducted a• compliance inspection on the
development covered under stormwater permit number SW7060729, Phase 1, and discovered
numerous permit condition violations. At that time is was discovered that the proposed parking lot
and drive isle located near the boat ramp was constructed without the prior completion of the entire

stormwater management system, which is in violation of permit item 11.1.. The bioretention areas
were not fully planted and graded to allow for the appropriate storage and infiltration of the
stormwater runoff. Item 11.1. states that the stormwater management systems shall be constructed in
its entirety, vegetated and operational for its intended use prior to the construction of any built -upon
surfaces per approved plans.
It . was also discovered during the inspection that many of the road side swales were'
constructed with steep side slopes at 2:1 (horizontal -vertical), and even 1:1 in some places. This is a
violation of permit condition item I. 4:, which states that each designated grassed swale shown on the
approved plans must be maintained at 3:1 (H:V) side slopes or flatter, maintain a dense vegetated
cover, and be located in either a dedicated common area or a recorded drainage easement.
Please be advised that North Carolina General Statute 143-215.6A(a)(2) provides that a civil
penalty of not more than twenty-five thousand dollars ($25,000) per violation may be assessed
against a person who is required but fails to act in accordance with the terms, conditions or
requirements of such permit or any other permit or certification issued pursuant to the authority
conferred by the general statues.
If you have an explanation for these violations that you wish to present, please respond to the
Washington Regional Office within 10 days after receipt of this Notice. Your explanation will be
reviewed and considered when making a determination whether to proceed with an enforcement
action. Please also provide a written "Plan of Action" which outlines the actions that will be taken to
correct these violations and a time frame for the completion of those actions.

Dear Mr. Bragg:
This office received a Coastal Stormwater permit application and plans for the subject project on
August 7, 2006. A preliminary review of the project indicates that before a State Stormwater permit can
be issued the following additional information is needed.
1) Please provide your title within Waterfront Group NC, LLC. A managing member or partner
must sign any applications and supplement forms.
2) Please provide the original signed copy of the application and any supplement forms. The two
application forms submitted were only copies of the original.
1 3) Please provide 2 complete copies of sealed, signed and dated stormwater plans. The two copies
provided were not sealed.
t 4) Under Section III, no.6 of the application form, please provide additional drainage areas, one
drainage area for each of the two bioretention areas. These drainage areas need to be labeled and
shown clearly on the plans. Also, please provide the impervious area to be deeded to each of the
224 lots in the impervious area listed in the second table under no.6 "Impervious* Surface Area".
These lot impervious numbers can be listed under "Other on -site".
5) Please provide a plan sheet showing .the two entire bioretention drainage areas at a scale of
1"=60' or smaller to help show elevations, impervious area, stormwater drainage and treatment.
6) Please reconfigure the amount of impervious area given to each lot. While overall the
subdivision may have less than 30% impervious coverage proposed, there are many lots (>100)
that individually will have much more than 30% impervious coverage if they were allowed
10,000sf per lot. For each individual lot, that lot may use up to 25% of wetlands on that lot in
order to calculate the maximum allowed impervious area on that lot. No more than 10% of the
total lots, or 22 lots out of 224, in this phase of the subdivision may be allowed to have more
impervious area than 30%, but no more than roughly 34%.
7) Please fill out and provide the attached Bioretention Area Supplement form, one for each of the 2
bioretention areas. (Submit the original signed & notarized documents and one copy of each.)

8) Although the "statewide" BMP manual does give an example sizing equation for bioretention
areas based on either 5% or 7% of the drainage area, the Coastal Stormwater Rules require that
the first I inch runoff be collected and treated. Please provide additional calculations showing the
minimum required 1" volume for the two drainage areas and the corresponding calculations
showing the provided storage volumes available in each bioretention area.
9) Please provide all necessary elevations on the Bio-Retention Area 91 Detail found on sheet SW-
5. (bottom, top, overflow, etc.)
10) Please provide a complete soils report including date and location of borings to help verify soil

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each lot number, size and the allowable built -upon area for each lot must be provided as an attachment.
1. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
tnl0 as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than 104 o(9J square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do riot include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the storrtnvater control system shall be performed in a mariner that maintains the integrity
and performance of the system as permitted.
By your signature below, you certify that the recorded deed restrictions and protective covenants for this project
shall include all the applicable items required above, that the covenants will be binding on all parties and persons
claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the State, and that they will be recorded prior to the sale of any lot.
