A few weeks ago, I forwarded you the Stormwater Management System Maintenance Compliance Inspections (NCDEQ Permit #SW7040910) report ("the Report"). My understanding is that the Stormwater devices are in need of maintenance. Your clients, BB Southampton Mews, LLC and BB Hamilton Cay took assignments of declarant rights at various times. For instance, BB Southampton Mews, LLC agreed to "accepted such transfer and assume the obligations of `Declarant"' under the Declaration of Devonshire Place Condominium recorded at book 1648, page 13 of the Dare County Register of Deeds. BB Hamilton Cay, LLC agreed to "accepted such transfer and assume the obligations of `Declarant"' under the Declaration of Hamilton Cay Condominium recorded at book 1709, page 133 of the Dare County Register of Deeds. The Bermuda Bay development is less than 50% built -out. And, under N.C.G.S. §143- 214.7 (c2), we do not believe the permit for these devices should therefore be transferred to the Association now. Further, some of the areas identified on the Report are not formally part of Bermuda Bay in any event. Therefore, we believe your clients have responsibility for the items mentioned in the Report. As I understand it, the permit needs to be renewed 15 October 2018, so please review and contact me to discuss at your earliest convenience. I apologize for the delay in responding. I think the most important operative fact is that, at this stage, and for the last number of years, it is my understanding that the Stormwater Permit No. SW7040910 is in the name of the Bermuda Bad' Owners Association. As the permitee, your client has agreed to maintain all of the Stormwater Management Facilities. It is your client that is responsible to the State of North Carolina for the proper maintenance, repair and management of the Stormwater Management Facilities. To be candid, I am not sure I understand your argument pursuant to N. C.G.S. § 143-214.7(c2). I certainly acknowledge that portions of the existing Stormwater Management Facilities are located on properties owned by my client. However, your client is the permitee. The fact that Bermuda Bay Development is less than. 50% built out is immaterial. Your client requested and obtained a transfer of the original permit into their name. N.C.G.S. §143-214.7(c2) is not applicable. Your letter was unclear, but I am assuming that you are not arguing that my client has any responsibility for issues concerning the Stormwater Management Facilities on lands that are not owned by my client. If I understand your argument to be that since we own lands upon which portions of the existing Stormwater Management Facilities are located, we therefore have an obligation to maintain those items. Certainly, we are not the only party that obtained an assignment of Declarant Rights. Furthermore, based on your argument that we have an obligation to maintain those Stormwater Management Facilities, does that also mean we have the right to remove them from our property? Let me also refer you to the original Declaration for Bermuda Bay, as recorded in Deed Book 1648,Page 10, as amended, hereinafter the "Declaration". Section 7.1 of the Declaration provides in part "The Association shall be responsible for management and Upkeep of all of the Common Elements, the cost of which shall be assessed against all lots as a common expense." The Declaration defines the term"Upkeep" to mean care, inspection, maintenance, operation, repair, repainting, remodeling, restoration, improvement, renovation, alteration, replacement and reconstruction. Further, under the Definitions, Section 1.1 defines the term "Common Element" to mean, among other items, "the Permit or Permits for stormwater facility assigned by the Declarant to the Association or otherwise procured or acquired by the Association [emphasis added]. Your client procured or acquired the permit. Therefore, it is a Common Element. Therefore, your client is responsible for its upkeep. If you will farther review Article 8 dealing with transfer of the permit and responsibilities, it clearly indicates that "from and after the transfer of the permit from the Declarant to the Association, the oversight, supervision, management and administration of the permit shall be the sole responsibility of the Association. The Association's duties with respect to the permit shall be carried out in accordance with the terms of the Association documents and the permit." Articles 8 clearly indicates that the transfer of the permit to the Association could occur prior to the total build out and therefore, the Association would have an obligation to maintain all of the Stormwater Management Facilities, irrespective if those lands were still owned by the original developer. It is probably why our letter was answered how it was. The declarant went bankruptcy. The HOA in the transfer no longer exists and the declarant responsibilities were moved to the new owners through purchase of the properties we talk about in our letter. It is our contention that the developers, until their properties are developed, are responsible for maintenance until the 50% development of the PUD. There is no transfer of the maintenance responsibility to the current HOA we can find. How does the state look upon bankruptcy issues such as this and follow on responsibilities? As stated in the letter, we do not own the land upon which the majority of storm water management facilities exist. The declarant, Mr Anderson, owned the land and therefore could maintain the areas. Owners should maintain their properties. We are in a trespass situation should we maintain their properties as we have no easements associated with these lands. I have a few questions before I can proceed with the possible transfer of the Stormwater Permit into the name of the Bermuda Bay Homeowners Association. And of course, the signer of the Operation and Maintenance Agreements will be subject to the answers to these questions. One of the requirements of The Change of Ownership Form is that ownership of all the common areas has been transferred to the HOA. This, in fact, has not occurred. Some of the common areas have been transferred, but some are still retained in the name of Bermuda Bay, LLC. Transfer of ownership was always planned to be a staged process. When the market stalled, so did development as well as the process of transfer of common areas. If someone other than the property owner(s) will be applying for the permit, the property owners must either legally transfer ownership to the Bermuda Bay I-IOA OR provide documentation of le fal agreement allowing the Bermuda I3ay -IOA to accept the responsibility on behalf of the property owners for constructing and/or operating and maintaining, the permitted stormwater management system. The Maintenance Agreements state "The legally responsible party should not be a homeowners association unless more than 50% of the lots have been sold and a resident of the subdivision has been named the president". Neither of these have occurred. This requirement will be waived for your situation. However, the person signing on behalf of the HOA must be Pres/VP/or member -manager level. I think we all are in agreement that the logical course of action is to have the permit ownership as well as the maintenance agreements transferred into the name of the association, however due to the reasons outlined above, I do not know if these transfers are possible. We may need to keep the permits in the name of Bermuda Bay, LLC and change the Signing Official's name and address. I will await your feedback on this. The 50% rule was set up to prevent the situation where only one or two homeowners are present in a 25 lot or greater subdivision and are forced to be responsible for the entire development. Clearly, this is not the case at Bermuda Bay. Please continue to fill out these forms and send to my attention. This does not create a conflict for DWQ In the mean time, I have walked the site with the developer and discussed the physical maintenance issues involved with the various basins and ponds. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system. a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surfaces except roads. b. During construction, erosion shall be' kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to: 5 a. Semi-annual scheduled inspections (every 6 months) b. Sediment removal C. Mowing and revegetation of side slopes d. Immediate repair of eroded areas e. Maintenance of side slopes in accordance with approved plans and specifications f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. 4. Records of maintenance activities must be kept and made available upon request to authorized.personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. This permit shall become voidable unless the facilities are .constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. III. GENERAL CONDITIONS 1. This permit is not transferable. In. the event there is a desire for -the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). A 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules,. regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. After every runoff producing rainfall event and at least monthly inspect the infiltration system for erosion, trash accumulation, vegetative cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetated cover to maintain a maximum height of six inches, and remove trash as needed. 3. After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage and repair thc� structure to approved design specifications. 4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when depth in the pretreatment unit is reduced to 7517o of the original design depth. The system shall be restored to the original'(1esign depth without over -excavating.' Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Reinoved sediment shall be disposed of in an appropriate manner and shall riot be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream, etc.). A benchmark shall be established in the pretreatment unit. The benchmark wi':1 document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device Lased to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. After every runoff producing rainfall event and at.least monthly inspect the infiltration system for erosion, trash accumulation, vegetative cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain acicquatc vegetative cover, mow vegetated cover to maintain a maximum height of six inches, and remove trash as needed. 3. After every runoff producing rainfall event and tit',least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage anti repair thte structure: to approved design specifications. 4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when depth in the pretreatment unit is reduced to 75% of the original design depth. The system shall be restored to the original design depth without over -excavating. Over -excavating may cause the requires, water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment crevice or stream, etc.). A benchmark shall be established in the pretreatment unit. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The meas�inng device used to determine the depth at the benchmark shall be suAh that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the design depth reads (0'56 feet in the pretreatment unit, the sediment shall be removed from both the pretreatment unit and" the infiltration basin. 5. If the Division determines that the system is failing, the system will immediately be repaired to original design specifications. WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT The wet detention basin system is defined as the wet detention basin, pretreatment including forebsays and the vegetated filter if one is provided. Inspect and repair the collection system (i.e.. catch basins, piping, swales, riprap, etc.) qt; irterly to maintain proper functioning. 4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is. reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of in an appropriate manner and shall be han&ed'in a manner that will not adversely impact water quality (i.e. stockpiling near a wet detention basin or stream, etc.). WET DETENTION BASIN OPERATION AND MAINTENANCE AGREEMENT The wet detention basin system is defined as the wet detention basin, pretreatment including forebcays and the vegetated filter if one is provided. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation, vegetated cover, and general condition. b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within 2 to 5 days as designed. 2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. 3. Inspect and repair the collection system (i.e_ catch basins, piping, swales, riprap, etc.) quarterly to maintain proper functioning. 4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to 75% of the original design -depth (see diagram below). Removed sediment shall be disposed of in an' appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near a wet detention basin or stream, etc.). The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. S. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size b. Project name change C. Change of ownership d. Redesign or addition to the approved amount of built -upon area e. Further subdivision of the project area. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 6. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame -specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system. a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surfaces except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to. 5 a. Semi-annual scheduled inspections (every 6 months) b. Sediment removal C. Mowing and revegetation of side slopes d. Immediate repair of eroded areas e. Maintenance of side slopes in accordance with approved plans and specifications f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. S. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate: The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. After every runoff producing rainfall event and at least monthly inspect the infiltration system for erosion, trash accumulation, vegetative cover, and general condition. 2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow vegetated cover to maintain a maximum height of six inches, and remove trash as needed. 3. After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow structures for blockage and deterioration. Remove any blockage and repair thstructure to approved design specifications. 4.. Remove. accumuIate d sediment from the pretreatment system and infiltration basin annually or when depth in.the pretreatment unit: is reduced to 75% of the original design deptl -.,The system shall be restored to the, original design depth without over -excavating. Over -excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not he handled in a manner that will adversely impact water quality (i.e. stockpiling near a stormwater treatment Device or stream, etc.). A'benchmark shall be established in the pretreatment unit. The benchmark will document the original design depth so that accurate sediment accumulation readings can be'taken. The measuring device used to determine the depth at the benchmark shall be such that it will give at,, accuntte depth reading and not readily penetrate into accumulated sediments. Wh.en the design depth reads ,50 feet in the pretreatment unit, the sediment shall be removed from both the pretreatment unit and the infiltration basin. 5. If the Division determines that the system is failing, the system will it;smediately be repaired to original design specifications. If the system cannot be repaired to perform its design function, otter stormwater control devices as allowed by NCAC 2H .1000 must be designed, approved and constructed.
