Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW7021109 dated January 27, 2003 to NC Department of Commerce. This permit replaces all previous stormwater permits for this site, and shall be effective from the date' of issuance until January 27, 2013, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in.future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you- have- the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. No homeowner/lot owner/developer shall be allowed to fill in, alter, or pipe any vegetative practices (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 5. The following items will requi-re a modification to the permit: a. Any revision to the approved plans, regardless of size b. Project name change C. Change of ownership d. Redesign or addition to the approved amount of built -upon area e. Further subdivision of the project area. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 6. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system. a. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surfaces except roads. b. During construction, erosion shall be kept to a' minimum and any eroded areas of the system will be repaired immediately. 2. The facilities must be properly maintained and operated at all times. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency including, but not limited to: 5 a. Semi-annual scheduled inspections (every 6 months) b. Sediment removal C. Mowing and revegetation of side slopes d. Immediate repair of eroded areas e_ Maintenance of side slopes in accordance with approved plans and specifications f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of five years from the date of the completion of construction. III. GENERAL CONDITIONS 1. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6(a) to 143--215.6(c). 1.1 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may be modified, revoked and reissued or terminated for cause. PROJECT SUMMARY: The applicant proposes to install a floating platform to add 4 new slips and remove an existing section of pier eliminating 3 slips for a net gain of I slip. N. C. Seafood Industrial Park Authority - Wanchese c/o Bob Peele - Director Dare County Umphlett Marina Express Permit Review Program Project setting Bob Peele, on behalf of the N. C. Seafood Industrial Park Authority, has requested the attached application be processed under the Express Permit Review Program, for the installation of a floating dock. The project site is located in Wanchese at 898 Harbor Road (off SR 1140) at Umphlett Marina, Lot 12 of the Seafood Industrial Park at the mouth of Broad Creek off Roanoke Sound in Dare County, North Carolina. Umphlett Marina is a tenant in the Seafood Industrial Park and to date all permits issued in the park have been under the name of the Park Authority for specific lots and/or tenants. Previous CAMA Major Permits issued to the Park Authority include Nos. 2-77,139-80, 175-84, 120-80, 63- 88, 124-94, 50-98, 91-98, 23-99, 64-99, 100-99, 147-00, 68-01, 90-02, 29-03,140-03,119- 05, and 106-09. Major CAMA Permit No. 90-02 was issued to the Park Authority on 6 August 2002 for the development of Umphlett Marina and the permit authorized. a maximum of 28 slips. The project went through the SEPA process and received a FONS1 prior to the issuance of the Major CAMA Permit. The permit was modified on 21 April 2003, was extended once, and expired on 31 December 2007. The Park Authority's land encompasses t54 acres around a manmade basin and along Broad Creek and currently has various marine based tenants, with numerous slips in various configurations within the basin. The tenants include the US Coast Guard, various boat builders, commercial fishing operations, and various marine supply businesses. As previously stated, the project site is located on Lot 12 and the current tenant is Umphlett Marina. Lot 12 totals t0.97 acres (42,390 ft2) and has 196' of shoreline along Broad Creek. The property is developed with a 75' by 1 00'steel building (currently vacant) which includes an office and bathroom. The bulk of the remaining area on the property is packed gravel or concrete with a small amount of maintained grass along the access road. The shoreline has a Coastal Wetland fringe t35' wide that is vegetated with SSpartina alterniflora along the waterline transitioning to Juncus r emerianus, Distichlis spicata, and then a significant stand of phragmites as well as other wetland grasses. An approximately 30' wide area of maintained upland grasses separates the wetland area from the metal building and gravel parking area. An 8' wide by t200' long pier with 16 finger piers creating 28 slips is located along the eastern half of the lot projecting into Broad Creek. Three boatlifts have been installed in slip numbers 12, 16 and 17 and currently have boats in the lifts. All other slips were empty at the time of this onsite investigation: Along the western property line, an 8' by 200' pier projects into Broad Creek with a 6.5' by 70' floating platform attached to the fixed pier at a right angle towards the downstream side for staging of boats. A steel sheet pile breakwater runs along the outside of the aforementioned pier and floating dock and projects t100' past the floating dock ending t35' waterward of the 28 slip pier. N. C. Seafood Industrial Park Authority - Wanchese c/o Bob Peele - Director Dare County Umphlett Marina Express Permit Review Program Page Two The project site is bordered to the west by a marine repair business and to the east by an existing gravel drive, parking area and boat ramp with a short section of wooden bulkhead and riprap. The eastern property is the site of Bailey Marina authorized under Major CAMA Permit No. 140-03 which is currently undergoing a modification to install a wider boat ramp. The site is t7' above the normal water level. The Estuarine Water of Broad Creek is classified as SA; HQW by the Environmental Management Commission and is closed to shellfishing at the project location. Project description The applicant proposes to install a 6.5' by 90' floating platform extension adjacent the inshore side of the existing breakwater and create 4 new side to slips. The proposed slips will be used as a staging area for new boats produced by Gunboat Yacht Building Company, a new tenant in the Park with no in water facilities. The new boats will be launched at the aforementioned adjacent boat ramp at Bailey Marina. To accommodate the floating platform extension, approximately 26' (208 ft2) of the existing pier structure will be removed eliminating 3 existing slips (identified on the plat as slips 13,14 and 15). This allows an adequate distance (50') between the pier and existing breakwater to access the proposed side to slips along the floating platform. The existing section of floating dock will be shifted slightly waterward towards the breakwater to line up with the new section of proposed floating dock. The existing water depth at the location of the side to slips adjacent the floating dock is 4'-5' below the NWh. The project as proposed will result in a net change of one additional slip at the site for a total of 29 slips. Anticipated impacts The project as proposed will result in the shading of 585 ft2 of creek bottom associated with the floating dock installation. The removal of the 26' pier section will result in a net increase in shading of 377 #t2.[No n we impervious surf proposed with this CqTject.�The project will result in localized turbidity as a result ofthe construction activities. Lot 12- Umphlett Marina Wanchese Seafood Industrial Park CAMA Major- Project Narrative Existing Conditions The site is a 0.97 acre parcel of land located near the end of Harbor Road and owned by the N.C. Seafood Industrial Park Authority (Seafood Park) in Wanchese, Dare County, North Carolina. In 2002, this site received a FONSI related to marina development through the SEPA Environmental Assessment process. On 8/6/2002 this project received a CAMA Major Permit for a 28 slip marina (CAMA Major 90-02), modified on 4/21/2003. The parcel of land (Lot 12) is located adjacent to the Roanoke Sound. The upland portion of the property is dominantly covered with a gravel parking lot and a metal building which has been leased in the past to industrial and retail marine operations. At this time the building is vacant. Marina related structures in place include a fixed pier with 28 slips, another fixed pier without slips, a pile -supported breakwater structure and a 70' floating pier adjacent to the breakwater that is accessible by a metal ramp. In 2010 the Seafood Park requested authorization to add three boat lifts (slips 12,16 and 17). This reduced the size of the adjacent existing slips. All existing conditions are depicted on the CAMA Plan. Proposed Work CAMA Major 90-02 expired on 12/31/2007 and the Seafood Park was informed that any future work must be permitted under a new CAMA Major Permit. Currently proposed work requiring CAMA permitting includes installation of 90 ft by 6.5 ft floating platform for a new slip, removal of 26 ft of existing pier and slip reconfiguration. The reconfigured slips are labeled New Slip #1, New Slip #2, New Slip #3 and New Slip #4. These are side -to slips intended to provide staging areas for boat haul out and new boat launching, primarily associated with Gunboat yacht building company. A commercial ramp has recently been permitted on the adjacent property that will be used to launch the new boats. This permitted boat ramp is depicted on the CAMA Plan and intended to be constructed in November 2012. Need The Seafood Park has recently welcomed Gunboat, a sailing catamaran yacht builder. The company originally planned to create 71 jobs and invest more than $1.8 million over the next three years in Wanchese. They have already created over 35 jobs and it is projected that even more than their predicted number of jobs will be added if the appropriate infrastructure is in place for the operation. The Park opened in 1981. Park lands include 53 acres and an 15-acre boat basin and a wastewater treatment system. Entrance to the Park is by Harbor Road from Highway NC 345. The Wanchese Seafood Industrial Park) Zoning District (WSIP) is established for the continuation of the existing general maritime and marine,related uses, industries and activities and to promote future development and activities within the boundaries of the Park, as governed by the Authority. Land uses in the Park are regulated and created by the Authority, which is authorized and empowered to by the State of North Carolina to acquire, construct, maintain, equip and operate any wharves, docks, piers, warehouses and other structures, and any and all facilities needful for the convenient use of the same in the aid of commerce within the Park. Section Two Water Quality Policy WQw Local efforts to develop aquaculture as a source of fisheries production are supported provided the proposed fishery or fish species does not negatively impact fisheries. Dare County supports efforts bythe State of North Carolina to promote locally harvested seafood. Policy WQ#14 Dare County recognizes the traditional practices of commercial fishing In Dare County and supports the use of traditional shellfish and fish harvesting methods including trawling and beach haul netting. Vehicular access to Dare County beaches by commercial fishermen Is essential to their continued livelihood. Implementodon Strategy: 1. (2010-2015) Marinas and Floattng Structures Another appropriate issue for discussion under the water quality management topic is marinas and floating structures. As noted in the fisheries resources discussion, commercial and recreational fishing are vital to the local economy. The Importance of boat -building in the local economy and its role in the heritage cf Dare County has been documented. Boating access and boat dockage were discussed during the review of water quality issues. With so much of our geographic region covered by water, there is a high demand for boat access and boat dockage. Water quality regulations must be balanced with the high demand for boating access to the surrounding water bodies. Many visitors travel to Dare County to access our local waters for fishing, watersports, or simply to enjoy being out on the water. Commercial fishermen and charter boat captains need access to the water and docks to practice their trade. In discussing marina development, the Planning Board referenced the extensive review process for any new marina proposal. it was the consensus of the Planning Hoard that all appropriate water quality Issues would be addressed during the exhaustive CAMA major permit review process by the 21-agencies involved in this process. The LAMA regulations define a marina as any public or private dock or wet storage facility that accommodates more than 10 boat slips. Locally, the Dare County Zoning Ordinance includes certain districts In which marinas are designated as appropriate uses. The Dare County Zoning Ordinance defines a marina as a business having frontage an navigable waters which provides mooring slips and docking facilities. There is no threshold of slips included In the Dare County definition. The need to balance water quality issues with the high demand for access was emphasized by Planning Board members and the resultant policies written to reflect this position. The location of dry stack storage facilities is regulated by the Dare County Zoning Ordinance with height limitations of such facilities set forth In the Zoning Ordinance. All previous versions of the land use plan have Included a policy opposed to the mooring or use of floating homes and structures within the jurisdictional waters of unincorporated Dare County. The CAMA regulations state that it is the policy of the State of North Carolina that floating structures shall Pagel" �. �... __.. Section Two Water Quality '1 not be allowed within the public trust waters of the coastal area except in permitted marinas. A �l floating structure is defined In the CAMA rules as any structure, not a boat, supported by a means of Rotation, designed to be used without a permanent foundation, which Is used or Intended for human habitation or commerce and establishes standards for when a boat is rendered to function as a floating structure. The Planning Board indicated support of the 2003 pollcy opposing floating homes and structures as defined In the CAMA regulations. In discussing this policy during the 2009 update, it was noted that CAMA regulations permit gloating homes and/or structures in approved marinas. The Planning Board indicated that regulations to prohibit the location of floating homes/structures in any jurisdictional water of Dare County should be considered. Policy WCW15 Marinas, developed according to applicable State and federal guidelines are identified as appropriate uses In Dare County due to the large amount of water resources within our jurisdiction. Facilities bulk for dry -stack storage of boats should be consistent with height limits and gross floor area limitations of applicable Dare County zoning codes. Implementation Strategy: 1. Encourage marina operators to participate in the voluntary Clean Marina certification program administered by the State of North Carolina Division of Coastal Management Policy WQ#16 . 1-- Dare- County, is strongly opposed to the mooring of floating homes and other floating structures ! designed for habitation anywhere in Dare County and Its surrounding waters. This policy shall not be Interpreted to preclude the permitting of floating accessory structures for recreational water use associated with kiteboarding or other water use activities. implementation Strategy. (2011) Policy Impacts on CAMA Management Goats and Objectives The Dare County water quality policies are consistent with the goals and objectives established by CAMA forthis management topic. Each policy has been reviewed with a status ranking of beneficial, neutral or detrimental noted for each policy.
