APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Vick:
You have our approval to install tcmpor?uy fill in 0.068 acres of wetlands or waters for the purpose
of constructing the US 1 bride over Haw River, as you described in your application dated 26 January,
1996 . After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2727. This certification allows you to use Nationwide Permit Number 33
when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached Certification. The additional
conditions for DEM Project #94647 still apply to this project. In addition, you should get any other
federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for .in ad ' judicatory
hearing. You must act within (4) days of the date that you receive this letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

SUBJECT: Chatham County, Widening of US I and improvements to the Haw River
Bridge, Modification to COE ID No. 199101629 (issued November
18, 1994), DEM Project N 94647, '.I.P. Project No. R-250013, State
Project No. 6.409006T.
The N.C. Department of Transportation is proceeding with the widening of US 1
in accordance with the above mentioned permit. However, the project contractor has
determined that two temporary piers will need to be constructed in the Haw River. These
piers will provide access for the construction of the new bridge structures. Each pier will
be about 20' by 75', and will consist of steel piles supporting a treated wood deck. The
only impacts below ordinary high water will be the twelve steel piles. It is expected that
construction in this area will be completed by October, 1997, and the piers will be entirely
removed within 30 days of the completion of construction.
This situation has been discussed with Ms. Jean Manuele of the Raleigh Regulatory
Field Office who requested this notification. Since the contractor is ready to begin work,
the NCDOT requests that this application be reviewed as soon as possible. By copy of
this transmittal, the NCDOT also requests that the N.C. Division of Environmental
Management review the proposed work. Attached you will find a pre-discharge
notification form and plan sheets depicting the proposed piers. If you need any additional
