On Behalf of The County of Currituck, I hereby submit for review and approval a North Carolina Division Of
Water Quality, Stormwater Management Permit Application package for the proposed kitchen addition to the
Currituck Law Enforcement Center.
The proposed kitchen addition is contained entirely within its own drainage area and, therefore, does not.
contribute runoff to, or alter in any way, the existing stormwater management system. Pursuant to this condition,
the stormwater management system for the new addition is being permitted as a stand-alone system with its own
independent drainage area and the permit application does not address the existing system.
The project proposes to build a kitchen addition that will serve the prison and to expand the on -site parking for
the Law Enforcement Center employees. The proposed kitchen addition and parking expansion will result in the
addition of 32,290 sf of impervious area, resulting in 106,752 sf, or 24% total coverage for the site. The
Stormwater Management Plan for the proposed development will utilise overland flow through vegetated buffers
to provide filtration and collection in adjacent infiltration basins to provide infiltration of stormwater. The
enclosed narrative will explain in detail the stormwater management of this site.

Revisions to hxisting Infiltration Basin
Dear Ms. Franklin;
I am sending this package as a follow-up to our conversation regarding the existing stonnwater pernlit for the
Currituck Law Enforcement Center site.
You are currently reviewing an application package for stonnwater associated with a Kitchen Addition at the
Law Enforcement Center site. 'file infrastructure lbr the addition was designed such that all runoff from
impervious areas associated with this new construction is collected independent of the existing stormwater
management system and conveyed to a new infiltration basin at the southern extremity of the site. This package
does not change that proposal in any way.
The original infiltration basin was configured in such a manner that storage is located too close (within 100') to
all existing County water supply well. The enclosed plan, supplement, and calculations propose to re -configure
that existing basin in order to honor the needed setbacks. As per our phone conversation, a note has also been
added to the plan sheet clarifying that no wetlands exist on the project site.
Please note that even though this reconfiguration does not alter the system associated with the Kitchen Addition
in any way, we are requesting that this re -configuration be included in the permit currently being processed as the
re -configuration will be made a part of the Kitchen Addition plans and the work will be performed by the Kitchen
Addition Contractor.

This office received a Coastal Stormwater permit application and plans for the subject project on
January 20, 2006. A preliminary review of your project indicates that before a State Stormwater permit
can be issued the following additional information is needed.
➢ Please provide additional soils information for the area along the fence.
➢ Please provide an engineer certification for the existing infiltration basin.
➢ Please note that the existing infiltration basin should have 3:1 side slopes.
The above requested information must be received in this office prior to May 10, 2006 or your
application will be returned as incomplete. The return of this project will necessitate resubmittal of all
required items including the application fee. If you need additional time to submit the required 'information,
please mail or fax your request for time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to
any development activity, Construction without a permit is a violation of 15A NCAC 211.1000 and North
Carolina General Statute 143-215.1 and may result in civil penalties of up to $10,000 per day.

I am sending this package in response to your April 10`I' letter regarding your review of the above referenced
application. Upon review of the plans and a site inspection, you requested additional information as follows:
Request: Please Provide additional soils irrfnr)nation fr)r the area along the,fence.
Response: Warren Eadus, a Licensed Geologist on our staff, visited the site and took three additional
borings for our reference; two along the fence line and one within the main area of the proposed
infiltration basin. Boring Logs are attached. As shown in the logs, the soils consist generally of'
fine silty sands with a layer of clayey fine sands at T-T of depth. The excavation for the
infiltration basin will remove this clayey sand layer (excavation will generally be 3' deep
throughout), leaving only fine sand to silty fine sand. This remaining soil will be suitable for
placement of an infiltration system.
Request: Please pi-ovlde a)1 engineer Certlf Catlon.fJr the existing infiltration basin.
Response: I have attached an engineer certification for the existing infiltration basin. Please note that the
certification lists as an exception to grading of the side -slopes, which will be corrected with other
basin modifications proposed with this application.
Request: Please note that the evlsting infiltration hasln should have .3: 1 side slUPes.
Response: I have added a note requiring a re -grade of the basin side -slopes in order to provide the originally
proposed 3:1 slope. An 8 ''/2" x I I " plan excerpt showing this notation has been attached to this
letter.

stormwater management facilities at the Currituck County Law Enforcement Center, the facilities were

The infiltration basin side -slopes appear to have been constructed at a slope exceeding the 3:1 maximum
slope.
Modifications to this existing infiltration basin are the subject of a new permit application (SW7020216-Mod)
and include re -grading of the infiltration basin side -slopes to conform to the 3:1 maximum.

The Washington Regional Office received the completed
Stormwater Application for the subject project on April 19, 2002.
Staff review of the plans and specifications has determined that
the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW70020216 dated April 19, 2002 to Currituck County for
an infiltration basin to serve the Currituck County Law Enforcement
Center located adjacent to the Currituck County Airport.
This permit shall be effective from the date of issuance until
April 19, 2012 and shall be subject to the conditions and
limitations as specified therein. Please pay special attention to
the Operation and Maintenance requirements in this permit. Failure
to establish an adequate system for operation and maintenance of
the stormwater management system will result in future compliance
problems.
If any parts, requirements, or limitations contained in this
permit are unacceptable, you have the right to request an
adjudicatory hearing upon written request within thirty (30) days
following receipt of this permit. This request must be in the form
of a written petition, conforming to Chapter 150B of the North
Carolina General Statutes, and filed with the Office of
Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447.
Unless such demands are made this permit shall be final and
binding.

I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and
volume of stormwater described in the application and other
supporting data.
2. This stormwater system has been approved for the management of
stormwater runoff as described on page 2 of this permit, the
Project Data Sheet.
3. Approved plans and specifications for this project are
incorporated by reference and are enforceable parts of the
permit.

4. No homeowner/lot owner/developer shall be allowed to fill in,
alter, or pipe any vegetative practices (such as swales) shown
on the approved plans as part of the stormwater management
system without submitting a revision to the permit and
receiving approval from the Division.
5. The following items will require a modification to the permit:
a. Any revision to the approved plans, regardless of size
b. Project name change
C. Transfer of ownership
d. Redesign or addition to the approved amount of built -
upon area
e. Further subdivision of the project area.
In addition, the Director may determine that other revisions
to the project should require a modification to the permit.
6. The Director may notify the permittee when the permitted site
does not meet one or more of the minimum requirements of the
permit, within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director
for modifying the site to meet minimum requirements. The
permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have
been made.
II. SCHEDULE OF COMPLIANCE
I. The permittee will comply with the following schedule for
construction and maintenance of the stormwater management
system.
a. The stormwater management system shall be constructed in
its entirety, vegetated and operational for its intended
use prior to the construction of any built -upon surfaces
exdept roads.
b. During construction, erosion shall be kept to a minimum
and any eroded areas of the system will be repaired
immediately.
2. The facilities must be -properly maintained and. operated at all
times. The approved operation and Maintenance Plan must be
followed in its entirety and maintenance must occur at the
scheduled intervals.
3. The permittee shall at all times provide the operation and
maintenance necessary to assure the, permitted stormwater
system functions at optimum efficiency including, but not
limited to:

a. Semi-annual scheduled inspections (every 6 months)
b. Sediment removal
C. Mowing and revegetation of side slopes
d. Immediate repair of eroded areas
e. Maintenance of side slopes in accordance with approved
plans and specifications
f. Debris removal and unclogging of outlet structure,
orifice device and catch basins and piping.
4. Records of maintenance activities must be kept and made
available upon request to authorized personnel of DWQ. The
records will indicate the date, activity, name of person
performing the work and what actions were taken.
5. This permit shall become voidable unless the facilities are
constructed in accordance with the conditions of this permit,
the approved plans and specifications, and other supporting
data.
6. Upon completion of construction and prior to operation of this
permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other
supporting documentation. Mail the Certification to the
Washington Regional' Office, 943 Washington Square Mall,
Washington, North Carolina, 27889, attention Division of Water
Quality.
7. A copy of the approved plans and specifications shall be
maintained on file by the Permittee for a minimum of five
years from the date of the completion of construction.
III. GENERAL CONDITIONS
1. This permit is not transferable. In the event there is a
desire for the facilities to change ownership, or - there is a
name change of the Permittee, a formal permit 'request must be
submitted to the Division of Water Quality accompanied by an
application fee, documentation from the parties involved, and
other supporting materials' as may be appropriate. The
approval of this request will be considered on its merits and
may or may not be approved.
2. Failure to abide by the conditions and limitations contained
in this permit may subject the Permittee to enforcement action
by the Division of Water Quality, in accordance with North
Carolina General Statute 143-215.6(a) to 143-215.6(c).
3. The issuance of this permit does not preclude the Permittee
from complying with any and all statutes, rules, regulations,
or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as
the construction of additional or replacement stormwater
management systems.
5. The permit may be modified, revoked and reissued or terminated
for cause. The filing of a request for a permit modification,
revocation and reissuance or termination does not stay any.,
permit condition.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS

2. No more than 112,292 square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do -not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the
integrity. and performance of the system as permitted.

IV. INFILTRATION BASIN OPERATION AND MAINTENANCE AGREEMENT
i . After every runoff producing rainfall event and at least monthly inspect the infiltration system for erosion,
trash accumulation, vegetative cover, and general condition.
2. Repair eroded areas immediately, re -seed as necessary to maintain adequate vegetative cover, mow
vegetated cover to maintain a maximum height of six inches, and remove trash as needed.
3. After every runoff producing rainfall event and at least monthly inspect the bypass, inflow and overflow
structures for blockage and deterioration. Remove any blockage and repair the structure to approved
design specifications.
4. Remove accumulated sediment from the pretreatment system and infiltration basin annually or when
depth in the pretreatment unit is reduced to 75% of the original design depth. The system shall be restored
to the original design depth without over -excavating. Over -excavating may cause the required water
table separation to be reduced and may compromise the ability of the system to perform as designed.
Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner
that will adversely impact water quality (i.e. stockpiling near a stormwater treatment device or stream,
etc.).
A benchmark shall be established in the pretreatment unit. The benchmark will document the original
design depth so that accurate sediment accumulation readings can be taken. The measuring device used
to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not
readily penetrate into accumulated sediments.
When the design depth reads feet in the pretreatment unit, the sediment shall be
removed from both the pretreatment unit and the infiltration basin.
`, if the Division determines that the system is failing, the system will immediately be repaired to original
design specifications. If the system cannot be repaired to perform its design function, other stormwater
control devices as allowed by NCAC 2H -1000 must be designed, approved and constructed.

Treatment
Stormwater runoff from proposed parking areas and travel aisles will be directed via paving surface grading to
flow to the northern and western edge of the parking areas where it will pass through a 2' wide gravel shoulder
where large particulates and debris will accumulate. This runoff will then flow overland into the proposed
infiltration basins, passing across the vegetated infiltration basin side slopes.
The basin bottoms will be grassed according to the general seeding specifications and maintained according to
the operation and maintenance plan. The runoff will undergo filtration of fine particulates and pollutants by
the vegetation within not only the basin and swale bottoms but also the basin and swale side walls which will
also be seeded according to the general seeding specifications. The filtration by the vegetation is considered
the primary treatment method. If the weather yields precipitation that exceeds the storage capability of the
basin system then the accumulated runoff will overflow into an existing ditch system to the north of the
property. It is unlikely during normal weather patterns, when considering storage volumes in conjunction
with infiltration rates that the infiltration basins will ever over flow their boundaries. A secondary treatment
method is also available when the stormwater runoff infiltrates into the subsurface. When the water passes
through the void spaces between the particles of soil material particulates and pollutants that have a particle or
grain size larger than the void size will be filtered out. In addition some pollutants will adsorb to the surface
of the soil particles. The benefit of this adsorption will prevent the pollutants from reaching the water table
and in some nutrient and microbe rich areas existing within the subsurface the pollutants will be consumed as
food and undergo a natural biodegradation.
Storage
It should be noted that there is no storage requirement associated with the low density permit being applied
for. However, since the land was readily available, and in the interest of minimizing flows from the site into
the surrounding ditch systems, infiltration basins are being provided. This infiltration basin system will offer
a portion of storage above the ground surface and a portion of storage within the void spaces available in the
subsurface. The infiltration basins will offer storage in excess of the first 1 inch of runoff. The first I inch of
runoff generated by all surfaces, pervious and impervious within the basin drainage areas will require
approximately 5,520 ft3 of storage. The runoff generated by a 4.3 inch storm (which is widely recognized as
the 10-year, 2-hour storm event for this area) will require 23,737 ft3 of storage. The storage available above
the ground surface is 23,238 ft3. This storage value is equal to approximately 4.3 inches of runoff over all
surfaces, pervious and impervious within the basin drainage areas. Additional storage is available within the
subsurface in the two (2) feet of separation between the basin bottom and the seasonal high water table and
the additional separation between the submerged basin side -slopes and the seasonal high water table. This
subsurface storage will provide for an additional 10,740 ft3 of storage. The addition of the above ground
storage and the subsurface storage is not quantified due to the fact that the above -ground storage noted above
is roughly equivalent to the runoff generated by the 10-year, 2 hour storm (4.3 inches of runoff over all
surfaces).
Disposal
The majority of stormwater runoff entering this management system will be infiltrated, therefore infiltration
will be the primary source of disposal. The system has been designed with adequate storage so that this site
will have the capability to handle a 4.3 inch, 10 year, 2 hour storm if such a weather event should occur. At
such time that the capacity were to be exceeded the system will then overflow into adjacent Swale system to
the north which will act as an emergency backup to this proposed system.
Soils
As per a geotechnical study by Geotechnical Environmental Testing Solutions, Inc., soils are comprised of
mostly loose to medium dense fine sands and silty sands with very little slope overlaid with a layer of topsoil
and rootmat within the top 8 inches of soil. Groundwater was encountered approximately 6 feet below
existing grade (equivalent to an elevation of approximately 10.0'). These soils are well drained with moderate
permeability. A copy of the boring logs from the aforementioned geotechnical study are included in the
appendix of this narrative.

General
This project proposes the redevelopment 1 conversion of the existing Maple Prison as a Law Enforcement
Center housing Highway Patrol, Detectives', and Magistrate's offices in conjunction with a County Detention
Facility. The site is comprised of 10.37 acres of land situated immediately to the west of the Currituck
County Airport on SR 1246 approximately 3840 feet north of the intersection of U.S. 158 and SR 1246. The
project consists of conversion of an existing prison to a Law Enforcement Center, involving the demolition of
several outbuildings, construction of one new small office building, additions and renovations to several
existing buildings, and associated parking and utility improvements. The project site currently contains built -
upon area of 47,041 square feet and proposes new built -upon area of 27,700 sf for a total built -upon area of
74,741 sf, or 16.5% of the project area. Therefore, the project is being developed as a "Low Density"
development.
The Stormwater Management Plan will utilize overland flow through vegetated buffers to provide filtration
and collection in adjacent infiltration basins to provide infiltration of stormwater runoff generated by the
proposed development. The following narrative will discuss specifically permissible built upon areas,
Stormwater collection, treatment, and disposal, and a brief discussion of soils.
Allowable Built Upon Area
The Stormwater regulations allow for a maximum coverage of 30% for inclusion in the "low density"
classification. The total land area used in calculations for this project is 10.37 acres. This area is comprised
of one developable parcel.
The total coverage proposed in the Stormwater Management Plan for this site is 1.72 acres (74,741 sf).
The allowable coverage based on the 30% maximum allowable coverage as outlined in the NCDE & NR,
DWQ, Administrative Code Section 15A NCAC 2H .1000 Stormwater Management for properties adjacent to
SC waters is, 10.37 acres x 30%(.30) = 3.1 acres (135,515 sf ).

the northern and western property lines.
The soils found in the field are in general agreement with the United States Department of Agriculture, Soil
Conservation Service, Soil Survey of Currituck County. According to the Soil Survey of Currituck County,
the following soil types are predominant in the area of the proposed development according to
Conetoe Loamy Sand, 0 to 3 percent slopes, moderately rapid permeability.
Conclusion
The stormwater management system proposed for the proposed Currituck County Law Enforcement Center
will more than adequately serve this renovation project and provides controls above and beyond those which
are prescribed by the project's low density classification.
