compliance and intent of the approved plans and specifications.

Certification Requirements:
1. The drainage area to the system contains approximately the permitted
acreage.
­412. The drainage area to the system contains no more than the permitted
amount of built -upon area.
3. All the built -upon area associated with the project is graded such that the
runoff drains to the system.
4. All roof drains are located such that the runoff is directed into the system.

7. Trash rack is provided on the outlet/bypass structure.
8. All slopes are grassed with permanent vegetation, per the vegetation plan.

circuiting of the system.
11. The permitted amounts of surface area and/or volume have been
provided.
12. Required drawdown devices are correctly sized per the approved plans.
13. All required design depths are provided.

The Division of Water Quality (Division) is in receipt of the engineering certification for the two biorentention
cells at the above referenced project. The Division now.considers the violation issued on June 10, 2011
resolved to our satisfaction.
Please note that you will be required to convert the pond to the dimensions and specifications in your approved
stormwater permit upon release of its use as a sediment basin by the Division of Land Resources. This includes
removal of all accumulated sediments to ensure proper depths and dimensions. The wet detention basin must be
certified by a professional engineer'upon conversion. Please forward the Certification to the Division when it is
completed.
Please also note that you are required to maintain and operate these stormwater management practices in
perpetuity per Stormwater Permit No. SW4080902 issued October 1, 2008. Routine inspections are required
per the signed Operation and Maintenance Plan you submitted with your permit application. In addition, Please
note that Condition 11.5, requires that the permittee submit an annual summary report of all maintenance and
inspection records.

You have indicated that the wet detention basin is currently being used as a sediment basin in accordance with
your approved Erosion Control Plan. The Division apologizes for its confusion regarding the status of this
pond. Please disregard all items noted in the Notice of Violation letter dated June 10, 2011 that are regarding
the wet detention basin and follow your approved Erosion Control Plan and any direction provided by the
Division of Land Resources.
Please note that you will be required to convert this pond to the dimensions and specifications in your approved
stormwater permit upon release of its use as a sediment basin by the Division of Land Resources. This includes
removal of all accumulated sediments to ensure proper depths and dimensions. The wet detention basin must be
certified by a professional engineer upon conversion. Please forward the Certification to the Division when it is
completed.
You have requested until August 5, 2011 to construct both Bioretention Cells in accordance with your
stormwater permit. The Division hereby accepts this proposed schedule of completion. Please submit as -built
plans and an engineer's certification for Bioretention Cell #1 and Bioretention Cell #2 by August 5, 2011.

process to make sure we build the biocells properly. If I can have till Friday August the
5th 2011 both biocells will be completed and ready for an inspection by NCDFNR.The
wet detention basin is still serving the purpose of a sediment pond until the stabilization
of the entire job. The last phase of construction should be stabilized by November 2011.
At this point the wet detention pond will be built to the final step of the stormwater permit
specifications.
I will straw,seed and apply matting around both inlets and clean out around the skimmer
in the wet detention pond. I will have the wet detention pond repairs made by Friday
,tune the 30th 2011.1 apologize on the delay of this violation. This is the first time I have
ever done a job of this magnitude. I was under the impression that NCDENR would tell
me when to complete the biocells. All violations will be corrected and be done in the
specifications of our stormwater permit.

On October 1, 2008 the Division of Water Quality (Division) issued a High Density Property Stormwater
Permit for the proposed West Pointe Luxury Apartments Project in Asehboro, NC in Randolph County. On
June 7, 2011, Sue Homewood from this Division conducted a routine inspection of the approved Stormwater
Collection and Treatment System. The following items were noted during their inspection and a subsequent file
review:
1. Condition II.7 of Permit No. SW4080902 requires that an engineer's certification must be received by
the Division prior to occupancy of the project.
2. Condition II.5 of Permit No. SW4080902 requires that the "permittee shall submit to the Division an
annual summary report of the maintenance and inspection records for each BMP". An engineer's
certification has not been received for the stormwater management facilities however previous
inspection records from the Division indicate that apartments at the site have been occupied for at least
one year.
3. Condition I1.6 of Permit No. SW4080902 requires that "the facilities shall be constructed as shown on
the approved plans." The site inspection determined the following discrepancies.
o Biorctention Cell 41 does not match the approved shape and size.
a Bioretention Cell #1 does not have the approved outlet structure.
a Bioretention Cell 41 and Cell #2 do not have the approved 3:1 side slopes.
o Neither bioretention cell show indications of having the approved underdrain system and
cleanout pipes.
o The vegetation present in the bioretention cells does not match the approved planting plans.

Bioretention Operation and Maintenance Agreement
I will keep a maintenance record on this BMP. This maintenance record will be kept in a
log in a known set location. Any deficient BMP elements noted in the inspection will be
corrected, repaired or replaced immediately. These deficiencies can affect the integrity
of structures, safety of the public, and the removal efficiency of the BMP.
Important operation and maintenance procedures:
Immediately after the bioretention cell is established, the plants will be watered
twice weekly if needed until the plants become established (commonly six
weeks).
Snow, mulch or any other material will NEVER be piled on the surface of the
bioretention cell.
— Heavy equipment will NEVER be driven over the bioretention cell.
-- Special care will be taken to prevent sediment from entering the bioretention cell.
— Once a year, a soil test of the soil media will be conducted.
After the bioretention cell is established, I will inspect it once a month and within 24
hours after every storm event greater than 1.0 inches (or 1.5 inches if in a Coastal
County). Records of operation and maintenance will be kept in a known set location
and will be available upon request.
