State of North Carolina Department of Environment, Health and Natural Resources Division of Water Quality James B. Hunt, Jr., Govemor Jonathan B. Howes,Secretary A. Preston Howard, Jr., P.E., Director AT4 4?1j- 10 C) EHNR August 6, 1996 Ashe County DWQ Project # 960705 APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS Mr. D. K. Bennett N.C. Dept. of Transportation P.O. Box 250 North Wilkesboro, NC 28659 Dear Mr. Bennett: You have our approval to place fill material in 0.01 acres of wetlands or waters for the purpose of replacing pipe culverts at SR 1599 in Ashe County, as you described in your application dated 24 July 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3026. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Applicant is reminded to install type A erosion control measures since the watershed is classified as trout water. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786. Sincerely, tn Howard, Jr. P.E. Due to the proximity of a small stream being a trib. to Big Peak creek Class-C-trout-+ we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the 2 existing cross line drainage structures that will need replacing, and or extending. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, and marked county map. By copy of this letter I am asking Ms. Stephanie Goudreau Mt. Region Coordinator with the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone, and I am asking Ms. Goudreau to comment directly to me concerning the Trout water buffer zone encroachment. .r Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act.from the Division of Environmental Management.
