Box 250 North Wilkesboro, NC 28659 Dear Mr. Bennett: You have our approval to place fill material in 0.14 acres of wetlands or waters for the purpose of improving SR 1371, as you described in your application dated 2 April 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3027. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Applicant is reminded that sediment and erosion control measures for High Quality Waters shall be used for this project. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Dear Mr. Thomas, The Department of Transportation is scheduled to grade, drain base, and pave primarily along.the existing roadway of SR 1371 (Joe Weaver Rd)., in Ashe County during the 1995-1996 fiscal year. Due to the proximity of a small stream, (Lost Branch) Creek Class- c-trout we are requesting a 404 Nationwide permit no. 3 to allow us to upgrade the 10 existing cross line drainage structures that will need replacing, and or extending. Attached is a straight line sketch with proposed erosion control, stream, stream embankment, pipe crossing, and marked county map. By copy of this letter I am asking Ms. Stephanie Goudreau Mt. Region Coordinator with the North Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide Permit request. A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of Lost Branch and I am asking Ms. Goudreau to comment directly to me concerning the Trout water buffer zone encroachment. Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. Stone for plain rip rap shall consist of field stone or rough unhewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will not be permitted. The stone or broken concrete shall be graded to meet the following requirements: 1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds. At least 30 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. 2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250 pounds. At least 60 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 100 pounds each. Not more than 5 percent of the total weight of the rip rap may be in individual pieces weighing less than 50 pounds each. 691 r EROSION CONTROL SCHEDULE (1) All adequate temporary erosion control measures will be installed before clearing and grubbing operations begin. (2) As construction progresses temporary and permanent erosion control devices shall be installed in a timely manner, according to any special permit requirements and /or requirements set out in G.R. 113A-57. MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY Piirnriant to G . S . 113A-57(3), Provisions for a ground cover sufficient to restrain erosion must be accomplished within 30 working days or 120 calendar days following completion of construction or development, whichever period is shorter, except as provided in 15A NCAC 4B .0024(e).
