You have our approval to place fill material :in 0.02 acres of wetlands or waters for the purpose of
improving SR 1481 from SR 1479 to existing pavement, as you described in your application dated 26
January 1996 . After reviewing your application,'we have decided that this fill is covered by General
Water Quality Certification Number 3026. This certification allows you to use Nationwide Permit
Number 3 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing., You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-74=7. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-

Dear Mr. Jolly:
The North Carolina :Department of Transportation, District I Maintenance plans to grade
this road primarily along the existing alignment in the 1996 - 1997 Fiscal Year. We will be
replacing/extending existing pipes which involve live streams at Station 18-1-30, 34-1-65, and
44100. We will also be extending or replacing various other pipe culverts throughouL the
project which do not involve live streams. WE., will be encroaching upon the 25' trout str6m,
buffer as follows: 1) Rt of Station 0+00 to 31-45. No work in this area will exceed the existing
slopes. We will use a ditch section Co lessen impact to the stream. 2) Rt of Station 5+50 - A
spring head is located approximately 48 foot right of the corner line at this station and 23
feet from the toe of the proposed fill slope. Wager flows away from the project and not
parallel to the project at this location.
We are requesting a 404 Nationwide Per (io(43 aintenance) from your agency.
I am sending a straight line sketch with the proposed erosion control, stream, and cross
sections of the affected areas. In addition, I am sending a typical section of the road, general
notes oil erosion control and a marked rriap.
By copy of this letter I am asking Ms. Stephanie Goudreau, Mountain Region Coordinator of
the North Carolina Wildlife Resources Corrlmission to comment directly to you concerning the
404 Nationwide Permit request.
A request will be made on this project for a Temporary Encroachment in the Trout Water
Buffer Lone of tributaries to DEHNR Trout Stream (Big Pine Creek) and I am asking Ms.
Goudreau to comment directly to me concerning the Trout Water Buffer Zone Encroachment.
Also, by copy of this letter, I am requesting authorization t.o proceed under Section 401 of the
Clean Water Act from the Division of Environmental Management.

Silt Basin Type B's will be constructed to the dimension of
six feet: by three fee( by three feet unless otherwise noted
on the plans.
Generally, the order of installation of the erosion control
measures w.i l l be as follows:
Temporary silt: basins shall be installed before
clearing and grubbing begins.
Silt fences and temporary silt ditches shall be
installed after clearing and before grading.
Temporary stone ditch checks shall be installed as
soon as ditchl ine is of t:abl ished.
Pipe outlet and inlet: protection will be done as
soon as the pipe is instal led.
Seeding and other pr! rmanent: erosion control
measures are to be implemented as soon as practical

You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose of
improving SR 1481 from SR 1479 to existing pavement, as you described in your application dated 26
January 1996 . After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 3026. This certification allows you to use Nationwide Permit
Number 3 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
