Hey Melonie,
Now that I have the correct DWR project number for UT Sandy Creek/Charles Williams, I found that
DWR has a pretty good electronic file, but it's likely missing key information. After researching the docs I
have online, there are a lot of inconsistencies in the buffer credits than what was submitted with the
Closeout Report. I've attached a few pages from the Restoration Plan, the AsBuilt Report and the Year 1
monitoring report for examples.
Since I can't find the MOA that is referenced in some documents and in the Restoration Plan, I can only
assume it means the MOA between DOT, DMS & the IRT. Which, to my knowledge, doesn't address the
buffer mitigation program. What I am also assuming based on the 2014 Year 1 Monitoring Report
Attribute table, is that DMS may have chosen to apply this 2013 Memo to get credit beyond 50' from
the UT since it wasn't originally described in the Restoration Plan (2009) as getting buffer credit along
the UT or out to 200' and nothing about Grandfathering. But, if applied to the credits, it still was not
applied correctly considering the ratios used are not the ratios described in that 2013 memo. I'm just
having a real hard time tracking what DMS was using to determine its credits from Restoration Plan
Submittal to AsBuilt, to Year 1 Monitoring.
I'm doing the best I can to figure it out based on what i have in the file and the memos I remember DWR
issuing. It would be helpful for DMS to indicate what rules, memos, etc they want to apply to their
credits and provide the correct references along with an appendix of the references in the Closeout
Report for DWR to review. Trying to figure it all out on my end to validate the credits you are requesting
is extremely complicated.
At this point in my review of the file, the only credits I know I can approve are the 1.56 acres of
Enhancement credits along Sandy Creek approved in the Restoration Plan & AsBuilt and possibly some
credits along the UT that comply with the 2013 Memo. Either way, I'm happy to discuss. Please let me
know if you have anything in your files from DWR that may close the loop on some of these questions.
