Dear Sir:
In an application dated March 18, 2008, the North Carolina Turnpike Authority (NCTA)
submitted an Individual Permit application for the Subject project. This application requested
authorization for impacts to jurisdictional features based upon a functional design. The project
had subsequently been awarded via the Design-Build procurement process. The Design-Build
team modified the roadway from Station -L- 195+50 through Station 223+00 (including
permit sites 12-14), presenting this as supplemental information on November 7, 2008 to be
included with the original March 18, 2008 Individual Permit Application. These impacts were
authorized in the 404 Individual Permit (IP) and accompanying Water Quality Certification
(WQC) on February 5, 2009 and November 25, 2008, respectively.
The Design-Build team has now completed their design throughout the remainder of the
project, including minor roadway modifications to Sites 1-8, 10-11, and 15-18 that also
required hydrologic design adjustments. Authorization to construct the project with these
modifications and adjustments are being requested through a modification to the existing IP
and WQC. Buffer Authorization is also requested from NCDWQ for riparian buffer impacts
at Site 16 subject to 15A NCAC 02B .0267 Jordan Water Supply Nutrient Strategy- _Protection-
of Existing Riparian Buffers ( ordan ake Buffer Rules)-A pre-permit submittal
meeting was held at NCDENR, Crabtree Blvd on November 24, 2009 to discuss Jordan Lake
Buffer Rules applicability, site-specific features, and intermittent stream mitigation

requirements. The November 24, 2009 meeting minutes, revised permit drawings, buffer
drawings for Site 16, and roadway plans are included.
The roadway has been redesigned with subsequent grade changes, all of which are within the
original footprint, except for Site 16. These roadway design changes resulted in very minor
changes in the drainage design, resulting in a net increase in impacts. The only noteworthy
changes are Site 5 and Site 16, which are described in detail below. The remaining site
changes are summarized in Tables 3 and 4. Per USACE request, the Design Build Team has
attached to this modification request a memo clarifying the differences between the original
permit (based on Mulkey design plans/impact calculations) and this permit modification
(based on the Team's revised plans/impact calculations).
Site 5. Unnamed Tributary to Kit Creek - Perennial and Intermittent Streams (Sheets
23, 24, 25, and 26 of 105 March 18, 2008 Permit Application)
The revised drawings (Sheets 23, 24, 25, and 26 of 105) indicate that impacts at Site 5 will
change due to additional fill required near the inlet of an expanded ditch added to the project
since the original application was submitted. Although the permanent stream impacts are
increased by 107 LF, temporary stream impacts have been decreased by 90 LF. Most of the
former temporary impacts have been reconsidered as permanent impacts. A summary of the
original and revised impacts at Site 5 is given in the following table.

Site 16. Unnamed Tributary to Burden's Creek - Perennial and Intermittent Stream
(Sheets 72 and 73 of 105 March 18, 2008 Permit Application)
The revised drawings (Sheets 72 and 73 of 105) indicate that impacts at Site 16 will change
due to an upgrade of Ramp D. Specifically, Ramp D had to be re-aligned in order to
accommodate the minimum 50 mph design speed, resulting in a slightly new alignment that
permanently impacts an additional 135 LF of streams with 18 LF of temporary impacts. A
summary of the original and revised impacts at Site 16 is given in the following table.

Temporary wetland impacts remain unchanged at 0.190 acre. Temporary stream impacts were
reduced to 492 LF, as itemized in Table 5. No impacts will occur to open water ponds.

Summary of Mitigable Impacts
As with the original permit application, the additional impacts will be mitigated through in-
lieu payments to the NC Ecosystem Enhancement Program (EEP). A copy of the EEP in-lieu
fee request form is attached and detailed in Table 6. The EEP acceptance letter will be
forwarded to all appropriate parties upon receipt.

MEMORANDUM
The ST Wooten / RK&K Design Build Team won U-4763B as a design build project in late 2008. U-4763B,'rriangle
Parkway in Wake and Durham Counties was partially designed and permitted by Mulkey Engineers and RKK Engineers.
RK&K received permits including the advanced section of construction which was approved November 2008. This section
ran from -L- 161+20 - 240+35.71 and included sites 12-14. The remainder of the project needs to have the permits
reissued. The following list gives a more detailed reason as to why there have been permit impact changes at each location.
Site I: The total increase in stream length affected is 15'. While the roadway design in this location remained
relatively unchanged, the length determined necessary for the construction sequencing of the RCBC has increased
slightly. The overall length of the RCBC has decreased by appr. 17', however the bank tie-in lengths are still the
same or slightly longer. The difference between the original permanent surface water impact length and the
proposed length is +48', and the difference between the original temporary surface impact length and the proposed
length is -33'. It is our belief that the original permanent stream length did not account for the bank stabilization
on the invert in side of the RCBC (approximately 34'). The new permit take accounts for this.
Site 2: The total increase in stream length affected is 19'. The new roadway design accounted for future lane
widening. This included appr. 22' additional shoulder width on the right and appr. 27' additional shoulder width
on the left. The overall length of the RCBC has increased by apps 45'. In the original design, -a 3.81:1 right fill
slope and a 3:1 left fill slope was used whereas 2:1 fill slopes are used in the new design. The difference between
the original permanent surface water impact length and the proposed length is +9', and the difference between the
original temporary surface impact length and the proposed length is +10'. The bank tie-in length downstream in
the original design was appr. 25' longer than what is required with the new RCBC length. We are also providing a
slightly longer temporary stream impact at either end due to construction sequencing.
Site 3: There is no stream at this site, only wetlands. The new roadway design accounted for future lane
widening. This included appr. 26' additional shoulder width on the right and appr. 17' additional shoulder width
on the left. This pushed the cut ditch and berm ditch out farther in to the wetland.
• Site 4: There is a total decrease of 34' in stream length affected. The new roadway design accounted for future
lane widening. This included appr. 14' additional shoulder width on the left. In the original design, a 4:1 left fill
slope was used whereas a 2:1 fill slope was used in the new design. The difference between the original
permanent surface water impact length and the proposed length is -33', and the difference between the original
temporary surface impact length and the proposed length is -F.
• Site 5: The total increase in stream length affected is 17'. The new roadway design accounted for future lane
widening. This included appr. 4' additional shoulder width on the right and appr. 14' additional shoulder width on
the left. The overall length of the RCBC has increased by appr. 20'. The difference between the original
permanent surface water impact length and the proposed length is +107', and the difference between the original
temporary surface impact length and the proposed length is -90'. It is our belief that the original permanent stream
length did not account for the bank stabilization on the invert in side of the RCBC (approximately 70'). The new
permit take accounts for this.
Site 6: The total increase in stream length affected is 30'. The roadway profile for -SR I- was changed
significantly and the alignment for -Y I- was shifted. The overall length of the RCBC under -Y I- has increased
by appr. 6'. The overall length of the RCBC under -L- has decreased by appr.37', however, it empties to an area
between -L- and -SR2- which is considered a total take. The difference between the original permanent surface
water impact length and the proposed length is +21', and the difference between the original temporary surface
impact length and the proposed length is +9'. Additional temporary stream length was added due to construction
sequencing.
Site 7: The total increase in stream length affected is 38'. The new roadway design used a resurfacing grade in
this section of-YI- instead of a new grade. Also in the new design, the turn lane to get on -SRI- north from -Yl-
west was lengthened which caused the shoulder to be pushed out appr. 5' in this area. The difference between the
original permanent surface water impact length and the proposed length is +40', and the difference between the
original temporary surface impact length and the proposed length is -2'. We are unsure how the original permit
didn't account for any permanent surface water impact when the original hydraulic design shows 1 t' of new 54"
pipe beyond the end of the existing pipe and also calls for 7' of riprap along the banks at the pipe outlet. A normal
riprap pad along banks for a 54" pipe should be 18'.
Site 8: The total increase in stream length affected is 16'. The new roadway design pushed out the -SR2-
alignment appr. 5' to the left. The difference between the original permanent surface water impact length and the
proposed length is +2', and the difference between the original temporary surface impact length and the proposed
length is +14'. We are unsure why the original permit didn't account for any temporary surface water impact
since it will be required beyond the slope slakes for construction purposes.
• Site 9: There was no change to the stream impact. Il was a total take in the original permit package and is in the
proposed one also.
Site 10: The total increase in stream length affected is 8'. The new ditch design pushed the slope stakes out
slightly. The difference between the original permanent surface water impact length and the proposed length is -
9', and the difference between the original temporary surface impact length and the proposed length is +17'. We
are unsure why the original permit didn't account for any temporary surface water impact since it will be required
beyond the slope stakes for construction purposes. The original permanent stream impact length might incorrect.
With the slope stakes being pushed out slightly, the permanent stream impact should have increased a little bit, not
decreased.
Site 11: There is a total decrease of 75' in stream length affected. The difference between the original permanent
surface water impact length and the proposed length is -47', and the difference between the original temporary
surface impact length and the proposed length is -28'. The general footprint of the project in this area varied only
slightly. Therefore, the permit take should not have varied very much. The original lengths could possibly be
incorrect.
• Site 12-14: Permit revisions have already been approved and are not part of this new permit mod.
Site 15: The total increase in stream length affected is 35'. -Y3- has a new alignment in the new roadway design.
It has been pushed north. This no longer necessitated a culvert extension on the invert out end but rather an
extension on the invert in end. The original extension on the invert out end was 19'. We are still installing a
riprap pad at the outlet, however it is only appr. 33' as opposed to the originally designed pad which was 97'. We
are now extending the invert in end appr. 20' with appr. 49' of channel tie-in. The difference between the original
permanent surface water impact length and the proposed length is 0', and the difference between the original
temporary surface impact length and the proposed length is +35'. The temporary impact takes in to account the
culvert sequencing.
Site 16: The total increase in stream length affected is 153'. -Y4RPD- was realigned per NCTA to meet a 50mph
design speed. The original design tied in to the existing ramp quicker but only met a 35 mph design speed. For
this reason , the alignment has been pushed out appr. 90' in the area of the jurisdictional stream. Due to the stream
meandering, this has increased the permit take greatly. The difference between the original permanent surface
water impact length and the proposed length is 135', and the difference between the original temporary surface
impact length and the proposed length is +18'. The stream impact between -Y4RPD- and -L- has also been
increased due to the need for construction (temporary impact). The stream impact to the left of-L- has decreased
due to the proposed slope stake now being 2:1 instead of 4:1 in the original design. To alleviate this increase, the
existing 36" RCP under the existing alignment of -Y4RPD- is being removed and the banks set back at 3:1 slopes
with a 3' base. Also, the Special Cut Ditch -Y4RPD- 16+36-20+57 RT acts as buffer filtration providing 421' of
filtration with 227' required in this ditch.
• Site 17: There is a total decrease of 23' in stream length affected. There were minor changes made to the profile
along -Y4RPC-. The RCBC extension decreased by appr. 11'. The difference between the original permanent
surface water impact length and the proposed length is -33', and the difference between the original temporary
surface impact length and the proposed length is +10'. We are unsure why the original permit didn't account for
any temporary surface water impact since it will be required beyond the slope stakes for construction purposes.
• Site 18: There is a total decrease of 30' in stream length affected. There were minor changes made to the profile
along -Y4RPC-. The difference between the original permanent surface water impact length and the proposed
length is -3', and the difference between the original temporary surface impact length and the proposed length is -
27'. A BDO structure and pipe in the original drainage design is no longer being used which helps decrease the
stream impact.

Subject: Pre Permit Modification Submittal Meeting for U4763B Final Design Section -
Triangle Parkway from NC 540 to 1-40 in Wake and Durham Counties
The "Pre-Permit Modification Submittal Meeting" for U4763B Final Design Section was held on
December 24, 2009. The following items were discussed and conclusions reached:
1. Tina Swiezy began with a brief description of the Design Build Team's
understanding of what is required for the project to move forward with the permit
modification for the final design section. The advanced section of the project is
currently under construction. This permit modification includes final design of the
remaining portions of the project.
2. A general discussion of the differences between the original permit based on
Mulkey design plans/permit impact tabulations and the Design Build Team
plans/permit impact tabulations revealed that a memo describing each site and
the differences from the original permit to now will assist Eric in writing the permit
mod. NCTA will provide the Design Build Team with the electronic files used to
produce the original impact tabulations. The Design Build Team will then provide
a memo as requested with the permit mod submittal.
3. A basic review of each site was completed with no new surface water impacts
greater than 40 feet (therefore not triggering Jordan Lake Buffer) were found
except at Site 16. It was determined with Rob Ridings assistance that the buffer
zone would be shown to the toe of fill of the existing Y4RPD and impacts from
this modification beginning beyond the original permit impacts shown at this site.
The existing 36" RCP will be removed with the existing ramp and the roadside
swale between the L and Y4RPD will be designed to filter road drainage as
presented in the meeting. A decision was made not to raise the invert in of the
66" pipe under the L line to avoid interruption of the jurisdictional stream flow.
4. The permit modification will be submitted to the agencies following
NCDOT/PDEA review including the requests above.
