You have our approval to place fill material in waters for the purpose of replacing Bridge # 162
on SR 2233, as you described in your application dated 13 October 1995. After reviewing your
application, we have decided that this fill is covered by General Water Quality Certification Number
2735. This certification allows you to use General Permit Number 031 when it is issued by the Corps
of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Jolly:
The North Carolina Department Of Transportation Bridge
Maintenance Unit, proposes the following project for your
issuance of a Section 404 Permit. The project involves a
designated mountain county in Western North Carolina and we
believe this project can be accomplished under General Permit
SAWC082-N-000-0031.
COUNTY: Surry
BRIDGE: #162 Surry, SR 2233
STREAM: Davenport Creek, Tributary to Fisher River
DESCRIPTION: Replace existing bridge with 1 line of
117"x79" CMPA. Approx. 150 CY of fill
material below normal highwater.
No wetlands involved.
No trout nor HQW involved.
With a copy of this letter, we are also requesting a concurrence
letter from the Wildlife Resources Commission and requesting issuance
of 401 Water Quality Certification from the N. C. Division Of
Environmental Manaaement.
We have attached a site location map, and a sketch of planned
activities. A stringent erosion and sedimentation control
program will be implemented during the project construction and
every effort will be made to complete work in a timely manner.

this project, if necessary. Should you have any questions,
