Box 25201 Raleigh, N.C. 27611-5201 ?1 Dear Mr. Vick: You have our approval to place fill material in wetlands or waters for the purpose of foundation test boring at Bridge # 74 over Nantahala River on SR 1180, as you described in your application dated 15 September 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3027. This certification allows you to use Nationwide Permit Number 6 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. SECRETARY SEP 2 6 1995 SUBJECT: Swain County, Replacement of Bridge No. 74 over Nantahala River, on SR 1180, TIP No. B-2640, State Project No. 8.2990301. The N.C. Department of Transportation (NCDOT) is proposing to replace the existing bridge on SR 1180 over the Nantahala River in Swain County, North Carolina. This project is being processed by the Federal Highway Administration as a "Categorical Exclusion" in accordance with 23 CFR 771.115(b). This project is still in the planning stage, and the project planning report is being prepared. The report is scheduled to be completed in March of 1996. This project occurs in an environmentally sensitive area. Consequently, the NCDOT is conducting an extensive analysis of construction alternatives. The NCDOT's Geotechnical Unit has been tasked with obtaining geological information for at least two alternative bridge locations within the study area. This will be accomplished by a series of foundation test borings. The information obtained in this study will assist the NCDOT in selecting the location for the replacement bridge. Attached you will find maps which show the project location and study area. Please review this proposal for authorization under Nationwide Permit No. 6 for Survey Activities. We anticipate that comments from the NCWRC will be required prior to authorization by the Corps of Engineers. By copy of this letter and attachments, NCDOT hereby requests that NCWRC review this proposal. NCDOT requests that NCWRC forward their comments to the Corps of Engineers. 1) We anticipate that the 401 General Water Quality Certification for Nationwide No. G (Survey Activities) will apply to this project. A copy of this information is being provided to the North Carolina Department of Environment, Health and Natural Resources, Division of Environmental Management, for their review.
