Dear Mr. Bennett:
You have our approval to place fill material in 0.04 acres of wetlands or waters for the purpose
of replacing five existing pipe at Stone Mountain State Park Road, as you described in your
application dated 21 June 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2745. This certification allows you to use
Nationwide Permit Number 3 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

SUBJECT: Nationwide Permit No. 3 to replace 5 existing pipe, Stone Mountain State Park road formerly
lnown as SR 1739 adiacent to East Prong of Roaring River class-c-trout.
Dear Mr. Thomas,
The N.C. Department of Environment, Health and Natural Resources Division of Parks and Recreation,
through Mr. Allen Jeffreys, has requested the Department of Transportation to perform improvements to
the existing road that runs through Stone Mountain State Park. This request will require pipe replacements.
This request was made to upgrade the existing narrow unpaved road to be a paved 18 ft. wide road.
Due to the proximity of a said stream, we are requesting a 404 Nationwide Permit No. 3 to allow us to
upgrade the 5 existing cross line drainage structures that will need replacing, and or extending.
Attached is a straight line sketch with proposed erosion controL stream, stream embankment, pipe crossing,
and marked county map.
By copy of this letter, I am asking Ms. Stephanie Goudreau, Mt. Region Coordinator with the North
Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide
Permit request.

A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of
East Prong of Roaring River. I am asking Ms. Goudreau to comment directly to me concerning the Trout
Water Buffer Zone Encroachment.
Also by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water
Act from the Division of Environmental Management.
We would like to begin construction as soon as possible. If further information is required, please let me
kmow. Your early review and consideration will be greatly appreciated.

EROSION CONTROL SCHEDULE

installed before clearing and grubbing operations begin.
(2) As construction progresses temporary and permanent
erosion control devices shall he installed in a timely
mannAr, according to any special permit requirements
and /or requirements set out in G.S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY

nnrnmplished within 30 working dnvs or 120 calendar
days following completion of constr+.iction or
development, whichever period is shorter, except as

DESIGN STANDARDS IN SENSITIVE WATERSHEDS
P»rauant to G.S. 113A-57(3) provisions for a ground
rover grtffintent to restrain erosion must he
provided for any portion of s land-disturbing
ar-tivity in a HnW zone within 15 working days or 60
calendar days following completion of construction
or development, whichever period .is shorter.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) On projects performed by D.O.T. Maintenance Forces,
req»PSt will promptly be made to the Division Roadside
Environmental Unit for stage and permanent seeding.
(5) Any rr-moval of siltation devices will he based on the
nnnd.itinn of established ground cover of that area the
device i4 serving.
