Dear Mr. Vick:
You have our approval to place temporary fill in 0.28 acres of -.vetlands or waters for the purpose of
replacing Bridge No. 15 over Richardson Creek, as you described in your application dated 31 January
1996. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2727. This certification allows you to use Nationwide Permit Number 33
when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the arched certification. Any material in
the cofferdam ring or above (or in) the concrete block shall be pum-td dry onto high ground before they
are removed to reduce siltation. In addition, you should get any of or federal, state or local permits
before you go ahead with your project.
If you do not accept any of the conditions of this certification. you may ask for an adjudicatory
hearing. You must act within 60 clays of the date that you receive tZis letter. To ask for a hearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7'47. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environme-anal Management under Section 401

Reference the 404 General Permit 31 issued by the Corps of Engineers on
June 5, 1995 and 401 Water Quality Certification issued by the N.C. Division
of Environmental Management on June 22, 1995 for this project. This project
involves the widening of 1.6 miles of US 601, including the replacement of
Bridge No. 15 over Richardson Creek. A single 0.28 acre scrub/shrub wetland
will be filled and a 140-foot channel change will be required on a tributary
to Richardson Creek. The new bridge will be located to the east of the
existing bridge, which will remain open to traffic throughout construction.
The contractor hired to construct this project has requested permission
to use one temporary work platform to facilitate construction of the new
bridge. Attached herein is correspondence detailing the need for the
proposed work platform, as well as construction materials, drawings and
schedules. The contractor has proposed two alternate types of work platform
construction; either a cofferdam ring with wooden cribbing or a group of
precast concrete blocks with timber mats will be used. Cross-section and
overhead drawings of each alternate are provided.
NCDOT does not anticipate any permanent impacts to Richardson Creek as a
result of the proposed work. Please review this material and inform us of
any concerns you may have regarding either type of proposed work platform.

A. NOTIFICATION TO THE CORPS OF ENGINEERS DISTRICT ENGINEER. (REFER TO
ITEM B. BELOW FOR DIVISION OF ENVIRONMENTAL MANAGEMENT APPLICATION RE-
QUIREMENTS AND SPECIFICALLY NOTE NWP 26 DIFFERENCE.)
Certain nationwide permits require notification to the Corps of Engineers before work can proceed. They are as follows:
NWP 5 (only for discharges of 10 to 25 cubic yards)
NWP 7
NWP 13 (only for stabilization activities in excess of 500 feet in length or greater than an average of one cubic yard
per running foot)
NWP 14 (only for fills in special aquatic sites, including wetlands, and must include a delineation of affected special
aquatic sites)
NWP 17
NWP 18 (required when discharge exceeds 10 cubic yards or the discharge is in a special aquatic site and must include
a delineation of the affected special aquatic site, including wetlands)
NWP 21 (must include a delineation of affected special aquatic sites, including wetlands)
NWP 26 (only for greater than 1 acre total impacts and must include a delineation of affected special aquatic sites,
including wetlands)
NWP 33 (must include a restoration plan of reasonable measures to avoid and minimize impacts to aquatic resources)
NWP 37
NWP 38 (must include a delineation of affected special aquatic sites, including wetlands)
For activities that may be authorized by the above listed nationwide permits that require notification, the
applicant shall not begin work
a. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by
the District Engineer, or
b. If notified that an individual permit may be required, or
c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer
and no notice has been received from the District Engineer, and required state approvals have been obtained.
Required state approvals include: 1) a Section 401 water quality certification if authorization is requested for a
discharge of dredged or fill material, and 2) an approved coastal zone management consistency determination if
the activity will affect the coastal area.
Use of NWP 12 also requires notification to the District Engineer, but work may not begin until written
concurrence is received from the District Engineer. The time periods described above do not apply.
Furthermore, requirements to notify the U.S. Fish and Wildlife Service (USFWS), the National Marne
Fisheries Service (NMFS), and the State Historic Preservation Office (SHPO), as indicated below and on the
notification form, do not apply.
B. APPLICATION TO DEM FOR NATIONWIDE PERMIT SECTION 401 CERTIFICATION.
Certain nationwide permits require an application to DEM in order to obtain Section 401 water quality certification.
They are NWP 6, NWP 12, NWP 15, NWP 16, NWP 17, NWP 21, NWP 33, NWP 34, NWP 38, and NWP 40.
Certain nationwide permits were issued general certifications and require no application. They are NWP 3, NWP 4,
NWP 5, NWP 7, NWP 20, NWP 22, NWP 23 (requires notification to DEM), NWP 25, NWP 27, NWP 32, NWP 36,
and NWP 37.
The following nationwide permits were issued general certifications for only limited activities: NWP 13 (for projects
less than 500 feet in length), NWP 14 (for projects that impact waters only), NWP 18 (for projects with less than 10
cubic yards of fill in waters only), and NWP 26 (for projects with less than or equal to one-thud acre fill of waters or
wetlands). Projects that do not meet these criteria require application for Section 4,01 water quality certifications.
C. NOTIFICATION/APPLICATION PROCEDURES.
The attached form should be used to obtain approval from the Corps of Engineers and/or the N.C. Division of
Environmental Management as specified above. The permittee should make sure that all necessary information is
provided in order to avoid delays. One copy of the completed form is required by the Corps of Engineers and seven
copies are required by DEM. Plans and maps must be on 8 1/2 x 11 inch paper.
Endangered species requirement: For Corps of Engineers notifications only, applicants must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the presence of endangered species that may.
be affected by the proposed project.

Request for an addendum to
the Corp of Engineers Permit
Dear Mr. Strickland,

The following information is to inform the NCDOT of our
intentions regarding the upcoming activity required to construct
the 8.1690302 project.
We would like to make a request to use a temporary work
platform in the Richardson Creek for the purpose of gaining
access to interior bent 2.
* A temporary work platform will be required for the
excavation of five (5) three feet and six inch (311-611)
diameter shafts. The platform will sevre as a work place
for a drill rig as it excavates the shafts.
* The platform will be constructed with precast concrete
blocks (3rx3'x3') +/-, metal or timber mats or a fabricated
metal cofferdam dam style ring and miscellaneous wooden
cribbing. A combination of this material will be used based
on existing water conditions.
* The ramp will serve as a means to bridge the existing
retaining wall. It is believed the existing wall will not
sustain the larger loads that construction equipment will
place on it. By providing a bridge we can distribute the
load of the drill rig back to a sound bearing area.
* The platform will be assembled and dismantled with the use
of a crane as the work progresses along bent 2. All small
equipment and materials associated with the work platform
will be removed at the end of each day.

Spoil removal and dewatering of shafts.
* As the shafts are being excavated the spoils will be removed
to a suitable location (away from the waters edge) with the
use of a crane and a skip pan. The work platform will
support the skip pan while material is being placed in it. A
permiable curtain will be suspended around active areas
which will contain the sediment.
* The dewatering of the shaft will be provided by the use of
submersible pumps and hoses. The discharge hose will
deposit the water into an approved sedimentation basin.
As the shafts are excavated steel sleeves are placed into
the open hole which contain the shaft water and separates it
from the creek water.
Placing Concrete into the shafts
* At the time the shafts are ready for concrete, additional
decking will be placed on the work platform. This is
intended to increase the safe working area on the platform
as well as to contain any fresh concrete from falling into
the water. Again, the steel sleeve will be in place in the
shaft and further protect the water from fresh concrete.
Placing the Column Concrete/Form of Bent 2
* As is,noted on drawing number 42, the shaft is larger than
the column by six (611) inches. Prior to placing the concrete
for the column a sleeve will be placed, as needed,
at the construction joint between the shaft and the column
as a means to contain any slurry that may seep out of the
form prior to its hardening.
* The same concrete blocks or cofferdam style ring may be used
temporarily to tie off the column forms while they are
being poured.
All material used at this location will be temporary and
will be required for construction of the bent 2. Bent 3 will
perhaps only require some concrete blocks at the waters edge as a
means to support the column forms. As is noted on the plans ,
bent 3 is on the bank of the creek.

Dear Sir:
Reference the 404 General Permit 31 issued by the Corps of Engineers on
June 5, 1995 and 401 Water Quality Certification issued by the N.C. Division
of Environmental Management on June 22, 1995 for this project. This project
involves the widening of 1.6 miles of US 601, including the replacement of
Bridge No. 15 over Richardson Creek. A single 0.28 acre scrub/shrub wetland
will be filled and a 140-foot channel change will be required on a tributary
to Richardson Creek. The new bridge will be located to the east of the
existing bridge, which will remain open to traffic throughout construction.
The contractor hired to construct this project has requested permission
to use one temporary work platform to facilitate construction of the new
bridge. Attached herein is correspondence detailing the need for the
proposed work platform, as well as construction materials, drawings and
schedules. The contractor has proposed two alternate types of work platform
construction; either a cofferdam ring with wooden cribbing or a group of
precast concrete blocks with timber mats will be used. Cross-section and
overhead drawings of each alternate are provided.
NCDOT does not anticipate any permanent impacts to Richardson Creek as a
result of the proposed work. Please review this material and inform us of
any concerns you may have regarding either type of proposed work platform.

A. NOTIFICATION TO THE CORPS OF ENGINEERS DISTRICT ENGINEER. (REFER TO
ITEM B. BELOW FOR DIVISION OF ENVIRONMENTAL MANAGEMENT APPLICATION RE-
QUIREMENTS AND SPECIFICALLY NOTE NWP 26 DIFFERENCE.)
Certain nationwide permits require notification to the Corps of Engineers before work can proceed. They are as follows:
NWP 5 (only for discharges of 10 to 25 cubic yards)
NWP 7
NWP 13 (only for stabilization activities in excess of 500 feet in length or greater than an average of one cubic yard
per running foot)
NWP 14 (only for fills in special aquatic sites, including wetlands, and must include a delineation of affected special
aquatic sites)
NWP 17
NWP 18 (required when discharge exceeds 10 cubic yards or the discharge is in a special aquatic site and must include
a delineation of the affected special aquatic site, including wetlands)
NWP 21 (must include a delineation of affected special aquatic sites, including wetlands)
NWP 26 (only for greater than 1 acre total impacts and must include a delineation of affected special aquatic sites,
including wetlands)
NWP 33 (must include a restoration plan of reasonable measures to avoid and minimize impacts to aquatic resources)
NWP 37
NWP 38 (must include a delineation of affected special aquatic sites, including wetlands)
For activities that may be authorized by the above listed nationwide permits that require notification, the
applicant shall not begin work
a. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by
the District Engineer, or
b. If notified that an individual permit may be required, or
c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer
and no notice has been received from the District Engineer, and required state approvals have been obtained.
Required state approvals include: 1) a Section 401 water quality certification if authorization is requested for a
discharge of dredged or fill material, and 2) an approved coastal zone management consistency determination if
the activity will affect the coastal area.
Use of NWP 12 also requires notification to the District Engineer, but work may not begin until written
concurrence is received from the District Engineer. The time periods described above do not apply.
Furthermore, requirements to notify the U.S. Fish and Wildlife Service (USFWS), the National Marine
:Fisheries Service (NMFS), and the State Historic Preservation Office (SHPO), as indicated below and on the
notification form, do not apply.
B. APPLICATION TO DEM FOR NATIONWIDE PERMIT SECTION 401 CERTIFICATION.
Certain nationwide permits require an application to DEM in order to obtain Section 401 water quality certification.
They are NWP 6, NWP 12, NWP 15, NWP 16, NWP 17, NWP 21, NWP 33, NWP 34, NWP 38, and NWP 40.
Certain nationwide permits were issued general certifications and require no application. They are NWP 3, NWP 4,
NWP 5, NWP 7, NWP 20, NWP 22, NWP 23 (requires notification to DEM), NWP 25, NWP 27, NWP 32, NWP 36,
and NWP 37.
The following nationwide permits were issued general certifications for only limited activities: NWP 13 (for projects
less than 500 feet in length), NWP 14 (for projects that impact waters only), NWP 18 (for projects with less than 10
cubic yards of fill in waters only), and NWP 26 (for projects with less than or equal to one-third acre fill of waters or
wetlands). Projects that do not meet these criteria require application for Section 401 water quality certifications.
C. NOTIFICATION/APPLICATION PROCEDURES.
The attached form should be used to obtain approval from the Corps of Engineers and/or the N.C. Division of
Environmental Management as specified above. The permittee should make sure that all necessary information is
provided in order to avoid delays. One copy of the completed form is required by the Corps of Engineers and seven
copies are required by DEM. Plans and maps must be on 8 1/2 x 11 inch paper.
Endangered species requirement: For Corps of Engineers notifications only, applicants must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the presence of endangered species that may
be affected by the proposed project.

Request for an addendum to
the Corp of Engineers Permit
Dear Mr. Strickland,
The following information is to inform the NCDOT of our
intentions regarding the upcoming activity required to construct
the 8.1690302 project.
We would like to make a request to use a temporary work
platform in the Richardson Creek for the purpose of gaining
access to interior bent 2.
* A temporary work platform will be required for the
excavation of five (5) three feet and six inch (311-611)
diameter shafts. The platform will sevre as a work place
for a drill rig as it excavates the shafts.
* The platform will be constructed with precast concrete
blocks (31x31x31) +/-, metal or timber mats or a fabricated
metal cofferdam dam style ring and miscellaneous wooden
cribbing. A combination of this material will be used based
on existing water conditions.
* The ramp will serve as a means to bridge the existing
retaining wall. It is believed the existing wall will not
sustain the larger loads that construction equipment will
place on it. By providing a bridge we can distribute the
load of the drill rig back to a sound bearing area.
* The platform will be assembled and dismantled with the use
of a crane as the work progresses along bent 2. All small
equipment and materials associated with the work platform
will be removed at the end of each day.
D
Spoil removal and dewatering of shafts.
* As the shafts are being excavated the spoils will be removed
to a suitable location (away from the waters edge) with the
use of a crane and a skip pan. The work platform will
support the skip pan while material is being placed in it. A
permiable curtain will be suspended around active areas
which will contain the sediment.
* The dewatering of the shaft will be provided by the use of
submersible pumps and hoses. The discharge hose will
deposit the water into an approved sedimentation basin.
As the shafts are excavated steel sleeves are placed into
the open hole which contain the shaft water and separates it
from the creek water.
Placing Concrete into the shafts
* At the time the shafts are ready for concrete, additional
decking will be placed on the work platform. This is
intended to increase the safe working area on the platform
as well as to contain any fresh concrete from falling into
the water. Again, the steel sleeve will be in place in the
shaft and further protect the water from fresh concrete.
Placing the Column Concrete/Form of Bent 2
* As is•noted on drawing number 42, the shaft is larger than
the column by six (611) inches. Prior to placing the concrete
for the column a sleeve will be placed, as needed,
at the construction joint between the shaft and the column
as a means to contain any slurry that may seep out of the
form prior to its hardening.
* The same concrete blocks or cofferdam style ring may be used
temporarily to tie off the column forms while they are
being poured.
All material used at this location will be temporary and
will be required for construction of the bent 2. Bent 3 will
perhaps only require some concrete blocks at the waters edge as a
means to support the column forms. As is noted on the plans ,
bent 3 is on the bank of the creek.

Dear Mr. Vick:
You have our approval to place fill material in waters for the purpose of replacing a tributary
bridge on SR 1964 for road improvements to US 601, as you described in your application dated
7 July 1995. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit
Number 14 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Reference the 404 General Permit 31 issued June 5, 1995 and 401 Water
Quality Certification issued June 22, 1995 for the above project. The permit
application addressed a 0.28 acre wetland adjacent to Richardson Creek. At
that time, we did not include information pertaining to a channel change
upstream on a tributary to Richardson Creek.
The attached plan drawing includes details of the SR 1964 re-alignment
at its intersection with US 601. SR 1964 currently intersects with the
existing US 601 at an angle. This road bridges a tributary to Richardson
Creek. The flow rate of this stream is 410 cubic feet per second. Please
note that the same tributary is culverted downstream prior to entering
Richardson Creek. Concurrent with the US 601 widening, the interchange with
SR 1964 is to be re-aligned. The existing bridge is to be replaced with one
16' X 7' reinforced concrete abutment. This work will also require a channel
change of approximately 140 feet. No wetland fill will be associated with
this work.
It is anticipated that the proposed work may be authorized under
Nationwide Permit No. 14 for Minor Road Crossings, 33 CFR 330.5(3).
Application is hereby made for a Department of the Army permit as required
for such activities. A site map is enclosed for your records. By copy of
this letter, we are also requesting 401 Water Quality Certification by the
Division of Environmental Management.

A. NOTIFICATION TO THE CORPS OF ENGINEERS DISTRICT ENGINEER. (REFER TO
ITEM B. BELOW FOR DIVISION OF ENVIRONMENTAL MANAGEMENT APPLICATION RE.
QUIREMENTS AND SPECIFICALLY NOTE NWP 26 DIFFERENCE.)
Certain nationwide permits require notification to the Corps of Engineers before work can proceed. They are as follows:
NWP 5 (only for discharges of 10 to 25 cubic yards)
NWP 7
NWP 13 (only for stabilization activities in excess of 500 feet in length or greater than an average of one cubic yard
per running foot)
NWP 14 (only for fills in special aquatic sites, including wetlands, and must include a delineation of affected special
aquatic sites)
NWP 17
NWP 18 (required when discharge exceeds 10 cubic yards or the discharge is in a special aquatic site and must include
a delineation of the affected special aquatic site, including wetlands)
NWP 21 (must include a delineation of affected special aquatic sites, including wetlands)
NWP 26 (only for greater than 1 acre total impacts and must include a delineation of affected special aquatic sites,
including wetlands)
NWP 33 (must include a restoration plan of reasonable measures to avoid and minimize impacts to aquatic resources)
NWP 37
NWP 38 (must include a delineation of affected special aquatic sites, including wetlands)
For activities that may be authorized by the above listed nationwide permits that require notification, the
applicant shall not begin work
a. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by
the District Engineer, or
b. If notified that an individual permit may be required, or
c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer
and no notice has been received from the District Engineer, and required state approvals have been obtained.
Required state approvals include: 1) a Section 401 water quality certification if authorization is requested for a
discharge of dredged or fill material, and 2) an approved coastal zone management consistency determination if
the activity will affect the coastal area.
Use of NWP 12 also requires notification to the District Engineer, but work may not begin until written
concurrence is received from the District Engineer. The time periods described above do not apply.
Furthermore, requirements to notify the U.S. Fish and Wildlife Service (USFWS), the National Marine
Fisheries Service (NMMS), and the State Historic Preservation Office (SHPO), as indicated below and on the
notification form, do not apply.
B. APPLICATION TO DEM FOR NATIONWIDE PERMIT SECTION 401 CERTIFICATION.
Certain nationwide permits require an application to DEM in order to obtain Section 401 water quality certification.
They are NWP 6, NWP 12, NWP 15, NWP 16, NWP 17, NWP 21, NWP 33, NWP 34, NWP 38, and NWP 40.
Certain nationwide permits were issued general certifications and require no application. They are NWP 3, NWP 4,
NWP 5, NWT 7, NWP 20, NWP 22, NWP 23 (requires notification to DEM), NWT 25, NWP 27, NWP 32, NWP 36,
and NWP 37.
The following nationwide permits were issued general certifications for only limited activities: NWP 13 (for projects
less than 500 feet in length), NWP 14 (for projects that impact waters only), NWP 18 (for projects with less than 10
cubic yards of fill in waters only), and NWP 26 (for projects with less than or equal to one-thud acre fill of waters or
wetlands). Projects that do not meet these criteria require application for Section 401 water quality certifications.
C. NOTIFICATION/APPLICATION PROCEDURES.
The attached form should be used to obtain approval from the Corps of Engineers and/or the N.C. Division of
Environmental Management as specified above. The permittee should make sure that all necessary information is
provided in order to avoid delays. One copy of the completed form is required by the Corps of Engineers and seven
copies are required by DEM. Plans and maps must be on 8 1/2 x 11 inch paper..
Endangered species requirement: For Corps of Engineers notifications only, applicants must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the presence of endangered species that may
be affected by the proposed project.

Dear Mr. Vick:
You have our approval to place fill material in 0.28 acre of wetlands or waters for the purpose of
improving US 601 from north of SR 2105 to US 74 in Monroe, and the replacement of the bridge
over Richardson Creek, as you described in your application dated 26 April 1995. After reviewing
your application, we have decided that this fill is covered by General Water Quality Certification
Number 2732. This certification allows you to,use Nationwide Permit Number 14 when it is issued by
the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

The North Carolina Department of Transportation proposes to widen 1.6
miles of US 601 in Monroe. The existing two lane facility is to be widened
to a five-lane 64-foot curb and gutter section. This project is part of the
plan to eventually widen US 601 to the South Carolina State Line.
The proposed work will require replacement of Bridge No. 15 over
Richardson Creek. The new bridge will be located to the east of the existing
bridge. Traffic will be maintained on the existing bridge throughout
construction. The new bridge will be 180 feet long with a vertical clearance
three feet higher than the existing bridge.
The proposed project will require fill in 0.28 acre of scrub/shrub
emergent wetlands at one site in the vicinity of Richardson Creek. It is
anticipated that the proposed project may be authorized under Nationwide
Permit #14 for Minor Road Crossings, 33 CFR 330.5(3). Application is hereby
made for a Department of the Army permit as required for such activities. A
site map is enclosed for your records. By copy of this letter, we are also
requesting 401 Water Quality Certification by the Division of Environmental
Management.

Certain nationwide permits require notification to the Corps of Engineers before work can proceed. They are as follows:
NWP 5 (only for discharges of 10 to 25 cubic yards)

NWP 13 (only for stabilization activities in excess of 500 feet in length or greater than an average of one cubic yard
per running foot)
NWP 14 (only for fills in special aquatic sites, including wetlands, and must include a delineation of affected special
aquatic sites)

including wetlands)
NWP 33 (must include a restoration plan of reasonable measures to avoid and minimize impacts to aquatic resources)

For activities that may be authorized by the above listed nationwide permits that require notification, the
applicant shall not begin work
a. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by
the District Engineer, or
b. If notified that an individual permit may be required, or
c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer
and no notice has been received from the District Engineer, and required state approvals have been obtained.
Required state approvals include: 1) a Section 401 water quality certification if authorization is requested for a
discharge of dredged or fill material, and 2) an approved coastal zone management consistency determination if
the activity will affect the coastal area.
"Jse of NWP 12 also requires notification to the District Engineer, but work may not begin until written
incurrence is received from the District Engineer. The time periods described above do not apply.

end NWP 37.
,"he following nationwide permits were issued general certifications for only limited activities: NWP 13 (for projects

C. NOTIFICATION/APPLICATION PROCEDURES.
The attached form should be used to obtain approval from the Corps of Engineers and/or the N.C. Division of
Environmental Management as specified above. The permittee should make sure that all necessary information is
provided in order to avoid delays. One copy of the completed form is required by the Corps of Engineers and seven
copies are required by DEM. Plans and maps must be on 8 1/2 x 11 inch paper.
Endangered species requirement: For Corps of Engineers notifications only, applicants must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the presence of endangered species that may
be affected by the proposed project.

SUBJECT: Union County - US 601 from North of SR 2105 (Marion Lee Road) to
US 74 in Monroe; T.I.P. No. R-2616C; State Project No. 8.1690301
The North Carolina Department of Transportation proposes to widen 1.6
miles of US 601 in Monroe. The existing two lane facility is to be widened
to a five-lane 64-foot curb and gutter section. This project is part of the
plan to eventually widen US 601 to the South Carolina State Line.
The proposed work will require replacement of Bridge No. 15 over
Richardson Creek. The new bridge will be located to the east of the existing
bridge. Traffic will be maintained on the existing bridge throughout
construction. The new bridge will be 180 feet long with a vertical clearance
three feet higher than the existing bridge.
The proposed project will require fill in 0.28 acre of scrub/shrub
emergent wetlands at one site in the vicinity of Richardson Creek. It is
anticipated that the proposed project may be authorized under Nationwide
Permit #14 for Minor Road Crossings, 33 CFR 330.5(3). Application is hereby
made for a Department of the Army permit as required for such activities. A
site map is enclosed for your records. By copy of this letter, we are also
requesting 401 Water Quality Certification by the Division of Environmental
Management.

A. NOTIFICATION TO THE CORPS OF ENGINEERS DISTRICT ENGINEER. (REFER TO
ITEM B. BELOW FOR DIVISION OF ENVIRONMENTAL MANAGEMENT APPLICATION RE-
QUIREMENTS AND SPECIFICALLY NOTE NWP 26 DIFFERENCE.)
Certain nationwide permits require notification to the Corps of Engineers before work can proceed. They are as follows:
NWP 5 (only for discharges of 10 to 25 cubic yards)
NWP 7 ,
NWP 13 (only for stabilization activities in excess of 500 feet in length or greater than an average of one cubic yard
per running foot)
NWP 14 (only for fills in special aquatic sites, including wetlands, and must include a delineation of affected special
aquatic sites)
NWP 17
NWP 18 (required when discharge exceeds 10 cubic yards or the discharge is in a special aquatic site and must include
a delineation of the affected special aquatic site, including wetlands)
NWP 21 (must include a delineation of affected special aquatic sites, including wetlands)
NWP 26 (only for greater than 1 acre total impacts and must include a delineation of affected special aquatic sites,
including wetlands)
NWP 33 (must include a restoration plan of reasonable measures to avoid and minimize impacts to aquatic resources)
NWP 37
NWP 38 (must include a delineation of affected special aquatic sites, including wetlands)
For activities that may be authorized by the above listed nationwide permits that require notification, the
applicant shall not begin work
a. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by
the District Engineer, or
b. If notified that an individual permit may be required, or
c. Unless 30 days (calendar) have passed from the time a complete notification is received by the District Engineer
and no notice has been received from the District Engineer, and required state approvals have been obtained.
Required state approvals include: 1) a Section 401 water quality certification if authorization is requested for a
discharge of dredged or fill material, and 2) an approved coastal zone management consistency determination if
the activity will affect the coastal area.
7Jse of NWP 12 also requires notification to the District Engineer, but work may not begin until written
oncurrence is received from the District Engineer. The time. periods described above do not apply.
.trthermore, requirements to notify the U.S. Fish and Wildlife Service (USFWS), the National Marine
isheries Service (NMFS), and the State Historic Preservation Office (SHPO), as indicated below and on the
.otification form, do not apply.
3. APPLICATION TO DEM FOR NATIONWIDE PERMIT SECTION 401 CERTIFICATION.

"he following nationwide permits were issued general certifications for only limited activities: NWP 13 (for projects

.ubic yards of fill in waters only), and NWP 26 (for projects with less than or equal to one-third acre fill of waters or
vetlands). Projects that do not meet these criteria require application for Section 401 water quality certifications.
C. NOTIFICATION/APPLICATION PROCEDURES.
The attached form should be used to obtain approval from the Corps of Engineers and/or the N.C. Division of
Environmental Management as specified above. The permittee should make sure that all necessary information is
provided in order to avoid delays. One copy of the completed form is required by the Corps of Engineers and seven
copies are required by DEM. Plans and maps must be on 8 1/2 x 11 inch paper.
Endangered species requirement: For Corps of Engineers notifications only, applicants must notify the U.S. Fish and
Wildlife Service and/or the National Marine Fisheries Service regarding the presence of endangered species that may
be affected by the'proposed project.
