Dear Mr. Bennett:
You have our approval to place fill material in 0.08 acres of wetlands or raters for the purpose
of pipe replacements at SR 1302, Casey's Branch Road, as you described in your application dated
6 March 1995. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 2745. This certification allows you to use 'r{ationwide Permit
Number 3 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

Subject: Nationwide Permit No. 3 to replace existing pipe
along SR 1302 adjacent to a small stream
(Little Creek class-C- Trout.)
Dear Mr. Thomas,
The Department of Transportation is scheduled to grade, drain
base, and pave primarily along the existing roadway of SR 1302
(Caseys Branch Rd)., in Wilkes County during the 1994-1995 fiscal
year. Due to the proximity of a small stream being Class-c-trout
we are requesting a 404 Nationwide permit no. 3 to allow us to
upgrade the 4 existing cross line drainage structures that will
need replacing, and or extending.
Attached is a straight line sketch with proposed erosion control,
stream, stream embankment, pipe crossing, and marked county map.
By copy of this letter I am asking Ms. Stephanie Goudreau Mt.
Region Coordinator with the North Carolina Wildlife Resources
Commission to comment directly to you concerning the 404
Nationwide Permit request.
A request will be made on this project for a Temporary
Encroachment in the Trout Water.Buffer Zone of Little Ck. and I
am asking Ms. Goudreau to comment directly tome concerning the
Trout water buffer zone encroachment.
Also by copy of this letter, I am requesting authorization to
proceed under Section 401 of the Clean Water Act from the Division
of Environmental Management.
We would like to begin construction as soon as possible. If
further information is required, please let me know. Your early
review and consideration will be greatly appreciated.

The Department of Transportation is scheduled to grade, drain, base, and pave
SR 1121 Curtis Creek Road in Avery County when the necessary permits are obtained.
This project will require filling in a section of a small pond, replacing several pipes carrying
small streams, repairing several road washouts, relocation of a ditch carrying a small
stream, and replace or extend a pipe at Sta 52+00. The streams are Curtis Creek and some
of its tributaries. Curtis Creek has the DEM classification, C Tr. Due to the proposed
work, we are requesting a 404 Nationwide Permit.
I am sending a ioint avolication form. tvt ical section. straight line sketch with the
proposed erosion control, notes on pipe installation, plan drawings and cross sections of
proposed encroachments in trout water buffer zone, and a marked county map.
By copy of this letter, I am requesting Ms. Stephanie Goudreau, Mt. Region Biologist
Coordinator to comment directly to you concerning the 404 Nationwide Permit request.
Since a request will be made for a temporary encroachment in the trout water buffer zone,
I am also requesting Ms. Goudreau comment directly to me concerning the encroachment.
Also, by copy of this letter, I am requesting a 401 Certification from the Division of
Environmental Management for this project.
We would like to begin construction when the necessary permits are obtained. If
additional infonnation is required, please let me know. Your early review and

EROSION CONTROL SCHEDULE

erosion control devices shall be installed in a timely
manner, according to any special permit requirements
and /or requirements set olit in. C3.R. 113A-57.

Pursuant to G.S. 113A-57(3) provisions for a grounc

provided for any portion of A land-disturbing
activity in.a HQW zone within 15 working days or 6C
calendar days following completion of'construction
or development, whichever period Is shorter.
(3) All siltation and erosion*"control devices shall be
properly maintained until no longer needed.
(4) on projects performed by D.O.T. Maintenance Forces,
req?iest will promptly be made to the Division Roadside
Environmental Unit for stage and permanent seeding.
(5) Any removal of siltation devices will be based on the
condition of established ground cover of that area the
device 11 serving.
