Box 250 Bryson City, N.C. 28713 Dear Mr. Styles: You have our approval to place fill material in 0.01 acres of wetlands or waters for the purpose of road maintenance at SR 1193, Old Whittier Road, as you described in your application dated 24 February 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. SAMUEL HUNT I I I SECRETARY The North Carolina Department of Transportation is proposing to grade, drain, base and pave primarily along the existing roadway of SR 1193, Old Whittier Road, in Swain County. In order to construct this project in accordance with our current secondary road standards and due to the replacement of pipe culverts along tributaries of the Tuckasegee River, (Class C), we are requesting authorization under Section 404 of the Clean Water Act. I am sending straight line diagram with our proposed erosion control, stream, stream bank, and construction limits at various sites along the project. In addition a typical section of the road, cross sections, drawings for pipe culvert replacements, general notes and standards on erosion control measures and a marked county map are enclosed. We propose to install the new culverts slightly below the existing streambed elevations where bedrock is not encountered to minimize. impacts to wildlife habitat and allow the existing stream gradients to remain as unchanged as is physically possible. The best management practices will be used to minimize and control sedimentation and erosion on this project. The construction foreman will review all erosion control measures daily to ensure sedimentation and erosion are being effectively controlled. If the planned devices are not functioning as intended, they will immediately by replaced with better devices. The rock silt screens and other erosion control devices will be in place prior to pipe construction and will remain in place until the project is stabilized. By copy of this letter I am asking Mr. David Yow, North Carolina Wildlife Resources Commission, District Fisheries Biologist to comment directly to you concerning the 404 Nationwide permit request. C 11 --OR 12 March, 1992 TEMPORARY SILT FENCE: A temporary silt fence is commonly used at the toe of a fill section to prevent off- site sedimentation. It is made of permeable filter fabric buried at the bottom, stretched and supported by steel posts. The silt fence reduces the water flow while retaining the sediment. They may also be used to divert water flow to protected outlets. Silt fences need to be checked after each significant rainfall to ensure there effectiveness. They must be maintained on a regular basis. Silt fences shall no be installed across streams, ditches, or waterways. AREAS OF USE: • At toe of fill sections where sediment runoff can be stored and contained inside the project limits. I Iw, ? N O Z _ <I= hp. I°;aI I 18 March, 1992 ROCK SILT SCREEN: r, M A rock silt screen is a low-level dam structure to be used in streams below culvert sites. Rock silt screens shall be used to trap sediment transported by running water and shall be placed in the stream below the construction site within the right-of- way or easement boundary. The rock silt screen utilizes class B stone lined with #5 or #57 stone to produce a ripple-effect in the stream to settle the larger sediment particles transported in the stream from the construction site. The trapped sediment shall be cleaned out before the device is removed from the stream. AREAS OF USE: • In live streams below construction sites where construction occurs in or adjacent to the stream. • In live streams below a culvert construction site., • Where it can be cleaned before it is removed from stream. For the purpos the corps of Engineers, Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid until the nationwide permit is modified, reissued or revoked. All the nationwide permits are scheduled to be modified, reissued or revoked prior to 21 January 1997. It is incumbent upon you to remain informed of changes to the nationwide permits. We will issue a public notice announcing the changes when they occur. Furthermore, if you commence or are under contract to commence this activity before the date the nationwide permit is modified or revoked, you will have twelve months from the date of the modification or revocation to complete the activity under the present terms and conditions of this nationwide permit. The discharge does not cause the loss of more than 10 acres of waters of the U.S. For the purpose of this nationwide permit, the acreage of loss of waters of the U.S. includes the filled area plus waters of the U.S. that are adversely affected by flooding, excavation, or drainage as a result of the project. b. A 30-day notification to the District Engineer (DE) is required if the discharge would cause the loss of water of the U.S. greater than one acre. For discharges in special aquatic sites, including wetlands, the notification must include a delineation of affected special aquatic sites including wetlands. C. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. GENERAL CERTIFICATION CONDITIONS a. General Certification is denied for fills greater than one area in SA, trout, HQW, ORW, WS-I and WS-II watersheds. General certification is issued for all other waters for fills of not more than 10 acres and in those watersheds specified above for fills of not more that one acre. b. Proposed fill or substantial modification of greater than one-third of an acre of such waters, including wetlands, requires a written concurrence from the North Carolina Division of Environmental Management (NCDEM). c. Established sediment and erosion control practices will be utilized to prevent violations of the appropriate turbidity water quality standard (50 NTU's in streams and rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's in all saltwater classes and all lakes and reservoirs and 10 NTU's in trout waters). d. Measures shall be taken to prevent live or fresh concrete from coming into contact with waters of the State until the concrete has hardened. e. Additional site-specific conditions may be added to this Certification in order to ensure compliance with all applicable water quality and effluent standards. f. Concurrence from the North Carolina Division of Environmental Management (NCDEM) that this Certification applies to an individual project shall expire three years from the date of the cover letter from the NCDEM.
