Dear Mr. Bennett:
You have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose
of pipe replacement at SR 1158 (Conley Shumaker Road), as you described in your application dated
13 February 1995. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2745. This certification allows you to use Nationwide
Permit Number 3 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you sbould get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Thomas,
The Department of Transportation is scheduled to grade, drain
and base primarily along the existing roadway of SR 1158 (Conley
Shumaker Rd)., in Wilkes County during the 1994-1995 fiscal year.
Due to the small stream being a trib. to Stoney Fork Ck. Class-c-
we are requesting a 404 Nationwide permit no. 3 to allow us to
replace the 1 existing cross line drainage structure.
Attached is a straight line sketch with proposed erosion control,
stream, stream embankment, pipe crossing, and marked county map.
By copy of this letter I am asking Ms. Stephanie Goudreau Mt.
Region Coordinator with the North Carolina Wildlife Resources
Commission to comment directly to you concerning the 404
Nationwide Permit request.
Also by copy of this letter, I am requesting authorization to
proceed under Section 401 of the Clean Water Act from the Division
of Environmental Management.

CONSTRUCTTOii Sr•.O11MICr FOR INSTALLING ROADWAY CULVERTS
1. Clear only enniivh area and install the downstream measures
G»c:h as silt check dams, silt screens, and silt basins as
noted on plan.
2. Excavate the 2' base tail ditch.
3. Excavate and install the roadway culvert.
4. Install sediment control measures at inlet as noted on
plan.
5. Tnstall additional pipe outlet protection and inlet
protection as noted.
EROSION CONTROL SCHEDULE
(t) All adequate temporary erosion control measures will be
installed before clearing and grubbing operations begin.
(2) A-q ronGtrliction progresses temporary and permanent
ernsinn control devices shall he installed in a timely
manner, according to any special permit requirements
and /nr regn1rements set out in G.S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
P»rGtiant to G.S. 113A-57(3), Provisions for a ground
cover sufficient to restrain erosion must be
accomplished within 30 working davs or 120 calendar
days following completion of construction or
development, whichever period iq shorter, except as
provided in 15A NCAC 4B .0024(e).
DESIGN STANDARDS IN SENSITIVE WATERSHEDS
Pltrsuant to G.S. 113A-57(3) provisions for a ground
rover siifficient to restrain erosion mt.tst be
provided for any portion of A land-disturbing
activity in a HQW zone within 15 working days or 60
calendar clays following completion of construction
or development, whichever period Is shorter.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) nn projects performed by D.O.T. Maintenance Forces,
regtie4t will promptly be made to the Division Roadside
Environmental Unit for stage and permanent seeding.
(5) Any removal of siltation devices will he ba.qed on the
rondltion of established ground cover of that area the
device 14 serving.
SECTION 1042
HIP RAP MATERIALS
1042-1 PLAIN RIP RAP.
Stone for plain rit) rapsllalI collslstof field stone or rough unhewn quarry
stone. The stone shall be sound, tough, dense, resistant to the action of air
and water, and suitable in all other respects for the purpose intended.
Where broken concrete from demolished structures or pavement is avail-
able, it may he used in place of stone provided that such use meets with the
approval of the Engineer. However, the use of broken concrete which
contains reinforcing steel will not be permitted.
The stone or broken concrete shall be graded to meet the following
requirements:
1. For Class 1 Rip Rap. Stone shall vary in weight from 5 to 200 pounds.
At least 30 percent of the total weight of the rip rap shall be in
individual pieces weighing a minimum of 60 pounds each. Not more
than 10 percent of the total weight of the rip rap may be in individual
pieces weighing less than 15 pounds each.
2. For Class 2 Rip Rap. Stone shall vary in weight from 25 to 250
pounds. At least 60 percent of the total weight of the rip rap shall be in
individual pieces weighing a minimum of 100 pounds each. Not more
than 5 percent of the total weight of the rip rap may be in individual
pieces weighing less than 50 pounds each.
