Dear Mr. O'Quinn:
You have our approval to place fill material in 1260 square feet of waters for the purpose of
bulkhead replacement at Minnesott Beach Ferry, as you described in your application dated 25 April
1995. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13
or its equivalent when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

8. PROJECT SUMMARY: The NCDOT proposes to add an additional ramp at the Minnesott Beach
Ferry Landing. The project involves the replacement, removal, and addition of numerous dolphin
clusters in addition to the replacement of the existing 400' bulkhead. The applicant also proposes to
add an additional 60' to the upstream breakwater as well as to replace the downstream breakwater.

9. NARRATIVE DESCRIPTION:
Project Setting
The North Carolina Department of Transportation operates a ferry link crossing
the Neuse River along NC 306 between Minnesott Beach in Pamlico County and
Cherry Branch in Craven County. The ferry operates 7 days a week, 365 days a year,
and during certain peak periods during the day provides three trips/hour each way.
The Minnesott Beach Ferry Landing currently has a single 17'-wide ramp, a ferry-
operations office building with public restrooms, and associated paved parking lot.
The remaining part of the tract is undeveloped and vegetated with lawn grasses. The
400' of shoreline adjacent the Neuse River is bulkheaded but in poor condition. Two
wooden and deteriorating breakwaters extend out into Neuse at the site, and are located
immediately upstream and downstream along the adjacent property lines. The
breakwater downstream is approximately 143' in length while the upstream breakwater
is only 40' in length. Currently, 8 dolphin clusters exist within the groin-protected
open water basin area. The Neuse River at this point is classified SB SW NSW and is
closed to shellfishing. The area is not a designated Primary Nursery Area.
Project Description
The applicant proposes to add an additional loading ramp immediately
downstream of and adjacent to the existing one. Associated development would
include paving the access to the ramp and paving a small area adjacent the office
building for parking. Construction of the new ramp would require the removal of 2
existing outer dolphin clusters and the addition of 7 new dolphin clusters (six of which
would mirror the existing clusters). At the same time, the applicant wishes to replace
the 6 remaining dolphin clusters.
The addition of the new ramp requires that the applicant excavate approximately
180 W of high ground and construct a bulkhead. At the same time, the applicant
proposes to replace the remaining deteriorated bulkhead by constructing a steel sheet
pile bulkhead 2' in front of the old alignment, and placing a 3'-wide concrete cap on it.
The proposal also includes replacing the two deteriorating breakwaters with the
same steel sheet pile and concrete cap. The downstream breakwater would be replaced
along the same alignment and distance from the NWL. The upstream breakwater on
the other hand would be replaced along the same alignment, but would also be
extended another 60' from the NWL.

Anticipated Impacts
The project as proposed would result in the filling of 1260 ft2 of Estuarine
Waters and Public Trust Areas of the Neuse River as a result of the replacement of the
bulkhead and the associated backfill (1200 ft') and the 60' extension of the upstream
breakwater (60 ft2). In association with the construction of the bulkhead,
approximately 73 yds3 would be excavated for installation of the tie backs. Of this,
approximately 22 yds3 would be below NWL. Approximately 98 yds3 of fill material
would be placed below NWL and another 189 yds3 above NWL. It is proposed that
180 ft2 of high ground would be excavated for the construction and installation of the
additional loading ramp.
The installation of the 7 additional dolphin clusters would not encroach farther
out into the Estuarine Waters and Public Trust Areas of the Neuse Rivers. The
additional dolphin clusters would remain within the groin-protected basin area.
Obviously, a temporary, constructed-related increase in turbidity during installation
would be expected. Substrates in the area are of a coarse sandy material, thus keeping
problems associated with increased turbidity to a minimum. The replacement of the
breakwaters would also create temporary increases in turbidity. In addition, the
lengthening of the upstream breakwater would encroach 60' farther into the Public
Trust Areas of the Neuse River. A statement from the adjacent property owner
specifically waiving the 15' riparian setback requirement is required. Similarly, on the
replacement of the downstream breakwater, documentation from the applicant showing
that the structure meets the replacement criteria for nonconforming structures must also
be provided.
The additional paving of the access road to the ramp and for the additional
parking adjacent to the building would increase the impervious coverage within the
Estuarine Shoreline to approximately 27%.
