Dear Mr. Moore:
You have our approval to place fill material in 0.01 acres of wetlands or waters for the purpose
of road maintenance at SR 1188, Deal Hill Road, as you described in your application dated 16 March
1995. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 2735. This certification allows you to use General Permit Number 031
when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in.the attached certification. In
addition, you should get any other federal, state or local permits: before you go ahead with your
project.
If you do not accept any of the conditions: of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date<that you receive this letter. To ask for a hearing,,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Spot Safety Improvement
Nationwide Permit Request
Dear Mr. Chapin:
I am attaching a straight line diagram with erosion
control plan, an application form for a nationwide permit,
and a county map section relative to a spot safety
improvement along SR 1188 Deal Hill Road in Mitchell
County.
This portion of Deal Hill Road is presently 9 to 12 feet
wide. We plan to widen the road to 14 feet wide and increase
the typical section. The proposed typical section is also
attached. Grading will be light to moderate. This project
begin 0.2 miles east of NC 80 and continues easterly for 0.11
miles.
We propose to relocate the existing 24" pipe at survey
station 16 + 55. This will require a channel change from
survey stations 15 + 95 to 16 + 90.
By a copy of this letter, we are asking Stephanie
Goudreau, North Carolina Wildlife Resources Commission
Mountain Region Coordinator, to comment directly to you
concerning the nationwide permit request. A request to work
within the twenty-five foot buffer zone will be made to the
Department of Environment, Health and Natural Resources at a
later date.
By copy of this letter, we are asking E. L. Ingle, Area
Roadside Environmental Engineer, to comment on the above
project.
