CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401
Public Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500 to N. C. Department of
Transportation resulting in 0.17 acres of wetland impact in Currituck County pursuant to an application
filed on the 29th day of June of 1995 to replace existing bridge over SR 1245 at Coinjock Bay and
stabilize shoreline.
The Applicton:,provides adequate assurance that the discharge of fill material into the waters
of Coinjock Bayin conjunction with the proposed development in Currituck County will not result in
a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-
500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
That the activity be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction related
discharge (50 NTUs in streams and rivers not designated as trout waters by
DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs
in trout waters).
Violations of any condition herein set forth shall result in revocation of this Certification. This
Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon
expiration of the 404 or CAMA permit.
If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon
written request within sixty (60) days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and
filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. If
modifications are made to an original Certification, you have the right to an adjudicatory hearing on
the modifications upon written request within sixty (60) days following receipt of the Certification.
Unless such demands are made, this Certification shall be final and binding.

8. PROJECT SUMMARY: NC DOT proposes to replace the existing bent pile bridge with a new
structure. The new bridge would utilize the same alignment and will be approximately 0.66 ft.
higher than the existing structure. The applicant plans to riprap approximately 869 ft. of shoreline to
protect the roadway from erosion.

SITE DESCRIPTION
SR 1245 connects the Currituck County mainland to Bells Island over a causeway
which includes Bridge No. 8. Bridge No. 8 crosses the adjacent marsh and waters of the
Coinjock Bay. Bells Island is located approximately one mile south of the Currituck County
Court House and is surrounded by the Currituck Sound and the Coinjock Bay. Water levels
on the Coinjock Bay, the Currituck Sound and it's tributaries are determined by wind tides.
The existing bridge was constructed in 1947 and has a roadway width of 18 ft. and
length of 98 ft. The current bridge structure provides an average vertical clearance of 2.5 ft.
and a horizontal clearance of 7 ft. The average channel depth is 3.5 ft. at NWL.
It is estimated that the existing bridge handles 1200 vehicles per day. Remnant
wooden bridge pilings are still present adjacent to the current bridge. County records indicate
that Bells Island has been accessed by animal drawn carts and later vehicular traffic since the
early eighteen hundreds. Previous access was along a high embankment approximately 300
yards north of the current crossing and this access was initially used by the region's earliest
inhabitants.
NC DOT proposes to replace the current bridge structure. The new bridge will utilize
the same alignment as the present structure.
The SR 1245 crosses over an extensive juncus marsh as it accesses Bells Island.
Coinjock Bay and the adjacent marsh are located within the N.C. Estuarine AEC. Juncus
roemerianus is the predominant plant species. Other dominant plant species include Typha
latifolia and Phragmitis australis. A list of plant species in the vicinity of Bells Island and
the Coinjock Bay are included in Appendix 1. This is one of the Currituck Sound's most
visible coastal marshes.
The waters and marsh along the Coinjock Bay provide habitat for several aquatic fish
and shellfish species as well as several species of bird, reptile, amphibian and mammal
wildlife. Species which have been identified or could be expected are included in Appendix
2.
PROPOSED DEVELOPMENT
The applicant proposes to replace Bridge No. 8 at this existing location and utilize the
same alignment. Approximately 1600 ft. of roadway approach would be widened.

maintained by temporary traffic signals..- , NC DOT also proposes to construct a temporary
mat and wooden bridge structure' adjacent to the current bridge to work from.
The new bridge would be 130 feet long. The new structure will provide 0.66 ft.
additional clearance over public : trust. waters than the existing structure and provide at least
three 10 ft. wide horizontal clearance openings.
Associated shoreline stabilization is also proposed for this project. NC DOT proposes
to rip rap 869 ft. of Estuarine Shoreline at a distance waterward of the NWL of 6.7 ft.
ANTICIPATED IMPACTS
The proposed project includes widening of the existing roadway approach to the
proposed bridge. This associated fill and rip rap would directly impact 17,140 sf. (0.40 A)
of shallow water habitat / public trust waters and-1,285 sf. (O.A) of coastal wetlands. In
addition, the temporary wood pile work bridge structure would impact 7,500 sf. (0.18A) of
public trust waters and shallow water habitat.
The use of a temporary wooden mat and pile bridge would impact the principle two
SAV species. These include Ruppia madtima (wedgeon grass) and Myriophyllum spp.
(milfoil). It is unknown to what degree of impact would be experienced by SAV
communities. It is anticipated that the temporary work bridge would be in place during the
duration of the bridge construction. It is estimated that bridge construction would take
approximately six months.
It is anticipated that by utilizing a temporary work bridge and the same bridge
alignment as the current bridge that long term and permanent impacts will be minimized.
This alternative will also allow traffic to continue on and off the island with a minimum of
delay to vehicular traffic as well as a minimum impact to public trust waters and coastal
wetlands. However, it is anticipated that some temporary damage may be experienced by
SAV species.
Temporary turbidity will also be experienced in the vicinity of the proposed development
until construction is complete and the site is stabilized and restored.
NC DOT also proposes to raise the bridge elevation. The proposed clearance over
public trust waters would be 0.66 ft. higher the current bridge and would improve access to
public trust waters as well as access for future bridge maintenance. However, the bridge
widening and height increase would require additional roadway widening and fill placement
in Coastal Wetlands, Estuarine Waters and shallow water habitat.

Widening of the bridge and roadway approach would provide a safer crossing for
vehicular traffic.
CAMA REVIEW
Sites of archaeological significance have been identified within 1 - 2.0 miles from the
site in Currituck County. They include sites CK9, 10 and 34 designated by the Division of
Archives and History.
The land use on Bells Island is residential. The Currituck County Land-Use Plan
shows the project area to be in the land-use classification of Conservation. Steve Gabriel
will forward the CAMA review at a later date.

NOTICE OF FILING OF
APPLICATION FOR CAMA MAJOR DEVELOPMENT
PERMIT AND WATER QUALITY CERTIFICATION
The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that NC DOT of Currituck
County, filed an application on May 12, 1995, for a permit from the Division of Coastal
Management to develop in an Area of Environmental Concern and for certification from the
Division of Environmental Management that a discharge of fill material in project wetlands
will not violate applicable water quality standards.
According to said application NC DOT proposes to replace the existing bent pile
bridge with a new structure. The new bridge would utilize the same alignment and will be
approximately 0.66 feet higher than the existing structure. The applicant plans to rip rap
approximately 869 feet of shoreline to protect the roadway from erosion. The project is
located at the bridge over Coinjock Bay on SR 1245, in Currituck County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of Dennis Hawthorn, Division of Coastal Management, located at 1367
US 17 South, Elizabeth City, N.C., 919/264-3901, and/or the office of Deborah Sawyer,
Division of Environmental Management, DEHNR Regional Field Office, Washington, N.C.,
919/946-6481.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before July 14, 1995. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
July 9, 1995 for consideration in the CAMA permit decision, and to Mr. John Dorney,
Division of Environmental Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
July 4, 1995 for consideration in the water quality certification decision. Later comments on
the CAMA application will be accepted and considered up to the time of permit decision.
Project modifications may occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter will be provided upon request.

This permit, issued on AUGUST 7, 1995 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be
subject to a fine, imprisonment or civil action; or may cause the permit to be null and void.
Excavation/Fill
1) In order to protect juvenile finfish populations, no excavation or filling will be permitted
between April 1 and September 30 of any year without the prior approval of the Division of
Coastal Management.
2) All fill material will be obtained from an upland source.
3) All fill material will be clean and free of any pollutants, except in trace quantities.
4) All fill material, construction materials and equipment shall be contained within the approved
construction site.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31. 1998
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

ADDITIONAL CONDITIONS
5) The temporary placement or double-handling of excavated material within waters or vegetated
wetlands is not authorized.
6) No excavated or fill materials will be placed at any time in any vegetated wetlands or waters
outside of the permitted area.
7) The temporary placement or double handling of excavated or fill materials within waters or
vegetated wetlands is not authorized.
8) No excavated or fill material will be placed in any location or in any manner so as to impair
surface water flow into or out of any wetland area.
Riprap
9) The riprap material will not be positioned farther waterward than 7 feet from the normal water
level (NWL) elevation contour at any point along its alignment.
10) All backfill materials will be obtained from a highground source and confined landward of the
permitted riprap.
Sedimentation/Erosion Control
11) Appropriate erosion and sedimentation control devices, measures, or structures will be used to
prevent sediment from entering the adjacent wetlands/watercourses/property (e.g., silt fence,
diversion swales/berms, sand fence, etc.).
12) A ground cover sufficient to restrain erosion will be provided within 30 working days of
completion of any phase of grading on cut or filled slopes.
13) Activities will be conducted in such a manner as to prevent significant increase in turbidity
outside the construction area.
14) All disturbed areas must be properly graded and seeded to prevent the formation of mosquito
breeding habitat.
Mitigation
15) Prior to completion of the project, a mitigation plan to offset the loss of coastal wetland impacts
will be submitted to the Division of Coastal Management and the U. S. Army Corps of
Engineers for approval.

16) Implementation of the approved mitigation plan must commence prior to the completion of the
project.
General
17) All work authorized by this permit must be performed in strict compliance with the permit plans.
18) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.

The Department of Transportation has concluded that a minor change to the
design of the temporary work bridge will result in minimizing impacts to adjacent
wetlands and aquatic habitat, while providing adequate construction access to the work
area. The recommended change is to construct a slightly longer work bridge from the
south approach only, terminating the temporary bridge at approximately station 1+230.
This will still allow the same channel opening for public trust usage as the original
design, but eliminates the impacts to wetlands on the north side of the water resource.
In view of the reduction of impacts to the adjacent estuarine communities, it is
reasonable to assume that this request will be considered favorably by the Division of
Coastal Management and other interested parties. Consequently, it is requested that a
minor refinement to the existing permit be approved. Such action, if approved, will
allow the contractor to proceed without delay on this important project.
