Box 25201 Raleigh, N.C. 25202 Dear Mr. O'Quinn: You have our approval to place fill material in 7.128 acres of wetlands or waters for the purpose of constructing US 70 Bypass of Smithfield, as you described in your application dated 16 June 1995. After reviewing your application, we have decided that this fill, is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Mitigation in areas I and II shall be done as shown on the 13 June 1995 mitigation plan. As-built plans and mitigation reports shall be submitted to DEM. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. I do not know enough about the project to complain so I'm going to accept the COE call. Jean is going to issue permit w/ condition that work can proceed if DEM says it is OK. Detailed mitigation info, as-built plans, etc. will be coming later. I told Cyndi it was OK to proceed. I do not know the status of the 401 but am assuming that it has been issued. Permit was originally issued in 1988 and permit expired. COE made them reapply, TIP # R-0084BA. SAMUEL HUNT III SECRETARY RECEIVED JUN 2 31995 ENVIRONMENTAL SCIENCES rD".,?U 0.4 mile east of of SR 2305 East of No. 6.319003T and Reference the Department of the Army permit issued on June 6, 1988 for the discharge of fill material into 10.65 acres of wetlands to be impacted by the widening and relocation of US 70-A from west of the Neuse River to east of Smithfield. The Company Swamp Mitigation Bank was debited 10.65 acres for this impact. This permit expired on December 31, 1991. Construction was completed except for the above referenced segment. NCDOT recently began construction of the US 70 Bypass segment without having renewed the permit. There was a mistake in our records which indicated the project was authorized with a nationwide permit and the Nationwide Permit No. 26 conditions were included in the contract specifications. On May 23, 1995 Ms. Jean Manuele of the DOA Raleigh Regulatory Field Office visited the construction site with NCDOT and its contractor. One wetland site (Site 6 in the 1988 permit) and a small farm pond (Site 7 in the 1988 permit) are located in the project corridor. The wetland site is a bottomland hardwood located above headwaters (Figure 1). The construction corridor has been cleared, and fill has been placed on approximately 2.5 acres of wetlands. The entire wetland fill area to be involved at this location will include 7.128 acres of jurisdictional wetlands. The 1988 permit indicated this site was 3.2 acres and the Company Swamp Mitigation Bank was debited that amount as mitigation for Site 6. This discrepancy in acreage assessment is due to changes in wetland delineation methodology which have occurred since the 1981 EA document was prepared for the US 70 project. Ms. Manuele informed us that a partial Cease and Desist Order would be placed on this project to prevent additional unauthorized fill in wetlands. At that time, all work in wetlands was discontinued. Work in upland portions of the project has continued. 9'- June 16, 1995 Page 2 On Friday, May 26, 1995.NCDOT staff showed Ms. Manuele several potential mitigation sites in the vicinity of this project. A total of 8.38 acres of wetlands could be restored, enhanced, or created at these locations. Figure 2 illustrates an area adjacent to the existing US 70A near the entrance to the US 70 Bypass. Mitigation Area I consists of 1.73 acres of forested bottomlands which have been ditched and drained, as well as a 2.42 acre field which has been drained and deforested. The forested portion of this tract can be enhanced by filling the ditches which are draining the site. Without this measure, the site would eventually become dominated by upland adapted species. The adjacent field will be restored to wetlands through controlling the roadside ditch which runs parallel to US 70A. This site will also be reforested with bottomland hardwood species. The site hydrology and vegetation will be monitored in accordance with the attached mitigation plan. This plan is consistent with the plan implemented for the SR 1003/US 70 Interchange project. Figure 3 illustrates Mitiga ion Areas II, III and IV at the state borrow ponds on US 70 at the Neuse Riv r. The lower pond already has a 0.24 acre enhancement mitigation area, a ociated with the SR 1003/US 70 Interchange project, on the western bank. .We propose reforestation of the entire western bank area, which will involve an additional 2.33 acres of land. Mitigation Area III will involve the creation of a 1.1 acre island within the upper pond. Mitigation Area IV will involve a 0.8 acre wetland created through a combination of excavation and fill in surface waters at the eastern edge of the upper pond. Mitigation Areas III and IV will be graded to a level approximately one foot above the surface level of the upper pond. In the event that the water level rises at the upper pond, the dam between the two ponds can be manipulated to reach the desired high water level. The mitigation site drawings include the locations of proposed monitoring wells. The sites will be planted and monitored in accordance with the attached mitigation plan. Figure 1 illustrates the projected wetland impact area, along with the extent of fill which has already been placed. It is anticipated that this work may be authorized under Nationwide Permit No. 26 for Project Above Headwaters 33 CFR 330.5(3) and a predischarge notification is attached. The 401.Water Quality Certification issued by the North Carolina Division of Environmental Management for the original permit may still be valid; however, because the site is larger than originally thought, DEM is being provided with a copy of this notification for their action, as required. Monitoring Timeframe - Mitigation site shall be inspected at the following time: A. Prior to planting B. At completion of planting C. At the end of the next three growing seasons. II. Data to be obtained at specific inspection times: A. Prior to planting 1. - Check for proper elevation and grade. - 2. Check for proper plant species and for acceptable plant quality. All disturbed areas adjacent to the mitigation sites will be stabilized to prevent sedimentation into the mitigation sites. 6. Construction of the mitigation sites will be initiated at such time to provide for planting of seedlings the first suitable planting period (December 1 through March 15) following commencement of project construction. 7. No more than 20% of any one species shall be planted in the initial planting. June 16, 1995 Page 4 B. At completion of planting check for conformity with plans as well as quality of planting. An "as-built" report of the mitigation area, including final elevations, photographs, sample plot locations, well locations, and problems/resolutions, shall be submitted to the Wilmington District within 30 days of the mitigation site construction. C. At the end of each of three growing seasons: 1. Determine stem count based upon one sample plot (0.05 acre) per acre. 2. Take photographs. 3. Annual monitoring shall be conducted in the period August 1 through September 30 of each year until the vegetative success criteria is met. 4. Annual monitoring reports, including photographs, sample plot data, well data, and problems/resolutions, shall be submitted within 30 days of site monitoring. III. Monitoring for Hydrology The hydrology parameter for this specific project has been established as saturation within 12 inches of the surface, ponded or flooded for at least 26 consecutive days of the growing season for the first year under reasonably average climatic conditions. NCDOT will document compliance through the use of monitoring wells or visual observation within the mitigation sites. In the event that the hydrological success criteria is not met during the first year, well monitoring will continue in successive years until the success criteria has been met and documented. IV. Evaluation and recourse actions: A. A minimum of 320 stems per acre living. If after three years the number of trees per acre.is below 320 NCDOT will consult with the COE to determine an appropriate recourse option. B. NCDOT will document compliance through the use of monitoring wells or visual observation within the mitigation sites. In the event that the hydrological success criteria is not met during the first year, well monitoring will continue in successive years until the success criteria has been met and documented. IV. No. R-00846Ai State Project no. 6.319003T and 8.1236901 Reference the Department of the Army permit issued on June 6, 1988 for the discharge of fill material into 10.65 acres of wetlands to be impacted by the widening and relocation of US 70-A from west of the Neuse River to east of Smithfield. The Company Swamp Mitigation Bank was debited 10.65 acres for this impact. This permit expired on December 31, 1991. Construction was completed except for the above referenced segment. NCDOT recently began construction of the US 70 Bypass segment without having renewed the permit. There was a mistake in our records which indicated the project was authorized with a nationwide permit and the Nationwide Permit No. 26 conditions were included in the contract specifications. On May 23, 1995 Ms. Jean Manuele of the DOA Raleigh Regulatory Field Office visited the construction site with NCDOT and its contractor. One wetland site (Site 6 in the 1988 permit) and a small farm pond (Site 7 in the 1988 permit) are located in the project corridor. The wetland site is a bottomland hardwood located above headwaters (Figure 1). The construction corridor has been cleared, and fill has been placed on approximately 2.5 acres of wetlands. The entire wetland fill area to be involved at this location will include 7.128 acres of jurisdictional wetlands. The 1988 permit indicated this site was 3.2 acres and the Company Swamp Mitigation Bank was debited that amount as mitigation for Site 6. This discrepancy in acreage assessment-is due to changes in wetland delineation methodology which have occurred since the 1981 EA document was prepared for the US 70 project. Ms. Manuele informed us that a partial Cease and Desist Order would be placed on this project to prevent additional unauthorized fill in wetlands. At that time, all work in wetlands was discontinued. Work in upland portions of the project has continued. E3 (9 FROM RALEIGH REGULATORV 86.21.1995 12:58 P.03 Page 2 -k, On Friday, May 26, 1995 MCDOT staff showed Ms. Manuele several potential mitigation sites in the vicinity of this project. A total of 8.38 acres of wetlands could be restored, enhanced, or created at these locations- Figure 2 illustrates an area adjacent to the existing US 70A near the entrance to the US 70 Bypass. Mitigation Area I consists of 1.73 acres of forested bottomiands which have been ditched and drained, as well as a 2.42 acre field which has been drained and deforested. The forested portion of this tract can be enhanced by filling the ditches which are draining the site. Without this measure, the site would eventually become dominated by upland adapted species. The adjacent field will be restored to wetlands through controlling the roadside ditch which runs parallel to US 70A. This site will also be reforested with bottomland hardwood species. The site hydrology and vegetation will be monitored in accordance with the attached mitigation plan. This plan is consistent with the plan implemented for the SR 1003/0S 70 Interchange project. figure 3 illustrates Mitigation Areas 11, III and IV at the state borrow ponds on US 70 at the Neuse River. The lower and already has a 0.24 acre enhancement mitigation area, associated with the SR 1003/US 70 Interchange project, on the western bank. We propose reforestation of the entire western bank area, which will involve an additional 2.33 acres of land. Mitigation Area III will involve the creation of a 1.1 acre island within the upper pond. Mitigation Area IV will involve a 0.8 acre wetland created through a combination of excavation and fill in surface waters at the eastern edge of the upper pond. Mitigation Areas III and IV will be graded to a level . approximately one foot above the surface level of the upper pond. In the event that the water level rises at the upper pond, the dam between the two ponds can be manipulated to reach the desired high water level. The mitigation site drawings include the locations of proposed monitoring wells. The sites will be planted and monitored in accordance with the attached mitigation plan. Figure 1 illustrates the projected wetland impact area, along with the extent of fill which has already been placed. It is anticipated that this work may be authorized under Nationwide Permit No. 26 for Project Above Headwaters 33 CFR 330.5(3) and a predischarge notification is attached. Monitoring Timeframe - Mitigation site shall be inspected at the following time: A. Prior to planting S. At completion of planting C. At the end of the next three growing seasons. II. Data to be obtained at specific inspection times: A. Prior to'plantinq 1. Check for proper elevation and grade. 2. Check for proper plant species and for acceptable .plant quality. All disturbed areas adjacent to the mitigation sites will be stabil i2ed to prevent sedimentation into the mitigation sites. 6. construction of the mitigation sites will be initiated at such time to provide for planting of seedlings the first suitable planting period (December 1 through March 15) following commencement of project construction. 7. No more than 20% of any one species shall be planted in the initial planting. 8. At completion of planting check for conformity with plans as well as quality of planting. C. At the end of each of three growing seasons: 1. Determine stem count based upon one sample plot (0.05 acre) per acre. 2. Take photographs. 3. Annual monitoring ahall be conducted, in the period August 1 through September 30 of each year until the vegetative success criteria is met. 4. Annual monitoring reports, including photographs, sample plot data, well data, and problems/resolutions, shall be submitted within 30 days of site monitoring. III. Monitoring for Hydrology The hydrology parameter for this specific project has been established as saturation within 12 inches of the surface, ponded or flooded for at least 26 consecutive days of the growing season for the first year under reasonably average climatic conditions. NCDOT Will document compliance through the use of monitoring wells or visual observation within the mitigation sites. In the event that the hydrological success criteria is not met during the first year, well monitoring will continue in successive years until the success criteria has been met and documented. TV. Evaluation and recourse actions: A. A minimum of 320 stems per acre living. If after three uears the number of trees per acre i.s below 320 NCDOT will consult with the COS to determine an appropriate recourse option. B. Annual data evaluation, at the end of three growing seasons: 1. Below acceptable survival rate (recourse options) A. Replant (supplemental or complete) D. Minor regrading c. Reevaluate Eeastbility 2.
