You have our approval to place fill material in 0.001 acres of wetlands or waters for the purpose
of the extension of pipe culverts to pave and widen SR 1104, Mulberry Road, as you described in
your application dated 4 May 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2732. This certification allows you to use
Nationwide Permit Number 14 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

The North Carolina Department of Transportation (NCDOT) is proposing to
grade, drain, base, and pave SR 1104, Mulberry Road, primarily along the existing
roadway. In order to construct this project in accordance with our current secondary road
standards and due to the proximity of a trout stream (Barkers Creek and tributaries, DEM
Class C - Trout Water) and extension of pipe culverts, we are requesting authorization
under Section 404 of the Clean Water Act.
I am sending a straight-line diagram, with the proposed erosion control, stream,
stream bank, and construction limits at various sites along the project where we will be in
conflict with the streams. In addition, I am sending a typical section of the road, cross-
sections, drawings for pipe culvert extensions, general notes and standards on some erosion
control measures, and a marked map. We propose to install the new culverts slightly below
the existing streambed elevations where bedrock is not encountered to minimize impacts to
wildlife habitat and allow the existing stream gradients to remain as unchanged as is
physically possible.
The best management practices will be used to minimize and control erosion and
sedimentation on this project. The construction foreman will review all erosion control
measures daily to ensure erosion and sedimentation are being effectively controlled. If the
planned devices are not functioning as intended, they will immediately be replaced with

better devices. The rock silt screens and other erosion control devices will be in place prior
to pipe culvert construction and will remain in place until the project is stabilized.
By copy of this letter I am asking Mr. David Yow, North Carolina Wildlife
Resources Commission (NCWRC) District 9 Environmental Coordinator, to comment
directly to you concerning the 404 Nationwide Permit request.
A request will be made on this project for a temporary encroachment in the Trout
Water Buffer Zone of Barkers Creek and I am asking Mr. Yow and Mr. Ed Ingle, Area
Roadside Environmental Engineer (NC Department of Transportation) to comment directly
to me concerning the Trout Water Buffer Zone Encroachment.
Also, by copy of this letter, I am requesting authorization to proceed under Section
401 of the Clean Water Act from the Division of Environmental Management.
We would like to begin construction as soon as possible. If further information is
required, please call me at (704) 321-4105. Your early review and consideration will be
greatly appreciated.

TEMPORARY SILT FENCE:
A temporary silt fence is commonly used at the toe of a fill section to prevent off-
site sedimentation. It is made of permeable filter fabric buried at the bottom,
stretched and supported by steel posts. The silt fence reduces the water flow while
retaining'the sediment. They may also be used to divert water flow to protected
outlets. Silt fences need to be checked after each significant rainfall to ensure there
effectiveness. They must be maintained on a regular basis. Silt fences shall not be
installed across streams, ditches, or waterways.
AREAS OF USE:
• At toe of fill sections where sediment runoff can be stored and contained
inside the project limits.

SILT BASIN TYPE-B.
A silt basin type-B is a temporary basin built to collect sediment flowing through a
drainage way. The silt basin is built at the base of the ditch with its length being at
least 2 times the width of the basin. The type-B silt basin is generally built in
conjunction with temporary rock silt checks and other devices that control or slow
down water flow. This device must be monitored closely and cleaned out on a
regular basis until grass is established along the ditch line and sedimentation is no
longer a problem.
AREAS OF USE:
• In conjunction with temporary rock silt checks and other devices used in
drainage ditches.
DESIGN CRPIERIA:
• Width - variable
• Length - 2 times width
• Depth - 2 ft. minimum storage - 1800 cubic feet/acre (equals L x W x D)

TEMPORARY ROCK SILT CHECK TYPE-B:
A temporary rock silt check type-B (also called check dam) is a small dam with a
weir used to reduce gullying in drainage ditches that are to be filled or
permanently stabilized at a later date. These type-B rock silt checks help reduce
the flow velocity and are generally made of class-B stone. They are used in ditches
during construction where the grade meets and/or exceeds 3%.
AREAS OF USE:
• In channels, roadside ditch outlets, temporary silt ditches, and temporary
diversions.
• In conjunction with type-B silt basins.
DESIGN CRITERIA:
• Center of rock silt check shall be at least 1 foot lower than the outer edges
(top of channel sides)
• The spacing (ft.) = (3 / % of ditch grade) X 100 ft.

ROCK SILT SCREEN:

A rock silt screen is a low-level dam structure to be used in streams below culvert
sites. Rock silt screens shall be used to trap sediment transported by running water
and shall be placed in the stream below the construction site within the right-of-
way or easement boundary. The rock silt screen utilizes class B stone lined with #5
or #57 stone to produce a ripple-effect in the stream to settle the larger sediment
particles transported in the stream from the construction site. The trapped sediment
shall be cleaned out before the device is removed from the stream.
AREAS OF USE:
• In live streams below construction sites where construction occurs in or
adjacent to the stream.
• In live streams below a culvert construction site.
• Where it can be cleaned before it is removed from stream.
DESIGN CRITERIA:
• Structural stone - class B stone
• Sediment control stone - # 5 or # 57 stone
• Dam height - 1.5 ft. minimum and 3 ft. maximum ( shall not be higher Ethan
1 ft. above normal flow of stream)

PIPE OUTLET ENERGY DISSIPATOR:
A pipe outlet energy dissipator shall be used at pipe outlets to slow the water
velocities when it exits the pipe and flows out ditched or natural waterways. It is
an apron of stone of a sufficient thickness to protect the outlet area from scouring
out and causing off-site sedimentation damage. Pipe outlet energy dissipators
should be built according to the guideline chart shown on page VIII-3 of this
manual.
AREAS OF USE:
• Outlets of pipes and culverts to prevent scouring.
DESIGN CRITERIA:
• In accordance with chart on page VIII-3.
• Filter fabric, or six inch layer of gravel, shall be used under stone.
MATERIALS :
• Filter fabric shall meet requirements of section 1056 of Standard
Specifications for Roads and Structures, January 1, 1990, for type II filter
fabric.

Dear Mr. Anderson:
Reference your April 28, 1995 application for Department of the Army (DA)
authorization to grade, base, drain, pave, and widen S.R. 1104 (Mulberry Road)
for 2,350 linear feet from the Georgia state line to the bridge at kers
Creek, near Otto, in Macon County, North Carolina. As part of e pro ect,
several culverts carrying live streams (Barkers Creek and trib taries) ill be
replaced/extended. As a result of the construction, less th one-tent of an
acre of headwater stream channel and wetlands will be impact This roject
has been coordinated with the NC Wildlife Resources Commissio •(WRC).
For the purposes of the Corps of Engineers' Regulatory Proms, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions, those
conditions outlined in the WRC letter (which you have already received), and
provided you receive a Section 401 water quality certification from the North
Carolina Division of Environmental Management (NCDEM). You should contact Mr.
John Dorney, telephone (919) 733-1786, regarding the above mentioned water
quality certification. This nationwide permit does not relieve you of the
responsibility to obtain other required State or local approval.
This verification will be valid until the nationwide permit is modified,
reissued or revoked. All the nationwide permits are scheduled to be modified,
reissued or revoked prior to 21 January 1997. It is incumbent upon you to
remain informed of changes to the nationwide permits. We will issue a public
notice announcing the changes when they occur. Furthermore, if you commence
or are under contract to commence this activity before the date the nationwide
permit is modified or revoked, you will have twelve months from the date of
the modification or revocation to complete the activity under the present
terms and conditions of this nationwide permit.
