APPROVAL of 401 Pater Quality Certification
Mr. W. Trent Anderson
NC DOT
P. 0. Box 1551
Andrews, N.C. 28901
Dear Mr. Anderson:
FILE Corg
You have our approval to place fill material in 0.017 acres of wetlands or waters for the purpose
of constructing road improvements at SR 1389, Daves Creek Road, as you described in your
application dated 21 April 1995. After reviewing your application, we have decided that this fill is
covered by General Water Quality Certification Number 2735. This certification allows you to use
General Permit Number 031 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project,
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.
Sincerely,
P stop 'Howard, Jr. P.

Dear Mr. Johnson:
The North Carolina Department of Transportation is proposing to widen and pave
SR 1389, Daves Creek Road, in Macon County. In order to construct this project in
accordance with our current secondary road standards it will be necessary to extend or
upgrade pipe culverts in three (3) locations. At survey station 11+00 (SITE 1) the existing
72" CMP is to be extended six (6) feet on the inlet end and 12.5 feet on the outlet end. At
survey station 23-4-30 (SITE 2) the existing 18" CMP is to be replaced with 55 LF of 24"
CMP. The inlet end of this new 24" CMP will be in the same location as the existing 18"
CMP. At survey station 27+60 (SITE 3) the existing 72" CMP is to be extended four (4)
feet on the inlet end and six (6) feet on the outlet end.
By constructing this project we will be avoiding some adjacent wetland areas but
due to right of way constraints will encroach upon one (1) particular wetland area 580 sq.
ft. or 0.013 acres.
All pipe culverts are to be installed slightly below the existing streambed elevations
to minimize impacts to wildlife habitat and allow the existing stream gradients to remain as
unchanged as is physically possible. The affected streams are Davos Creek and some of
its tributaries. Davos Creek has been designated as Class C by the North Carolina Division
of Entiiromnental Management.

The best management practices will be used to minimize and control erosion and
sedimentation on this project. The construction foreman will review all erosion control
measures daily to ensure erosion and sedimentation are being effectively controlled. If the
planned devices are not functioning as intended, they will immediately be replaced with
better devices. The rock silt screens and other erosion control devices will be in place
prior to pipe culvert construction and will remain in place until the project is stabilized.
By copy of this letter, we are requesting the N. C. Wildlife Resources Commission
(NCWRC) District 9 Environmental Coordinator, Mr. David Yow, to comment to you
concerning our request. Also, by copy of this letter to the N. C. Division of
Environmental Management (NCDEM), we are requesting authorization under Section
401 of the Clean Water Act.
Enclosed are a location map, straight-line diagram, plan/profile sheets, erosion
control plans and details, and a U.S.G.S. map indicating project area and location of
proposed pipe culverts along the road. Please review this request for authorization under
Section 404 of the Clean Water Act. If you have any questions concerning this permit
application, please contact me at (704) 321-4105.
Sincerely,
0.? 4tA__?

TEMPORARY SILT FENCE:
A temporary silt fence is commonly used at the toe of a fill section to prevent off-
site sedimentation. It is made of permeable filter fabric buried at the bottom,
stretched and supported by steel posts. The silt fence reduces the water flow while
retaining the sediment. They may also be used to divert water flow to protected
outlets. Silt fences need to be checked after each significant rainfall to ensure there
effectiveness. They must be maintained on a regular basis. Silt fences shall no be
installed across streams, ditches, or waterways.
AREAS OF USE:
At toe of fill sections where sediment runoff can be stored and contained
inside the project limits.

SILT BASIN TYPE-B:
A silt basin type-B is a temporary basin built to collect sediment flowing through a
drainage way. The silt basin is built at the base of the ditch with its length being at
least 2 times the width of the basin. The type-B silt basin is generally built in
conjunction with temporary rock silt checks and other devices that control or slow
down water flow. This device must be monitored closely and cleaned out on a
regular basis until grass is established along the ditch line and sedimentation is no
longer a problem.
AREAS OF USE:
• In conjunction with temporary rock silt checks and other devices used in
drainage ditches.
DESIGN CRITERIA:
• Width - variable
• Length - 2 times width
• Depth - 2 ft. minimum storage - 1800 cubic feet/acre (equals L x W x D)

TEMPORARY ROCK SILT CHECK TYPE-B:
A temporary rock silt check type-B (also called check dam) is a small dam with a
weir used to reduce gullying in drainage ditches that are to be filled or
permanently stabilized at a later date. These type-B rock silt checks help reduce
the flow velocity and are generally made of class-B stone. They are used in ditches
during construction where the grade meets and/or exceeds 3%.
AREAS OF USE:
• In channels, roadside ditch outlets, temporary silt ditches, and temporary
diversions.
• In conjunction with type-B silt basins.
DESIGN CRITERIA:
• Center of rock silt check shall be at least 1 foot lower than the outer edges
(top of channel sides)
• The spacing (ft.) = (3 / % of ditch grade) X 100 ft.

RUCK SILT' SCREEN:
.a.
A rock silt screen is a low-level dam structure to be used in streams below culvert
sites. Rock silt screens shall be used to trap sediment transported by running water
and shall be placed in the stream below the construction site within the right-of-
way or easement boundary. The rock silt screen utilizes class B stone lined with #5
or #57 stone to produce a ripple-effect in the stream to settle the larger sediment
particles transported in the stream from the construction site. The trapped sediment
shall be cleaned out before the device is removed from the stream.
AREAS OF USE:
• In live streams below construction sites where construction occurs in or
adjacent to the stream.
• In live streams below a culvert construction site.
• Where it can be cleaned before it is removed from stream.
DESIGN CRITERIA:
• Structural stone - class B stone
• Sediment control stone - # 5 or # 57 stone
• Dam height - 1.5 ft. minimum and 3 ft. maximum ( shall not be higher than
1 ft. above normal flow of stream)

^'•k
A pipe outlet energy dissipator shall be used at pipe outlets to slow the water
velocities when it exits the pipe and flows out ditched or natural waterways. It is
an apron of stone of a sufficient thickness to protect the outlet area from scouring
out and causing off-site sedimentation damage. Pipe outlet energy dissipators
should be built according to the guideline chart shown on page VIII-3 of this
manual.
AREAS OF USE:
• Outlets of pipes and culverts to prevent scouring.
DESIGN CRITERIA:
• In accordance with chart on page VIII-3.
• Filter fabric, or six inch layer of gravel, shall be used under stone.
MATERIALS :
• Filter fabric shall meet requirements of section 1056 of Standard
Specifications for Roads and Structures, January 1, 1990, for type II filter
fabric.
