Box 5189 Horse Shoe, N.C. 28742 FILE COPY Dear Mr. Dumas: You have our approval to place fill material in 0.09 acres of wetlands or waters for the purpose of road maintenance at SR 1525, Oleta Road, as you described in your application dated 4 April 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2735. This certification allows you to use General Permit Number 31 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. SAMUEL HUNT III SECRETARY 2 t5 ? 710 I am attaching a straight line diagram with erosion control plans, an application form for a Nationwide Permit, and a county map section locating SR 1525, Oleta Road, in Henderson County. SR 1525 is a gravel road that we propose to clear, grub, grade, pave, and replace/extend pipes for a distance of 1.62 miles. Grading will be moderate. We are requesting permission to replace and extend pipes in live streams noted on plans at survey stations 31+25, 35+10, 36+70, 53+35, 55+15, 56+00, 71+20 and 76+40. Pipes will be replaced using our standard method of pipe installation described in the erosion control plans. NCDOT Best Management Practices and proper phasing of erosion control items will be used to minimize and control sedimentation and erosion. We are also requesting permission to relocate a small stream that currently flows in the roadway ditch along Sta. 75+50 Rt. - 75+90 Rt. This proposed channel change is necessary to widen the roadway to the right of the proposed center line, away from Trout Waters as indicated in the enclosed erosion control plans. By copy of this letter to Mr. Richard Phillips, P.E. (DEHNR) we are requesting a variance to work in the Trout Water Buffer Zone of an unnamed tributary of Tumblebug Creek alongside survey station ranges 43+25 - 44+80 Rt., and 75+10 - 75+70 Lt. We do not propose to disturb the fill slope alongside 43+25 Rt. - 44+80 Rt; however, we do propose to extend/replace a pipe in the Buffer Zone at Sta. 75+35 as indicated in the erosion control plans. Due to steep creek bank side slopes and the erodible type of soil on this project, we are requesting permission to place rip rap in the Buffer Zone alongside survey station ranges 76+25 Lt. - 77+80 Lt., 82+15 Lt. - 83+30 Lt., and 83+70 Lt. - 85+50 Lt. as indicated on the attached straight line diagram and cross-sections. Wildlife Resources Commission, to comment directly to the Corps of Engineers concerning the Nationwide Permit request. Upon review for the Corps of Engineers, we are requesting that Mr. Yow forward a copy to us (NCDOT) as well. By copy ofthis letter, we are also asking Mr. Ed Ingle, Area Roadside Environmental Engineer (NCDOT), to comment directly to us on the above project. We are also requesting, by copy of this letter, that Mr. Ed Ingle, Area Roadside Environmental Engineer (NCDOT), and Mr. David Yow, N.C. Wildlife Resources Commission, comment directly to Mr. Richard Phillips, DEHNR, concerning the variance to work in the Trout Water Buffer Zone of the unnamed tributary to Tumblebug Creek. All pipes shall be laid in accordance with section 300 of the North Carolina Department of Transportation "Standard Specifications for Roads and Structures", January 1, 1990. Pipes will be installed in the dry wherever possible. I ?K TEMPORARY SLOPE DRAIN WITH EARTH BERM: E-- ?-- A temporary slope drain is a flexible tubing or pipe used to carry concentrated runoff from the top to the bottom of a cut or fill slope without causing erosion along the slope. An earth berm is an earth barrier designed to channel runoff into a number of erosion control devices. A berm is usiially constructed with typical'on- site material. T -sections and elbows at the inlets are used to intercept the directional flow of. the runoff, to protect the temporary slope drains from washouts. AREAS of USE: • At construction areas where storm water runoff above a cut or fill slope will cause erosion if allowed to flow over a slope. DESIGN CRrmRIA: • Peak runoff from 10 year storm. • T section shall be used at inlet for multiple directional flow. • Elbows shall be used at inlet for single directional flow. It is an apron of stone of a sufficient thickness to protect the outlet area from scouring out and causing off-site sedimentation dam- age.. Pipe outlet energy disipators should be built according to the-guideline chart shown on page 52 of this manual. AREAS OF USE: Outlets of pipes and culverts to prevent from scouring. Stone for plain rip rap shall consist of field stone or rough unhewn quarry stone. The stone shall be sound, tough, dense, resistant to the action of air and water, and suitable in all other respects for the purpose intended. Where broken concrete from demolished structures or pavement is avail- able, it may be used in place of stone provided that such use meets with the approval of the Engineer. However, the use of broken concrete which contains reinforcing steel will not be permitted. The stone or broken concrete shall be graded to meet the following requirements: 1. For Class 1 Rip Rap. Stone shall vary in weight from5 to 200 pounds. At least 30 percent of the total weight of the rip rap shall be in individual pieces weighing a minimum of 60 pounds each. Not more than 10 percent of the total weight of the rip rap may be in individual pieces weighing less than 15 pounds each. - Section 1044 1042-2 STONE FOR EROSION CONTROL. The stone shall be of a hard, durable nature and shall range in size as follows: Class Size A 2„ - 6„ B 5" - 15" All stone shall meet the approval of the Engineer. While no specific - gradation is required, the various sizes of stone shall be equally distributed within the required size range.
