Dear Mr. Anderson:
You have our approval to place fill material in 0.068 acres of wetlands or waters for the purpose
of road maintenance at SR 1413M, Hampton Branch Road, as you described in your application dated
12 January 1994. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2735. This certification allows you to use General Permit
Number 031 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this: certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

Dear Mr. Johnson:
The North Carolina Department of Trion (NC D.O.T.) is proposing to
grade, drain, base, and pave SR 1413K Halton Branch Road, in Macon County. In
order to construct this project in accordance W1 0i our cunvnt secondary road standards it
will be necessary to extend or replace corned metal pipe culverts at seven (7) locations
and incorporate five (5) short stream channel relocations. Due to the nature of this
proposed work, we are requesting arrthosization under Section 404 of the Clean Water Act.
The affected streams are Hampton Branch (DEM Class C) and tributaries.
The proposed channel changes are not located on the same stream but are tributary
to Hampton Branch which is tributary to Parbulp Creek (DEM Class C, Trout Water).
We intend to exercise every reasonable precausm to protect these valuable natural
resources. If possible, the channel changes will be constructed before stream flow is
permanently diverted into the newly constructed channels. By doing this, the downstream
movement of silt will be minimized dwmby prole fang Pa>ridge Creek as much as possible
from this type of construction work. We have wed every reasonable alternative
attempting to eliminate the need for these channel charges. We were successful at two (2)
locations but on the five (5) mentioned above the stream relocations were our only feasible
alternatives...
I am sending a straight line diagram with the proposed erosion control, stream,
stream bank, and construction limits at various sites along the project where we will be in
s??
conflict with the streams. In addition, I am sending a typical section of the road, cross-
sections, drawings for pipe culvert replaces, general, notes and standards on some
erosion control measures, and a marked map. We propose to install the new culverts
slightly below the existing streambed devatiom when bedrock is not encountered to
minimize impacts to wildlife habitat and allow dw existing stream gradients to remain as
unchanged as is physically possible.
The best management practices will be used to minimize and control sedimentation
and erosion on this project. The construction f reman will review all erosion control
measures daily to ensure sedimentation and erosion an being effectively controlled. If the
planned devices an not functioning as irk they will lately be replaced with
better devices. The rocksilt screens and other erosion control devices will be in place prior
to pipe culvert construction and will remain in plaice until the project is stabilized.
By copy of this letter I am asking Mr. David Yow, North Carolina Wildlife
Resources Commission District 9 Err roiunental Coordinator, to comment directly to you
concerning the 404 Nationwide Permit Request.
Also, by copy of this letter, I am requesting authorization to proceed under Section
401 of the Clean Water Act from rite Division of Environmental Management,

TE1IP0RARY SILT FENCE:
A temporary silt fence is commonly used at the toe of a fill section to prevent off-
site sedimentation. It is made of permeable filter fabric buried at the bottom,
stretched and supported by steel posts. The silt fence reduces the water flow while
retaining the sediment. They may also be used to divert water flow to protected
outlets. Silt fences need to be checked after each significant rainfall to ensure there
effectiveness. They must be maintained on a regular basis. Silt fences shall = be
installed across streams, ditches, or waterways.

inside the project limits.

SILT BAsil, TYPE-B:
y
A silt basin type-B is a temporary basin belt to collect sediment flowing through a
drainage way. The silt basin is built at the base of the ditch with its length being at
least 2 times the width of the basin. The type-B silt basin is generally built in
conjunction with temporary rock silt checks and other devices that control or slow
down water flow. This device must be moored closely and cleaned out on a
regular basis until grass is established along the ditch line and sedimentation is no
longer a problem.
AREAS OF USE:
• In conjunction with temporary rock silt checks and other devices used in
drainage ditches.
DESIGN CRITERIA:
• Width - variable
• Length - 2 times width
• Depth - 2 ft. minimum storage -1800 cubic feetlac re (equals L x W x D)

TEmPoRARY Roca SrLT CHEcK Tyw-$:
A temporary rock silt check type-B (also cad check dam) is a small dam with a
weir used to reduce gullying in drainage ditches that are to be filled or
permanently stabilized at a later date. These type-B rock silt checks help reduce
the flow velocity and are generally made of class-B stone. They are used in ditches
during construction where the grade meets and/or exceeds 3%.
AREAS OF USE:
• In channels, roadside ditch outlets, temporary silt ditches, and temporary
diversions.
• In conjunction with type-B silt basins.
RESIGN CRnEMA:
• Center of rock silt check shall be at least 1 foot tower than the outer edges
(top of channel sides)
• The spacing (ft.) _ (3 / % of ditch grade.) X 100 ft.

ROCS SILT SCREEN:

A rock silt screen is a low-level dam structuve to be used in streams below culvert
sites. Rock silt screens shall be used to trap sediment transported by running water
and shall be placed in the stream below the construction site within the right-of-
way or easement boundary. The rock silt screen utilizes class B stone lined with #5
or #57 stone to produce a ripple-effect in the stream to settle the larger sediment
particles transported in the stream from the construction site. The trapped sediment
shall be cleaned out before the device is removed from the stream
AREAS OF USE:
• In live streams below construction sites where construction occurs in or
adjacent to the stream.
• In live streams below a culvert construction site.
• Where it can be cleaned before it is removed from stream.
DESIGN CRITERIA:
• Structural stone - class B stone
• Sediment control stone - # 5 or # 57 stone
• Dam height - 1.5 ft. minimum and 3 ft. maximum ( shall not be higher than
1 ft. above normal flow of sue)

PIPE OUTLET ENERGY DSSIPATUR
A pipe outlet energy dissipator shall be used at pipe outlets to slow the water
velocities when it exits the pipe and flows out ditched or natural waterways. It is
an apron of stone of a sufficient thickness to protect the outlet area from scouring
out and causing off-site sedimentation damage. Pipe outlet energy dissipators
should be built according to the guideline chart shown on page VIII-3 of this
manual.
AREAS OF USE:
• Outlets of pipes and culverts to prevent scouring.
DESIGN CRITERIA:
• In accordance with chart on page VIII-3.
• Filter fabric, or six inch layer of gravel, shall be used under stone.
MATERIALS:
• Filter fabric shall meet requirements of section 1056 of Standard
Specifications for Roads and Structures, January 1, 1990, for type II filter
fabric.

Reference your January 12, 1995 application for Department of the y
(DA) authorization to widen and pave S.R. 1413M (Hampton Branch Road), ong
Hampton Branch, in the northwestern part of Macon County, North Carolina As
part of the project, culverts will be replaced/extended at 7 locations d 4
channel relocations will be needed. You have informed us that channel c ge
#1 (as outlined in the plans) will not be necessary now. Approximately 0.
acres of headwater wetlands and stream channel will be impacted by the
proposed construction. This project has been coordinated with the NC Wildlife
Resources Commission (WRC).
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330.6, published in the Federal
Register on November 22, 1991, lists nationwide permits. Authorization was
provided, pursuant to Section 404 of the Clean Water Act, for discharges of
dredged or fill material into headwaters and isolated waters.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions, those
conditions outlined in the February 22, 1995 WRC letter (which you have
already received), and provided you receive a Section 401 water quality
certification from the North Carolina Division of Environmental Management
(NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786,
regarding the above mentioned water quality certification. This nationwide
permit does not relieve you of the responsibility to obtain other required
State or local approval.
This verification will be valid for two years from the date of this
letter unless the nationwide authorization is modified, reissued or revoked.
Also, this verification will remain valid for the two years if, during that `
period, the nationwide permit authorization is reissued without modification
or the activity complies with any subsequent modification of the nationwide ,
permit authorization. If during the two years, the nationwide permit
authorization expires or is suspended or revoked, or is modified, such that
the activity would no longer comply with the terms and conditions of the
nationwide permit, activities which have commenced or are under contract to
commence, in reliance upon the nationwide permit, will remain authorized.
This is provided the activity is completed within twelve months of the date of
the nationwide permit's expiration, modification or revocation.
