F, 2009 from Mr. Dennis Fornes, of Dennis Fornes & Associates, requesting a pen-nit modification. State Pen-nit #116-09 was issued on August 26, 2009 for the construction of a docking facility, boat ramp, shoreline stabilization, pool, and workshop on Neuse River near Arapahoe, Pamlico County. The pen-nit expires on May 7, 2014. The request is to modify the permit to change the workshop into a storage platfonn, include a guest house, a tennis court, expand the shoreline stabilization, and infrastructure. The proposed rip rap will be expanded across the mouth of the Section 404 Wetland drainage feature. The section of rip rap will be 75' long and not exceed 1' above the adjacent wetland substrate. The C'r t"T will have return walls on either side of the drainage feature. The remaining development will take place outside of the 75' AEC. I would recommend that copies of this proposed modification be submitted to the U.S. Army Corps of Engineers, the NC Department of Transportation, and the NC Division of Water Quality for review and comments before issuing the Minor Modification to State Permit #116- 09. A check (#14025) in the amount of $100 has been received in order to process the request. Dear Mr. Connell, Thank you for coordinating the ons.ite meeting held yesterday November 4, 2009. There were some additional decisions made relative to the proposed site improvements mainly along the area connecting the Section 404 wetland drainage area with the river. I have revised the work plat to reflect the recommendations of yourself_ and Ms Tracey Wheeler with the US Army Corp of Engineers in that area, at least that was my intent. Please review the revised drawings and let me know if the redesign in that location meets with the requirements of The Division of Coastal Management as well as the US Army Corp of Engineers. On Behalf of Mr. Benjamin I am herewith requesting a minor modification to the above subject permit. I am including herewith 4 copies of a site plan entitled Proposed Minor modifications to permit number 116-09, dated October 22, 2009. The included plat contains a listing of the proposed modifications which I will also list herein and include a short discussion addressing the reasons for the proposed changes. 1. Mr. Benjamin is proposing to remove the 3 story boathouse from this project. It is now proposed to construct an open, elevated, platform for boat storage and launch. Mr. Benjamin has decided to include a poolh.oiise/ma_ritenance/guest quarters as a part of this project. This facility was will provide showers and sanitary facilities at the pool proper and also house pool equipment & maintenance materials. There will also be an upper level which will. serve as guest quarters. We feel this amenity is necessary and desire to include it as apart of this modification. The pool_ complex has also been relocated to a point approximately 12' feet north of the 75'AEC to facilitate the addition of the tennis court (item 3). 3. Mr. Benjamin has likewise decided to construct a regulation size tennis court as a part of this project and requests this facility be included in this request for a minor Modification. 4. The proposed drives were originally submitted on the Storm Water Permit application as gravel and has since been revised to Bituminous pavement. The storm water plans are being revised to reflect such and being submitted to NC Department of Water Quality for Review and comment. 5. As a part of this project, it was determined that a turnaround be placed near the terminus of state road 1122 (Bennett Place) to minimize the entry onto Mr. Benjamin's Property by the general public and to minimize the potential of motor vehicles from accidentally entering the steep slopes near the end of the State Road. We are in the process of submitting an encroachment request to The NCDOT for permission to construct this and connect with the existing road. 6. It is proposed to place the existing overhead electric distribution lines underground to minimize conflicts with the new proposed tennis court and pool house. Tideland electric is the Utility having jurisdiction over this line and a contract is in place with them to get this done. 7. It is proposed to add low profile rip-rap shoreline stabilization across the mouth of the wetlands. A cross-section view of this has been included on the work plat being provided as a part of this request. We feel that the inclusion of this rip-rap will serve to reduce erosive action of the river due to wave 3' IT) e °_ i°S n ?.? r?.? i -, aJ :?? } 4 no higher than 12" Inches above t e existing section 404 wetland substrate. 8, The incoming access drive leading to the boat storage platform is proposed to be relocated +/-- 6' feet westward from the or_i.g:i.na1ly proposed. ;Location in. order to preserve some existing trees. It is proposed to shift the elevated walkway about 10' northwardly in order to preserve existing trees. 9. It is proposed to construct a retaining wall along the south & west sides of the pool complex. This wall is needed to retain and stabilize the sloped areas adjacent to the pool patio and to carry a security fence required by State and Local Codes. 10. The bulkhead has been realigned near its terminus at the Eastern boundary of the property creating a 45 degree wing for the last 16' linear feet of the bulkhead and additional granite rip rap is proposed at this location to better absorb wave energy. This concludes the summary of proposed changes and modifications. On behalf of Mr. Benjamin, I am requesting that these changes be added to Mr. Benjamin's original submittal and hopefully be reviewed as a minor modification to existing permit number 116-09, dated August 26, 2009.
