After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. NAMATM DESCRIPTION: Project Setting The project is located on SR 1300 near Merrimon on Back Creek (Black Creek on some maps) whicb is a major tributary to Adams Creek in Carteret County. Back Creek flows from southeast to northwest and is approximately 85 wide at the project site. An intertidal marsh dominated by black needlerush (Juncus roemerianusl and saltgrass (Distichlis. spicata) with scattered patches of giant cordgrass (Sl2artina evnosuroides) and groundsel bush Baeeharis ball ifoli borders this tidal creek. Manmade canals approximately 15'-20' wide exist on three sides of SR 1300 and run parallel to the road. The canal along the southeast side of the road feeds a large shallow water bay. Along the bank of this canal, erosion is occurring with washout areas within 5' of the pavement. The existing bridge is currently approximately 25' wide by 87' long, utilizes five spans, and has a. vertical clearance at high We of less than 2'. Back Creek is a Primary Nursery Area, a class SA NSW water and closed to shellfishing. Project Dmription. The applicant proposes to replace an existing timber bridge with a new cored slab concrotc bridge. The process will involve "prepping " the approaches to the bridge by excavating areas approximately 10' X 30' on each side of the bridge. During the replacement process, the applicant proposes to raise the. existing grade approximately 18" and to shift the road alignment for approximately 400' on each side of the bridge to the west by 4' to 5'. In addition, the applicant proposes to install 580 linear feet of rock rip rap along the shoreline of the canals to eliminate areas subject to washing and to stabilize the proposed 1:1 slope. According to the applicant, the existing abutments will be used if riot damaged during demolition/removal of the old bridge spans. The proposed bridge will remain 25' wide and will have three spans that total 105' in length. Post project vertical clearance will be approximately 2.5'. Anticipated Impacts The project as proposed would involve the following AECs: Coastal Wetlands, Estuarine Waters, Public Trust Areas, and the Estuarine Shoreline. The "prepping" of the area would involve high ground excavation in an area totaling approximately 600 ft2 and would involve the removal of approximately 70 yds3. The filling activities associated with the shifting of the road would impact approximately 4000 ftz of high ground. During the shoulder dressup, approximately 540 fe of shoreline bank below the MAW would be excavated thus impacting a small area of shallow water habitat. NOV-09-1995 1453 FROM EHNR WILM REG OFFICE TO GALAMB & DORNEY P.06 FIELD INVESTIGATION REPORT: North CaroUrta Department of Tran5portatIon/ Carteret County PACE 43 The shifting of the road and the placement of tho associated rock rip rap would also result in the loss of approximately 5600 fO of shallow water habitat within the Estuarine Waters of the two southernmost canals. Also during the shifting of the road, approximately 2800 ftz of coastal wetlands on the northeast side of the goad would be filled. All these excavation and filling activities would probably result in short-term and localized turbidity within the Estuarine Waters of Back Creek. The applicant has proposed to implement Best Management Practices to minimize any adverse effects which may be caused by project-related sedimentation. After a pre-application meeting, the applicant agreed. to modify their project proposal which included substantially more impact to not only the resources being directly impacted but also the resources in the adjoining embayment. Consequently, the alignment was shifted slightly to the west and the amount of resources that were impacted was reduced tremendously. Prepared by M. The following correspondence is a response to your September 5, 1995 letter concerning the above referenced project. The proposed action will include the demolition and replacement of bridge No. 3 over Back Creek. The bridge will be replaced along the existing alignment and will not require a temporary detour. The existing bridge is outdated and in need of repair. There is also an erosion problem along the approach roads to this facility creating a safety hazard. During the design of the project, measures were taken to avoid and minimize impacts to waters of the US including wetlands. In addition, the proposed project will improve water quality and navigation within the main channel. The elevation of the new structure will be slightly higher (6 inches) than the existing bridge and will have fewer piers in the channel. The existing abutments will be retained if not damaged during construction. In addition, the grade of the approach roads will be raised approximately 18 inches and shoreline stabilization is necessary to eliminate the erosion problems. The increased side slopes from this action will result in filling 0.13 acres of surface waters and 0.06 acres of tidal marsh located adjacent to the roadway. The elimination of the erosion problems will improve water quality in the area and the navigation within Back Creek will also be improved by constructing a higher bridge with fewer piers in the channel. The impacts to wetlands have also been reduced from the original proposal which required excavation in 0.09 acres of tidal marsh to maintain the existing navigational channel adjacent to the southern approach road. This proposal avoids these impacts by shifting the alignment of the approach roads 4 to 5 feet to the west. 3*10 J? 2 As a result of these avoidance, minimization and improvement measures (mitigation) it is our opinion that compensatory mitigation is not required for the project. NARRATIVE DESCRIPTION: Project Setting The project is located on SR 1300 near Merrimon on Back Creek (Black Creek on some maps) which is a major tributary to Adams Creek in Carteret County. Back Creek flows from southeast to northwest and is approximately 85 wide at the project site. An intertidal marsh dominated by black needlerush uncu roemerianus) and saltgrass i tichli i to with scattered patches of giant cordgrass (Syartinna cynosuroides) and groundsel bush Baccharis halimifolia borders this tidal creek. Manmade canals approximately 15'-20' wide exist on three sides of SR 1300 and run parallel to the road. The canal along the southeast side of the road feeds a large shallow water bay. Along the bank of this canal, erosion is occurring with washout areas within 5' of the pavement. The existing bridge is currently approximately 25' wide by 87' long, utilizes five spans, and has a vertical clearance at high tide of less than 2'. Back Creek is a Primary Nursery Area, a class SA NSW water and closed to shellfishing. Project Description The applicant proposes to replace an existing timber bridge with a new cored slab concrete bridge. The process will involve "prepping " the approaches to the bridge by excavating areas approximately 10' X 30' on each side of the bridge. During the replacement process, the applicant proposes to raise the. existing grade approximately 18" and to shift the road alignment for approximately 400' on each side of the bridge to the west by 4' to 5'. In addition, the applicant proposes to install 580 linear feet of rock rip rap along the shoreline of the canals to eliminate areas subject to washing and to stabilize the proposed 1:1 slope. According to the applicant, the existing abutments will be used if not damaged during demolition/removal of the old bridge spans. The proposed bridge will remain 25' wide and will have three spans that total 105' in length. Post project vertical clearance will be approximately 2.5'. Anticipated Impacts The project as proposed would involve the following AECs: Coastal Wetlands, Estuarine Waters, Public Trust Areas, and the Estuarine Shoreline. The "prepping" of the area would involve high ground excavation in an area totaling approximately 600 ft2 and would involve the removal of approximately 70 yds'. The filling activities associated with the shifting of the road would impact approximately 4000 ft' of high ground. During the shoulder dressup, approximately 540 ft' of shoreline bank below the MHW would be excavated thus impacting a small area of shallow water habitat. FIELD INVESTIGATION REPORT: North Carolina Department of Transportation/ Carteret County PAGE #3 The shifting of the road and the placement of the associated rock rip rap would also result in the loss of approximately 5600 ft2 of shallow water habitat within the Estuarine Waters of the two southernmost canals. Also during the shifting of the road, approximately 2800 ft2 of coastal wetlands on the northeast side of the road would be filled. All these excavation and filling activities would probably result in short-term and localized turbidity within the Estuarine Waters of Back Creek. The applicant has proposed to implement Best Management Practices to minimize any adverse effects which may be caused by project-related sedimentation. After a pre-application meeting, the applicant agreed. to modify their project proposal which included substantially more impact to not only the resources being directly impacted but also the resources in the adjoining embayment. Consequently, the alignment was shifted slightly to the west and the amount of resources that were impacted was reduced tremendously. Prepared by M. PROJECT SUMMARY: The applicant proposes to replace an existing timber bridge with a new cored slab concrete bridge and raise the grade of the road approximately 18". NARRATIVE DESCRIPTION: Project Setting The project is located on SR 1300 near Merrimon on Back Creek (Black Creek on some maps) which is a major tributary to Adams Creek in Carteret County. Back Creek flows from southeast to northwest and is approximately 85 wide at the project site. An intertidal marsh dominated by black needlerush Juncu. roemerianus) and saltgrass istichfi icata with scattered patches of giant cordgrass S artin cynosuroides) and groundsel bush Baccharis halimifolia borders this tidal creek. Manmade canals approximately 15'-20' wide exist on three sides of SR 1300 and run parallel to the road. The canal along the southeast side of the road feeds a large shallow water bay. Along the bank of this canal, erosion is occurring with washout areas within 5' of the pavement. The existing bridge is currently approximately 25' wide by 87' long, utilizes five spans, and has a vertical clearance at high tide of less than 2'. Back Creek is a Primary Nursery Area, a class SA NSW water and closed to shellfishing. Project Description The applicant proposes to replace an existing timber bridge with a new cored slab concrete bridge. The process will involve "prepping " the approaches to the bridge by excavating areas approximately 10' X 30' on each side of the bridge. During the replacement process, the applicant proposes to raise the. existing grade approximately 18" and to shift the road alignment for approximately 400' on each side of the bridge to the west by 4' to 5'. In addition, the applicant proposes to install 580 linear feet of rock rip rap along the shoreline of the canals to eliminate areas subject to washing and to stabilize the proposed 1:1 slope. According to the applicant, the existing abutments will be used if not damaged during demolition/removal of the old bridge spans. The proposed bridge will remain 25' wide and will have three spans that total 105' in length. Post project vertical clearance will be approximately 2.5'. Anticipated Impacts The project as proposed would involve the following AECs: Coastal Wetlands, Estuarine Waters, Public Trust Areas, and the Estuarine Shoreline. The "prepping" of the area would involve high ground excavation in an area totaling approximately 600 fe and would involve the removal of approximately 70 yds3. The filling activities associated with the shifting of the road would impact approximately 4000 ft2 of high ground. During the shoulder dressup, approximately 540 ft2 of shoreline bank below the MHW would be excavated thus impacting a small area of shallow water habitat. r-, t FIELD INVESTIGATION REPORT: North Carolina Department of Transportation/ Carteret County PAGE #3 The shifting of the road and the placement of the associated rock rip rap would also result in the loss of approximately 5600 fe of shallow water habitat within the Estuarine Waters of the two southernmost canals. Also during the shifting of the road, approximately 2800 W of coastal wetlands on the northeast side of the road would be filled. All these excavation and filling activities would probably result in short-term and localized turbidity within the Estuarine Waters of Back Creek. The applicant has proposed to implement Best Management Practices to minimize any adverse effects which may be caused by project-related sedimentation. After a pre-application meeting, the applicant agreed. to modify their project proposal which included substantially more impact to not only the resources being directly impacted but also the resources in the adjoining embayment. Consequently, the alignment was shifted slightly to the west and the amount of resources that were impacted was reduced tremendously. Prepared by M. PROJECT SUMMARY: The applicant proposes to replace an existing timber bridge with a new cored slab concrete bridge and raise the grade of the road approximately 18". NARRATIVE DESCRIPTION: Project Setting The project is located on SR 1300 near Merrimon on Back Creek (Black Creek on some maps) which is a major tributary to Adams Creek in Carteret County. Back Creek flows from southeast to northwest and is approximately 85 wide at the project site. An intertidal marsh dominated by black needlerush Juncus roemerianus) and saltgrass (Di snicata) with scattered patches of giant cordgrass ( in cynosuroides) and groundsel bush Baccharis halimifolia borders this tidal creek. Manmade canals approximately 15'-20' wide exist on three sides of SR 1300 and run parallel to the road. The canal along the southeast side of the road feeds a large shallow water bay. Along the bank of this canal, erosion is occurring with washout areas within 5' of the pavement. The existing bridge is currently approximately 25' wide by 87' long, utilizes five spans, and has a vertical clearance at high tide of less than 2'. Back Creek is a Primary Nursery Area, a class SA NSW water and closed to shellfishing. Project Description The applicant proposes to replace an existing timber bridge with a new cored slab concrete bridge. The process will involve "prepping " the approaches to the bridge by excavating areas approximately 10' X 30' on each side of the bridge. During the replacement process, the applicant proposes to raise the existing grade approximately 18" and to shift the road alignment for approximately 400' on each side of the bridge to the west by 4' to 5'. In addition, the applicant proposes to install 580 linear feet of rock rip rap along the shoreline of the canals to eliminate areas subject to washing and to stabilize the proposed 1:1 slope. According to the applicant, the existing abutments will be used if not damaged during demolition/removal of the old bridge spans. The proposed bridge will remain 25' wide and will have three spans that total 105' in length. Post project vertical clearance will be approximately 2.5'. Anticipated Impacts The project as proposed would involve the following AECs: Coastal Wetlands, Estuarine Waters, Public Trust Areas, and the Estuarine Shoreline. The "prepping" of the area would involve high ground excavation in an area totaling approximately 600 fe and would involve the removal of approximately 70 yds3. The filling activities associated with the shifting of the road would impact approximately 4000 ft2 of high ground. During the shoulder dressup, approximately 540 ft2 of shoreline bank below the MHW would be excavated thus impacting a small area of shallow water habitat. A t FIELD INVESTIGATION REPORT: North Carolina Department of Transportation/ Carteret County PAGE #3 The shifting of the road and the placement of the associated rock rip rap would also result in the loss of approximately 5600 ft2 of shallow water habitat within the Estuarine Waters of the two southernmost canals. Also during the shifting of the road, approximately 2800 ft2 of coastal wetlands on the northeast side of the road would be filled. All these excavation and filling activities would probably result in short-term and localized turbidity within the Estuarine Waters of Back Creek. The applicant has proposed to implement Best Management Practices to minimize any adverse effects which may be caused by project-related sedimentation. After a pre-application meeting, the 'applicant agreed to modify their project proposal which included substantially more impact to not only the resources being directly impacted but also the resources in the adjoining embayment. Consequently, the alignment was shifted slightly to the west and the amount of resources that were impacted was reduced tremendously. Prepared by M. The proposed action will include the demolition and replacement of bridge No. 3 over Back Creek. The bridge will be replaced along the existing alignment and will not require a temporary detour. The elevation of the new structure will be slightly higher (6 inches) than the existing bridge and will have fewer piers in the channel. The existing abutments will be retained if not damaged during construction. In addition, the grade of the approach roads will be raised approximately 18 inches and shoreline stabilization is necessary to eliminate erosion problems. The increased side slopes from this action will result in filling 0.13 acres of surface waters and 0.06 acres of tidal marsh located adjacent to the roadway. The impacts to wetlands and waters have been reduced from the original proposal which required excavation in tidal marsh to maintain the existing navigational channel. This proposal avoids these impacts by shifting the alignment of the approach roads 4 to 5 feet to the west. In addition, the navigation within the main Back Creek will be improved by constructing a higher bridge and fewer piers in the channel. As a result of these avoidance, minimization and improvement measures, it is our opinion that compensatory mitigation should not be required for the project.
