After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2725. This certification allows you to use Nationwide Permit Number 6 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Approval is not given for any work which would require relocation or impact on Gashes Creek. DEM will not take action on the remainder of this project until the Corps of Engineers Public Notice has been done. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Although a number of other projects were discussed, we understand the above projects require the more immediate coordination in order to lessen the likelihood of permit and eventual construction delays. We are in receipt of the individual permit application for R-2306-A (US 74 from I-40 to SR 2775). In reviewing the application we find it to include only approximately 3.5 miles of the project. Combined with R-2306b, the total project is approximately 7.0 miles (11.26 Km.) Department of the Army permit regulations require that applicants submit applications and plans that include all activities the applicant wishes to undertake that are reasonably related to the same project and for which a DA permit is required. In keeping with these regulations, the R-2306A application is incomplete without segment B. The application for segment A is being held pending the receipt of additional information for segment B. As you may already be aware, it is essential that we receive a comprehensive project application in order to evaluate cumulative impacts to waters and wetlands over the length of the US 74 project and to fully apply avoidance and minimization standards under the 404 (b) (1) Guidelines of the Clean Water Act. Further, Federal and State review agencies typically expect no less than a complete and comprehensive public notice where such projects are proposed. In submitting, the complete project application, you should also include channel relocation/construction details (i.e. any proposed in- stream fish habitat structures, streambank revegetation plans, etc.) for the significant stream relocations. Likewise, if stream channel enhancement is proposed elsewhere in or near the project area to compensate for net linear stream footage lost, please indicate this with the complete application. The specific locations of any such channel enhancement work can be provided during the public notice review period if not immediately available. Regarding A-10, I understand that your office is planning to submit a comprehensive individual permit application package for sections BB, C, and D in place of a pre-discharge notification application for what would have been a large number of nationwide permits. Printed an IS Recycled Paper -2- We believe this decision is well founded in that this 12 mile long multi-lane interstate project is expected to have much more than minimal individual or cumulative impact on aquatic resources. Had you made a decision to submit a nationwide permit application/s DA regulations and the 404 (b) (1) guidelines allow for a finding by the District Engineer that it would be more appropriate to proceed with an individual permit. We believe that the individual permit procedures in this case will provide for a more efficient public review and better accommodate mitigation planning and review. In March of this year our Asheville office participated in a site inspection of the A-10 preferred alignment with a number of other Federal and State agency representatives. The project is expected to result in the loss of approximately 8 acres of wetlands. We are in agreement with your Department that there is little opportunity to further avoid or reduce wetland impacts within the selected corridor. Therefore it was recommended at that time that DOT, begin to consider developing a wetland mitigation plan to offset potential unavoidable wetland losses (perhaps on one of the proposed waste areas). Of even greater concern to this office and probably the review agencies are the expected primary and secondary impacts on trout streams and tributaries. Primary impacts will result from channel relocations and the numerous, lengthy culvert installations. Secondary effects may be even more significant due to sedimentation and runoff from upland construction, and watershed clearing. Acid rock may also be encountered during construction. Some of these impacts are already visible due to private logging operations within the anticipated highway corridor. In considering the potentially far reaching effects of this project on the various cold and cool water resources, my staff recommended at the March meeting that DOT develop an aggressive and comprehensive mitigation plan designed to avoid, minimize, and compensate for primary and secondary stream impacts. We believe that such a plan is essential and that it should be submitted with the permit application or at least during the public notice review period. In short it will be part of any issued permit along with the wetland mitigation plan. In providing recommendations concerning stream mitigation, all channel relocations should be planned in accordance with the North Carolina Wildlife Resources Commissions published guidelines for channel relocations. Relocation plans should show specific proposed in-stream structures designed to approximate natural habitat conditions. The plan should strive to add length to channel relocations where possible. Relocation plans should also include detailed revegetation plans including species composition, plant spacing, etc. Stream channels that are unavoidably placed in pipes/culverts and permanently b.iried under the highway, should be mitigated for by locating nearby waters suitable for enhancement. Enhancement should be undertaken on a greater than 1 to 1 linear ratio. Streams selected should be of similar size or larger. Typical enhancement measures may include but will not be limited to streambank stabilization and/or revegetation, installation of fish habitat structures, fish stocking, and fencing livestock out of the stream or constructing managed livestock watering facilities. -3- Concluding this, we are hopeful the above comments and recommendations will help to avoid permit and construction delays and at the same time insure compliance with DA and EPA permit regulations. I am confident that our goals can be and may already be similar where the overall public interest is concerned. The Department of Transportation's submission of the above requested additional information and mitigation planning will be appreciated. This memorandum responds to the subject environmental document. Staff biologists with the N. C. Wildlife Resources Commission (NCWRC) have reviewed the proposed project through multiple site inspections and onsite meetings with FHWA and NCDOT staff and resource agency personnel. Our comments are provided in accordance with provisions of the National Environmental Policy Act (42 U.S.C. 4332(2)(c)) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The proposed work involves widening of an existing two-lane highway facility in an area of urban growth and traffic congestion. Primary impacts to fish and wildlife resources involve encroachment on riparian corridors and relocation of stream segments in tributaries to Designated Public Mountain Trout Waters. Throughout the review process for this project, NCWRC staff biologists have discussed our concerns egarding the loss of stream habitat in the project area, particularly along the in stem of Gashes Creek. We commend the staff of the NCDOT and FHWA in their of rts to develop and evaluate design alternatives to reduce aquatic impacts. The proposed relocations of tributaries to public trout waters would constitute a significant impact to these resources and should be avoided where practicable alternatives exist. While we do not recommend that an Environmental Impact Statement be prepared for this project, it is our opinion that additional design modifications and mitigative measures will be necessary to alleviate the extensive project impacts on surface water 96-0056 Memo Page 2 August 21, 1995 resources. Therefore, we will concur with the FONSI for this project, provided the following modifications are incorporated into project designs: Impacts on Gashes Creek should be avoided to the extent practicable, possibly through symmetric widening in the vicinity of multiple resource conflicts and asymmetric widening away from the stream in other areas. We recognize that cultural resources exist in the vicinity of the roadway opposite Gashes Creek near the Blue Ridge Parkway. However, in completely avoiding direct physical impacts on these cultural resources, the proposed alternative incurs more than $0.65 million in additional project costs over those associated with the alternative that avoids the creek. Symmetric widening would effectively reduce impacts on both resources from the level of impact required through total avoidance of either resource, and project costs would likely be reduced because of reductions in the amount of soil-nail construction required. The 4(f) finding included in the FONSI determines only that no impact will occur on the B. K. Miller property if it is completely avoided. No evaluation of impacts of other alternatives or assessment of relative values of cultural or natural resources is discussed. Such an evaluation of avoidance alternatives must be completed before the NCWRC can consider minimization or compensatory mitigation options for wetland impacts associated with the project. When opportunities to avoid loss of stream channel have been fully explored through such a comparative evaluation, we will consider the engineering techniques for channel reconstruction as partial mitigation of unavoidable impacts to stream segments. We will likely recommend additional mitigation to compensate for lost stream channel segments under the anticipated individual 404 permit. Compensatory mitigation will likely involve NCDOT acquisition and protection of riparian habitat elsewhere in the Gashes Creek watershed. 2. We anticipate that this project will be permitted as an individual 404 permit. Therefore, we will recommend mitigation for all impacts to wetlands and waters associated with the project in Gashes Creek, Gap Creek, and other tributary waters. Fragmentiiig or segmenting the project to avoid mitigation responsibilities will not be acceptable. Thank you for the ongoing opportunity to provide input in the planning stages for this project. The North Carolina Department of Transportation (NCDOT) proposes to widen existing US 74 between I-40 and SR 3136 southeast of Asheville in Buncombe County. The preferred alternative with recommended improvements consists of widening the existing road to a five-lane 64-foot curb and gutter facility combining both northside and southside widening. A four-lane section is required through the underpass at the Blue Ridge Parkway where lateral clearance is limited. This widening project will be accomplished in two phases. The first phase is designated as TIP Project No. R-2306A, and extends from 1-40 to SR 2775. The enclosed application pertains specifically to this phase of the project. The environmental impacts of the entire R-2306 project were evaluated in an Environmental Assessment document which was signed by the Federal Highway Administration on January 19, 1994. The potential impacts were further reviewed in a Finding of No Significant Impact and Programmatic 4(f) document which was signed by the Federal Highway Administration on June 8, 1995. The proposed design of the project presented in this application is consistent with the findings of the FONSI document. The project permanently impacts waters of the United States at 23 locations, and wetlands at three of these sites. The project will fill a total of 0.06 acres of wetlands and 0.86 acres of surface water. These impacts are summarized on Sheets 1 A and 2. The most serious impacts to waters of the United States occur at several channel relocations along the project. The general locations of these impact areas are shown on Sheet 1 A. Detailed drawings have been provided showing the areas where channel changes are proposed. 9 2 Considerable controversy has arisen over the alignment of the project in the vicinity of the B. K. Miller property and Gashes Creek. The B. K. Miller house and property has been determined to be eligible for the National Register of Historic Places and thus is offered protection under Section 4(f) of the Department of Transportation Act. Immediately across existing US 74 from the Miller property lies one of the few relatively undisturbed portions of Gashes Creek, which is designated a Hatchery Supported Designated Public Mountain Trout Water by the N.C. Wildlife Resources Commission. The proposed design avoids the historic property and rechannels approximately 800 feet of Gashes Creek. The creek will be relocated in an open channel with a naturalized bottom and revegetated banks. The adjacent hillside will be held back by a soil-nail retaining wall, which minimizes disturbance further up the slope. The proposed design is consistent with the Finding of No Significant Impact and Programmatic 4(f) document which was signed by the Federal Highway Administration on June 8, 1995. This area is depicted on Sheets 9-11A, and is identified as Site 6 in the permit package. The proposed design will also require a channel change at Site 1, near the Blue Ridge Parkway overpass. This will involve relocating approximately 400 feet of Gashes Creek (Sheets 6-8). Approximately 175 feet of the channel of Gashes Creek will also be slightly shifted at the intersection of US 74 and SR 3121 to tie into an extended culvert ( Site 7, Sheets 12-14A). This also occurs at the western intersection of US 74 and SR 2771, affecting about 250 feet of channel (Site 10, Sheets 15-17A). Modifications to the eastern intersection of US 74 and SR 2771 will require a new culvert and extensions of an existing culvert. Approximately 375 feet of the stream channel will also be relocated at this intersection (Sites 13-14, Sheets 18-22A). The project will also relocate portions of Gap Creek and a tributary at Sites 22 and 23. Site 22 involves the extension of an existing culvert with concrete pipe. Approximately 350 feet of the stream will be relocated to the base of the roadway fill slope, and will tie into the extended culvert (Sheets 23-25A). Site 23 will involve the removal of the existing culvert and the construction of a new culvert (Sheets 26-28). About 300 feet of the stream channel will be redirected through the new culvert. The NCDOT has studied many alternative designs to avoid adverse environmental impacts. The Environmental Assessment examined five build alternatives for the project, and selected a preferred alternative. Several review agencies objected to the original design of the stream impacts at Site 6, and requested that additional alternatives be studied. Consequently, the FONSI document examined 4 alternative designs at this site to further avoid and minimize impacts. The NCDOT has also utilized retaining walls to minimize stream impacts. It is the NCDOT's position that this proposal represents the least damaging, most practicable alternative. The most important environmental impacts of the project are the stream relocations required. Consequently, the NCDOT intends to mitigate for these impacts through the design and implementation of the new channels. The design of all channel changes will be closely coordinated with the North Carolina Wildlife Resources Commission, U.S. Fish and Wildlife Service and other interested agencies. The new channels have been designed in accordance with the North Carolina Wildlife Resources Commission's "Guidelines for Mountain Stream Relocations in North Carolina. The new channels have been designed to replicate the existing channel in terms of channel width and substrate as much as practicable. The Planning Division of the U.S. Army Corps of Engineers, Wilmington District, advised the NCDOT that an Individual Permit would be required for this project by letter dated April 21, 1994. Consequently, an application for this authorization is enclosed. The NCDOT also needs to conduct preliminary geotechnical investigations in preparation for retaining wall construction. Materials describing these proposed activities are also enclosed. The drawings shows that three of the drill sites will have to be accessed from the creek bed. An ATV drill machine will be used to drill holes to determine a rock line on which to construct the retaining wall. It is anticipated that this activity can be authorized under Nationwide Permit No. 6. The NCDOT hereby requests that you initiate review of the project for 404 Individual Permit authorization. It is also requested that you review the Nationwide 6 request as a separate action, as these investigations need to occur as soon as possible. A copy of this information has been provided to the N.C. Yow, District 9 Habitat Biologist Habitat Conservation Program DATE: September 14, 1995 SUBJECT: 401 Water Quality Certification, Federal Highway Administration (FHWA) and North Carolina Department of Transportation (NCDOT) proposed fill in waters and wetlands, US 74 from I-40 to SR 3136, Buncombe County, North Carolina, TIP No. R-2306, DEM ID #95858. This memorandum responds to the subject application for 401 Water Quality Certification through your office for the proposed roadway expansion. The N. C. Wildlife Resources Commission (NCWRC) has reviewed the proposed project through multiple site inspections and onsite meetings with FHWA and NCDOT staff and resource agency personnel. Our comments are provided in response to your request for our concerns regarding impacts to existing uses in the project area related to fish and wildlife habitat. 'Be proposed work involves widening of an existing two-lane highway facility ui an area of urban growth and traffic congestion. Primary impacts to fish and wildliic resources involve encroachment on riparian corridors and relocation of stream segments in tributaries to Designated Public Mountain Trout Waters. Throughout the review process for this project, NCWRC staff biologists have discussed our concerns regarding the loss of stream habitat in the project area, particularly along the main stem of Gashes Creek. We reference recent correspondence to Mr. H. Franklin Vick of the NCDOT from the U. S. Army Corps of Engineers (G. Wayne Wright, August 25, 1995) regarding fragmenting of the subject project within the permitting process. We concur with the finding of the Corps that the subject application is incomplete without both segments A and B included in the project description. All wetland and waters impacts for the project should be assessed and mitigated under a single permitting action for this project. We anticipate that an Individual Public Notice will be circulated by the Corps when sufficient information on project-related impacts has been provided.
