On 12 July 1995 you wrote the Division of Environmental Management (DEM)
regarding your plan to pave SR 1471, Pittmans Gap Road in non-wetlands. Your letter
sought approval from DEM to pave this road in non-wetlands. Please be aware that a 401
Water Quality Certification issued by this office is only needed when there is a 404 Permit
issued by the U.S. Army Corps of Engineers which usually involves clearing and/or filling of
wetlands. As long as no wetlands impacts occur, approval by this office is not necessary.

I am attaching a straight line diagram with erosion
control plan and a county map section relative to the paving
of SR 1471, Pittmans Gap Road, in Burke County
Pittmans Gap Road is presently 16 to 18 feet wide. We
plan to add stone and pave the road 18' wide. Grading will
be light. There is no cross pipe which carries a live stream
that will be extended.
Because a variance to work in the twenty-five foot
buffer zone from the Department of Environment, Health and
Natural Resources will be required, we are requesting that
you comment directly to us on the above project.
By copy of this letter, I am asking E. L. Ingle, Area
Environmental Engineer, to comment on the above project.
Also, by copy of this letter, I am sending seven (7)
copies of the straight line diagram to the Division of
Environmental Management.
Your earliest consideration for this request would be
appreciated. If any further information is needed, please
advise.
