Dear Mr. Bennett:
You have our approval to place fill material in 0.15 acres of wetlands or waters for the purpose
of road maintenance at SR 1353, Big Windfall Road, as you described in your application dated
3 April 1995. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit
Number 3 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

along SR 1353 in small stream trib. to
Big Windfall branch class-c-trout.
Dear Mr. Thomas,
The Department of Transportation is scheduled to grade, drain
base, and pave primarily along the existing roadway of SR 1353
(Big Windfall Rd)., in Ashe County during the 1994-1995 fiscal
year. Due to the proximity of a small stream being a trio to
Big Windfall Branch Class-c-trout we are requesting a 404
Nationwide permit no. 3 to allow us to upgrade the 10 existing
cross line drainage structures that will need replacing, and or
extending.
Attached is a straight line sketch with proposed erosion control,
stream, stream embankment, pipe crossing, and marked county map.
By copy of this letter I am asking Ms. Stephanie Goudreau Mt.
Region Coordinator with the North Carolina Wildlife Resources
Commission to comment directly to you concerning the 404
Nationwide Permit request.
A request will be made on this project for a Temporary
Encroachment in the Trout Water Buffer Zone of Halls Ck. and I am
asking Mr. Mickey to comment directly to me concerning the Trout
water buffer zone encroachment.

Also by copy of this letter, I am requesting authorization to
proceed under Section 401 of.the Clean Water Act from the Division
of Environmental Management.
We would like to begin construction as soon as possible. If
further information is required, please let me know. Your early
review and consideration will be greatly appreciated.

DESIGN STANDARDS IN SENSITIVE WATERSHEDS
Pursuant to G.S. 113A-57(3) provisions for a ground
cover s»fficient to restrain erosion must be
provided for any portion of.a land-disturbing
activity in a HnW zone within 15 working days or 60
calendar days following completion of construction
or, development, whichever period 14 shorter.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) on projects performed by D.O.T. Maintenance Forces,
request will promptly be made to the Division Roadside
Environmental Unit for stage and permanent seeding.
(5) Any removal of siltation devices will be based on the
condition of established ground cover of that area the
devir:e i4 serving.
