The Application provides adequate assurance that the discharge of fill material into the waters of Albemarle Sound in conjunction with the proposed development in Camden County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92- 500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (50 NTUs in streams and rivers not designated as trout waters by DEM; 25 NTUs in all saltwater classes, and all lakes and reservoirs; 10 NTUs in trout waters). Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. This Certification shall expire upon expiration of the 404 or CAMA permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. RE: Installation of Pipe structures(s) To Replace Private Bridge on sailboat Road Off SR-1163 In Camden Point Shores, Camden County Dear Mr. Evans: As you requested a review of subject location has been made and the following comments are offered. In my letter of April 11, 1989 to Mr. C. O. White, Division engineer, alternates for the bridge replacement structure were 2 @ 90" corrugated metal pipes or a 142" x 91" corrugated metal pipe arch. Pipe material to be fiber bonded bi tumincus coated steol pipe or saluminura pipe. Length of pipe required for conformance to Division of Highways standards is dependent upon end treatmeht of the structure(s). Installation with end wall construction will require about 45' of'pipe length. Xnstallation with pipe projecting or nitorod to tho roadway ombankmant fill slope will require about 60' of pipe length. As discussed by telephone, the questionable condition of adequate foundation for end wall construction could result in considerable additional cost which may make the projected or mitered end treatment more economical. Please find attached a sketch showing both methods of installation. DOT of Camden County, filed an application on March 1, 1995, for a permit from the Division of Coastal Management to develop in an Area of Environmental Concern and for certification from the Division of Environmental Management that a discharge of fill material in project wetlands will not violate applicable water quality standards. According to said application N.C. DOT proposes to replace the existing wooden span bridge with a culvert and fill. The property is located at Camden Point Shores, on SR 1163, Camden County. PROJECT SUMMARY: NCDOT proposes to replace the existing wooden span bridge with a culvert and fill bridge on SR 1163, Camden Point Shores, Camden County. N.C. DOT Bridge SR 1163 Camden Point Shores - Sailboat Road Bio Report Page Two Site Description Camden Point Shores and the Sailboat Road Bridge are located approximately 10 miles southeast of the community of Shiloh in Camden County. This bridge is located at the end of the existing hard surface road on Sailboat Road (SR 1163). The existing wooden bridge is currently maintained by the Camden Point Home Owners Association. The existing bridge allows only limited vehicular access and is in need of repair or replacement. N.C. DOT and the Camden Point Shores Home Owners Association have agreed to a mutual bridge replacement project. In this agreement, the Camden Point Shores Home Owners Association would provide the culvert/bridge material, and N.C. DOT would construct the new bridge and maintain it. Clearances beneath the existing bridge do not allow any public trust access upstream of the bridge and restrict movement of waters between the Albemarle Sound and the man-made canal adjacent to the present structure. Migration of fishery resources may also be limited by the existing wooden structure. The applicant proposes to remove the existing bridge and replace it with a culvert with an opening of 142" x 91" and a length of 60 feet. This replacement would include 200 cubic yards of fill to be placed below the NWL and would impact 1,000 sf. of non-vegetated wetlands (ie., shallow water habitat). This proposed project would directly impact 400 sf. of freshwater wetlands, including areas vegetated with plant species Arundinaria gigantea (giant cane) and Phragmitis australis (giant reed). No coastal or submerged species are present at this location. Approximately 60 linear feet of shoreline adjacent to the crossing structure slope would also be stabilized with rip-rap stone material. The proposed roadway would be 40 feet in width with 10 foot of slope on both sides of the roadway. A total area of 2,400 sf. would be impacted by this project. Anticipated Impacts This proposed project would directly disturb an area of 2400 sf. (0.058 A.). Approximately 1,000 sf. (0.024 A.) of impacts would be directly to non-vegetated wetlands and estuarine waters. In addition, approximately 400 sf. of freshwater wetlands would be filled. 1,000 sf. (0.024 A) of upland would be filled. N.C. The proposed structure would allow limited public trust access to several miles of canals and may improve movement of fishery resources upstream. The proposed structure may also improve upstream flushing and water quality. Some temporary turbidity would be experienced downstream from the bridge site until construction is complete and the site stabilized. The improved roadway would also provide a dependable vehicular access to several residents located beyond the existing bridge on Sailboat Road. CAMA Review The land use in the vicinity of Camden Point Shores is residential with some small commercial family fishing operations.
