FILE CUYou have our approval to place fill material in 0.02 acres of wetlands or waters for the purpose
of road maintenance at SR1103A (Woodruff Road), as you described in your applications dated 23
January and 3 August 1995. After reviewing your application, we have decided that this fill is covered
by General Water Quality Certification Numbers 2745 and 2732. These certifications allow you to use
Nationwide Permit Numbers 3 and 14 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Dear Mr. Jolly:
In your letter of February 14, 1995 you authorized The North Carolina Department of Transportation,
District I Maintenance to proceed with the work as described above which included replacing two bridges
on Brush Creek and an unnamed tributary to Brush Creek. The bridge at Station 37+75 was to be replaced
with a single span bridge approximately 40LF in length. After further study, we would prefer to replace this
bridge with a double line of 117"x79" CMPA approximately 50' in length. We would install a concrete
headwall on the inlet of the pipe and rip rap the outlet end. Since the location of the proposed pipe is bed
rock, we would not be able to bury the pipe 1' into the substrate as usually required by the Wildlife
Resources Commission. We would place foundation conditioning material on the rock on which to place
the new line of pipe. This has been discussed with Ms. Stephanie Goudreau, Mountain Region
Coordinator Habitat Conservation Program, Wildlife Resources Commission and since we will be
encountering bed rock, she has no objection to not burying the pipe 1' into the substrate.
We are requesting that the 404 Nationwide Permit (# 14 Road Crossing) be revised to allow the placement
of the additional pipe as described. All other information in the original application is unchanged.
By copy of this letter I am asking Ms. Stephanie Goudreau, Mountain Region Coordinator of the North
Carolina Wildlife Resources Commission to confirm her verbal approval of this change by responding
directly to you.
A request has been made and approved on this project for a Temporary Encroachment in the Trout Water
Butter Zone of tributaries to and DEHNR Trout Stream (Brush Creek) and this change does not affect that
encroachment since this will be an approximate perpendicular crossing and all other activities will be
unchanged. I am asking Ms. Goudreau to comment directly to me concerning the Trout Water Buffer Zone
Encroachment.
Also, by copy of this letter, I am requesting authorization for this change under Section 401 of the Clean
Water Act from the Division of Environmental Management.

Dear Mr. Jolly:
The North Carolina Department of Transportation, District I Maintenance plans to grade this road primarily
along the existing alignment in the 1995 - 1996 Fiscal Year. We will be replacing existing bridges at Station
37+75+- and Station 39+00+-. The first bridge will be replaced with a bridge of approximately a 40 LF span
and the second bridge will be replaced with a 95"x 67" CMPA. We will also be extending or replacing
various other pipe culverts throughout the project which do no involve live streams. We are requesting a
404 Nationwide Permit (#3 Maintenance) from your agency.
I am sending a straight line sketch with the proposed erosion control, stream, and cross sections of the
affected areas. In addition, I am sending a typical section of the road, general notes on erosion control and a
marked map.
By copy of this letter I am asking Ms. Stephanie Goudreau, Mountain Region Coordinator of the North
Carolina Wildlife Resources Commission to comment directly to you concerning the 404 Nationwide
Permit request.
A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of
the DEHNR Trout Stream (Brush Creek) and I am asking Ms. Goudreau to comment directly to me
concerning the Trout Water Buffer Lone Encroachment.
Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water
Act from the Division of Environmental Management.
We would plan to begin construction in the spring. If further information is required, please let me know.
Your early review and consideration of this request will be greatly appreciated.

Silt Basin Type B's will be constructed to the dimension of
six feet by three feet by three feet unless otherwise noted
on the plans.
Generally, the order of installation of.the erosion control
measures will be as follows:
Temporary silt basins shall be installed before
clearing and grubbing begins.
Silt fences and temporary silt ditches shall be
installed after clearing and before grading.
Temporary stone ditch checks shall be installed as
soon as ditchline is established.
Pipe outlet and inlet protection will be done as
soon as the pipe is installed.
Seeding and other permanent erosion control
measures are to be implemented as soon as practical.
