PROJECT SUMMARY: The applicants propose to conduct hydraulic maintenance dredging of a 3,216 SF area of the Pamlico Sound and construct a 2,745 SF spoil disposal area on the adjacent waterfront lot. Project Setting The applicants' properties are located on the north and south sides of an unnamed access easement that connects to NC Highway 12 in Rodanthe, Dare County. The properties are located on the Pamlico Sound approximately 500 feet west of the intersection of Midgetts Mobile Court and NC Highway 12. Mr. Spence's property, which is located on the north side of the access easement, consists of a 1.16-acre parcel that has been divided into three lots. The eastern most lot, Lot #1, contains a 16-foot by 20-foot shed. Lot #2 is undeveloped, but Lot #3 has been bulkheaded. The lots north of Mr. Spence's property have not been hardened. Mrs. White's property, which is located on the south side of the access easement, consists of a .82-acre parcel. The Hatteras Jack fishing tackle shop is located on the eastern half of the property, while asingle-family residence is located on the western half of the property. Mrs. White's property and the lots south of her lot have not been hardened. Both of the applicants' properties are comprised of upland areas with elevations of three - four feet that are vegetated with mowed weeds and indigenous grasses. No U.S Army Corps of Engineers Section 404 wetlands or Division of Coastal Management Coastal Wetlands are located on the subject properties or will be affected by the proposed development. The applicants' share a pier structure that is located at the western end of the unnamed access easement. The pier structure extends 190 feet into the Pamlico Sound and is equipped with pilings to create three boat slips and 820 SF of platformJfinger piers. The current water depths in the proposed dredge area located northwest of the pier are 2.1 - 3.5 feet, with a connecting water depth of 4 feet. No SAVs were observed in the proposed dredge area, however SAVs are present in the shallower water located north of the existing pier structure. The proposed dredge spoil disposal area will be located on Lot #3 of Mr. Spence's property. The spoil disposal area will be constructed 40 feet east of the existing bulkhead and will extend 110 feet east across the undeveloped lot. This upland area is also vegetated with mowed weeds and indigenous grasses. tiE Field Investigation Report Mr. Everett Spence and Ms. Rosemary White -Rodanthe, Dare County Page 3 Project Description The applicants propose to conduct hydraulic maintenance dredging of a 3,216 SF area of the Pamlico Sound. The area to be dredged is located at the northwest corner of the existing pier structure. Dredging to the final proposed depth of 4.0 feet will create approximately 178 cubic yards of dredge material that will be placed in a 2,745 SF spoil disposal area that will be constructed on the adjacent waterfront Lot 3. The spoils retention site will be constructed by scraping approximately 2 feet of material from the area to create berms that will be approximately 15 feet wide and 5 feet tall. The proposed spoil retention area will have a capacity of approximately 400 cubic yards. During dredging operations approximately 200 feet dredge spoils inflow pipe will be placed in the Pamlico Sound. The pipe will exit the Pamlico Sound on the southwest corner of Lot 3 and another 175 feet of pipe will be placed across the lot to discharge the spoils into the eastern edge of the proposed dredge spoil disposal area. Approximately 100 feet of outflow pipe will be required for the dredge effluent to exit the western edge of the retention area and discharge back into the shallow waters of the Pamlico Sound. Dredging of the proposed dredge area and other areas near the existing pier structure was previously authorized on March 19, 2004 by General Permit #36573A (see attachments). This permit was issued to remove eroded materials that were deposited along the sound side of Rodanthe by ocean overwash caused by Hurricane Isabel. 9. ANTICIPATED IMPACTS It is anticipated that the proposed project will cause the following impacts: • The proposed dredging will result in the disturbance of 3,216 SF (.07 acres) of Estuarine Waters/Public Trust Areas and the removal of 178 CY of sandy material from the bottom of the Pamlico Sound. • The proposed dredging will result in the placement of 178 CY of sandy material in the FEMA "V" Flood Zone. • The construction of the proposed dredge spoil disposal area will result in the disturbance of 5,625 SF (.13 acres) of upland area. • The dredging will result in the temporary increase in turbidity of the open waters of the Pamlico Sound. • Because the applicant has also requested that a dredging maintenance clause be issued to ensure that adequate water depths may be maintained in the future, the impacts listed above may be of a recurring nature. • A review of available maps indicates that no archaeological resources are located on or near the subject property. Box 157 Rodanthe, NC 27968 SITE LOCATION - NC 12 in Rodanthe, adjacent to `Hatteras Jacks' The site covers 0.34 acres with 145 LF of shoreline on Pamlico Sound. The Applicant holds title to the subject property, Lot 3, and the adjacent existing residential lots to the east, (lots 1 and 2). The co-applicant holds one-half interest in the pier which lies between the two properties. Please see the attached Boat Dock Agreement. The proposed activities will be conducted within Ms. White's riparian corridor established along the pier alignment. Post-Hurricane Isabel dredging was permitted (# A 36573) on March 19, 2004, and was referred to "Authorized Maintenance Excavation" on the July 16, 2004, CAMA General Permit # A 38227. The applicant proposes to conduct similar excavation work to re- establish and maintain adequate water depths. Please see the attached site plan. The maintenance of the basin is necessary for. the boat slips around the existing pier and to ensure safe access to the existing channel leading to the deeper water of the sound. The pier, slips, and basin are meant for use by adjacent residential lots. The character of the facility and improvements will be for private, residential, recreational use. The facility will not be for commercial use, and will serve to provide safe mooring and navigational access to the Pamlico Sound for the residents only. The applicant requests that a maintenance clause (as authorized by 15 NCAC 07J.0404) to conduct similar excavation work to maintain adequate water depths around the existing pier be incorporated into the permit. This will allow for regular dredging of a similar nature as needed. Existing structures include an outbuilding (16 X 20 ft shed on Lot 1), bulkhead, and pier (on shoreline, Lot 3). All upland areas are stabilized and vegetated. In order to continue to provide adequate boat access to adjacent waters the applicant proposes the following; • Conduct maintenance dredging of an area of approximately 3,216 SF of Pamlico Sound bottom to a depth of 4 ft. • Place approximately 178.7 CY of dredged material onsite, in an upland area, for dewatering and subsequent grading and stabilization. '} The purpose of the basin dredging is to provide safe mooring and navigational access to the Pamlico Sound for the local residents and other boating interests while avoiding SAV's to the maximum extent possible. Current water depths average approximately 2.5 feet below MLW, rendering boat travel in this vicinity hazardous to watercraft and passengers. The temporary spoil dewatering and containment area will be located on Lot 3, owned by the applicant, Mr. Spence. This area currently exists as an established lawn and is surrounded on all sides by uplands. Minimal site disturbance will be required to convert the site into a spoil dewatering and containment area. An earthen dike wall will be constructed to contain the dredged material and the outflow end of the pipe will be located in the area of the northwestern property corner of Lot 3. After the dewatering process is completed, the area will be graded and seeded to reduce potential sediment transport to the sound.
