Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2732. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 14. This action completes DEM's review under Section 401 of the Clean Water Act. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150E of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. C. 28801 Subject: Nationwide Permit SR 1192 Wilson Branch Road Proposed Spot Safety Improvement Dear Mr. Chapin: 1 am attaching a straight line diagram with erosion control plan, cross sections of a proposed channel change, an application form for a nationwide permit, and a county map section relative to the proposed spot safety improvement of SR 1192 Wilson Branch Road in Mitchell County. Wilson Branch Road is presently 12 to 14 feet wide. We propose to widen the road to the widths shown on typical section attached. The spot improvements will be in two locations: #l. from survey station 17 + 02, 0.2 miles east of NC 226, for 0.09 miles. #2. from survey station 27 + 22 for 0.21 miles. Grading will be moderate. We propose to channel change on the left from survey station 18 + 00 to survey station 21 + 50. The channel change is necessary because of the steep drive on the right adjacent to the road. We also propose to replace/extend pipes with live streams at survey stations 18 + 00, 26 + 12 and 27 + 22. We also propose to realign the drive pipe left of survey station 19 + 50 to fit channel change. A request to twenty-five foot buffer zone will be made to of Environment, Health and Natural Resources Chris Boudreau, District you concerning work within the the Department at a later date. By a copy of this letter, we are also asking Mr. E. L. Ingle, Area Roadside Environmental Engineer, to comment on the above project.
