THIS CERTIFICATION is issued in conformity with the requirements of
Section 401 Public Laws 92-500 and 95-217 of the United States and subject to
the North Carolina Division of Environmental Management Regulations in 15 NCAC
2H, Section .0500 to North Carolina Dept. of Transportation resulting in 0.01
acres of wetland impact in Pasquotank County pursuant to an application filed
on the 15th day of March of 1994 to replace bridge 24 on.SR 1140.
The Application provides adequate assurance that the discharge of fill
material into the waters of Halls Creek in conjunction with the proposed
development in Pasquotank County will not result in a violation of
applicable Water Quality Standards and discharge guidelines.
Therefore, the State of North Carolina certifies that this activity
will not violate Sections 301,302,303,306,307 of PL 92-500 and PL 95-
217 if conducted in accordance with the application and conditions
hereinafter set forth.
Condition(s) of Certification:
1. That the activity be conducted in such a manner as
to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the stream is 25 NTU's or less are
not considered significant).
Violations of any condition herein set forth shall result in
revocation of this Certification. This Certification shall become
null and void unless the above conditions are made conditions of the
Federal or Costal Area Management Act Permit.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

SITE DESCRIPTION
NC DOT maintains the bridge at Halls Creek on SR 1140 in Pasquotank County near the
community of Nixoriton. Halls Creek is a tributary to the Little River. The Halls Creek Bridge
is approximately 1 mile upstream from the confluence of Halls Creek and the Little River. Both
streams are in the CAMA Estuarine AEC. Halls Creek is approximately 90 feet in width at the
bridge location and has a channel depth of approximately 7 feet at NWL. The existing bridge
clearance is approximately 24 inches at NWL. The northern shoreline of Halls Creek is
stabilized with bulkhead and rip rap structures near the vicinity of the existing bridge. The
southern bank is a natural shoreline of coastal and wooded wetlands.
The applicant proposes to replace the bridge over Halls Creek. This bridge replacement
would include a new structure composed of two 50 foot by 24 foot concrete pads. The proposed
structure would be 100 feet long and 24 feet wide. The new bridge would provide the same
clearance as the existing bridge. Since the new road grade would be wider, the existing ditch
would be filled and a new ditch would be excavated to accommodate roadway drainage. The
proposed structure would also require the removal of existing support structures and the
placement of three new pile bents to support the new bridge. A total of 0.01 acres of shallow
water habitat and wetlands would be directly impacted by the proposed development.
The Pasquotank County Soils Survey, published in 1957 classifies soils in the immediate
bridge vicinity as "Sd; swamp, low wet areas and alluvial material".
The land use in the vicinity of the Halls Creek Bridge varies from residential and
commercial to bog and hardwood wetlands. Land use adjacent to the bridge includes a trailer
park, and a bait and tackle shop on the north shoreline. Land surfaces in this developed area
are either roadway or grassed. Land use adjacent to the bridge on the south shoreline includes
coastal and wooded wetlands. A North Carolina Wildlife Boat Ramp and gravel parking area
is located adjacent to coastal wetlands, approximately 100 feet downstream of the existing bridge
structure.
Some structural evidence exists on site which indicates that the south shore downstream
area may have been utilized for other purposes in the past or that other structures may have
previously existed as this site. It is not known if this site has been investigated by the Division
of Archives and History or if any sites of historical or cultural importance have been identified
in the immediate vicinity of the proposed development.
The predominate plant species adjacent to the existing bridge structure is Annufinaria
with a sparse to dense overstory canopy. An inventory of existing plant species include the

ANTICIPATED IMPACTS
This proposed project would directly impact a total of 0.01 areas of shallow water habitat
and wetlands. Construction work and directly impacted areas would occur within the access
right-of-way of SR 1140 and would involve three property owners. Construction would also
have a temporary impact on water quality by increased turbidity due to construction activities
within the stream channel as well as adjacent areas.
The proposed project would also temporarily impact the public trust use of Halls Creek,
as well as access to the N.C. Wildlife Boat Rarnp and the private bait and tackle shop adjacent
to the site.

SUBJECT: Pasquotank County, Replacement of Bridge 24 on
Sr 1140.
The North Carolina Department of Transportation proposes
to replace bridge 24 over Halls Creek on SR 1140 in
Paskquotank County. The proposed action will involve
replacing the existing bridge structure with two 50 foot
cored slab bridge sections with three pile bents for support.
This bridge replacement will take place on existing
alignment, and local traffic will be detoured along existing
roadways.
In order to facilitate a slightly longer and wider
bridge structure, NCDOT proposes that a small portion of
wetlands (0.1 acres) in the existing roadway ditch be filled
and a small amount of material (12 cubic yards) be excavated
for the new roadway ditch. The Northwestern bank of Halls
Creek will be stabilized with class II rip rap. The proposed
action will not lead to new encroachment into Halls Creek.
Best management practices will be implemented to
minimize any adverse effects which may be caused by project
related sedimentation. Steps will be taken to prevent live
concrete from coming in contact with waters of the United
States.
The enclosed permit drawings do not show any property
lines or right of way lines. In this case, the proposed
activity will not lead to impacts outside of existing roadway
footprint (toe of fill, state maintained ditches, underneath
bridges, etc).
NCDOT is requesting that the proposed work be authorized
under the appropriate Coastal Area Management Act (CAMA)
permit. By copy of this letter, we are also requesting
issuance of a 401 Water Quality Certification from the N.C.
Division of Environmental Management and Section 404 permit
from the U.S. Army Corp of Engineers. Included for your
information is a permit application package and set of permit
drawings (3 pages). A processing fee of $250.00 will be
forwarded to your office within the next week.
