After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2745. This certification allows you to use Nationwide Permit Number 3 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter.. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Due to the proximity of a DEHNR Trout Stream (Bledsoe Creek) and tributaries to DEHNR Trout Streams, we are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a straight line sketch with the proposed erosion control, stream, stream bank, and construction limits. In addition, I am sending a typical section of the road and cross sections at station 58+00 to Station 58+70 where we will be encroaching on the trout stream buffer zone. We will be extending and or replacing pipes which involve streams as follows: an existing 18" pipe at Station 26+40, proposed 18" pipe at Station 30+80 at a wet weather stream, an existing 24" pipe at Station 54+45, and an existing 18" pipe at Station 55+30. We will be tying to the existing bridge at Station 0+25. By copy of this letter I am asking Mr. Joseph'Mickey, Jr., North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the 404 Nationwide Permit Request. A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of the DEHNR Trout Stream (Big Creek) and I am asking Mr. Mickey to comment directly to me concerning the Trout Water Buffer Zone ATk f Jolly Page 2 Encroachment. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. Generally, the order of installation of the erosion control measures,.will be as follows: Temporary Silt Basins shall be installed before clearing and grubbing begins. Silt Fences and temporary silt ditches shall be installed after clearing and before grading. Temporary Stone ditch checks shall be installed as soon as ditchline is established. Pipe Outlet and inlet protection will be done as soon as the pipe is installed. Seeding and other.permanent erosion control measures are to be implemented as soon as practical. Due to the proximity of a DEHNR Trout Stream (Bledsoe Creek) and tributaries to DEHNR Trout Streams, we are requesting a 404 Nationwide Permit (#3 Maintenance) from your agency. I am sending a straight line sketch with the proposed erosion control, stream, stream bank, and construction limits. In addition, I am sending a typical section of the road and cross sections at station 58+00 to Station 58+70 where we will be encroaching on the trout stream buffer zone. We will be extending and or replacing pipes which involve streams as follows: an existing 18" pipe at Station 26+40, proposed 18" pipe at Station 30+80 at a wet weather stream, an existing 24" pipe at Station 54+45, and an existing 18" pipe at Station 55+30. We will be tying to the existing bridge at Station 0+25. By copy of this letter I am asking Mr. Joseph Mickey, Jr., North Carolina Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the 404 Nationwide Permit Request. A request will be made on this project for a Temporary Encroachment in the Trout Water Buffer Zone of the DEHNR Trout Stream (Big Creek) and I am asking Mr. Mickey to comment directly to me concerning the Trout Water Buffer Zone Jolly Page 2 Encroachment.
