Buncombe County
The Corps of Engineers,Nashville District, is evaluating potential flood damage reduction measures for
the Swannanoa River Watershed near Asheville.
The Corps has had on-going meetings regarding this project with interested parties,including the Division
of Water Quality(DWQ)—Asheville Regional Office.
As DWQ has stated during those meetings,the following concerns may, or will likely,need to be
addressed:
1. NPDES Construction Stormwater Permit NCGO10000—This permit is issued concurrently with
an approved Sediment and Erosion Control plan to control stormwater discharges from
construction activities. If greater than one acre is disturbed,a NCGO 10000 is required.
2. 401 Water Quality Certification—If a 404 permit is required by the Army Corp of Engineers, a
401 Water Quality Certification is necessary. Depending on the amount of impact to a stream
and/or wetland—written concurrence from this office may be required.

Mountain Housing Opportunities,Inc.proposes to develop a site for 10 single family dwellings on
approximately 2 acres in Swannanoa,NC at Getaway Drive.
The following concerns may, or will likely,need to be addressed:
1. NPDES Construction Stormwater Permit NCGO 10000—This permit is issued concurrently with
an approved Sediment and Erosion Control plan to control stormwater discharges from
construction activities. If the proposed project will disturb greater than one acre, an NCGO10000
permit is required.
2. Buncombe County Phase II stormwater requirements—Mountain Housing should contact
Buncombe County to ensure compliance with any Phase II or additional stormwater
requirements. Impervious surfaces should be 30 feet from any surface water.

The City of Asheville has applied for HUD funding for a 70 unit affordable housing apartment complex at
Eagle and Market Streets in downtown Asheville.
The following concerns may,or will likely,need to be addressed:
1. NPDES Construction Stormwater Permit NCGO 10000—This permit is issued concurrently with
an approved Sediment and Erosion Control plan to control stormwater discharges from
construction activities. The proposed project will disturb greater than one acre, so an
NCGO10000 permit is required.
2. City of Asheville Phase II stormwater requirements—the City of Asheville,Planning Department,
should be contacted to ensure compliance with any Phase II or additional stormwater
requirements.
3. 401 Water Quality Certification—This project is a redevelopment in an urbanized area—no
impacts to streams are wetlands are expected, so likely no 404 or 401 Certification will be
necessary.

Buncombe County
The USDA Forest Service wishes to perform an Oak Regeneration Research Project in Pisgah National
Forest, southeast of Beaverdam in Buncombe County. Road construction and improvements are also
proposed.
The Division of Water Quality has the following comments:
1. The USDA should ensure that all Forestry Practice Guidelines are met/maintained during.the
project.
2. NPDES Construction Stormwater Permit NCGO 10000—This permit is issued concurrently with
an approved Sediment and Erosion Control plan to control stormwater discharges from
construction activities. If the proposed project will disturb greater than one acre, an NCGO 10000
permit is required.
3. 401 Water Quality Certification—If a 404 permit is required by the Army Corp of Engineers
(ACOE),a 401 Water Quality Certification is necessary. Depending on the amount of impact to a
stream and/or wetland—written concurrence from this office may be required. The Division is
unsure from the information provided if there will be any impacts to streams or wetlands with the
road improvements (this should be confirmed and the ACOE contacted if necessary).

Dear MR. FROST:
The City of Asheville Community Development Division is preparing a HUD
Environmental Review Record for the following project known as the Irene
Wortham Center Rose Street Facility Expansion. Irene Wortham Center plans to
expand an existing treatment facility for medically fragile adults on the subject
parcel by an additional 324 square feet. The current treatment room will be
expanded towards the rear of the property by ten feet. The existing porch will be
deconstructed, and a new porch will replace it. Building materials will include
concrete for the foundations, aluminum c-channel studs, sheetrock walls, and
brick and stucco materials for the exterior.
The property (PIN # 964793217800000) is located at 1 Rose Street W, Asheville,
NC 28803:

Buncombe County
Progress Energy proposes to construct a 115 kV transmission line between the Asheville Generating Plant
and the Enka substation. Part of this line will run through NFS land and cross the Blue Ridge Parkway.
The preferred alternative is to parallel the existing transmission line.
As DWQ has stated during past meetings regarding the overall project,the following concerns may, or
will likely,need to be addressed:
1. NPDES Construction Stormwater Permit NCGO 10000—This permit is issued concurrently with
an approved Erosion and Sedimentation Control plan to control stormwater discharges from
construction activities. If greater than one acre is disturbed, a NCGO10000 is required.
2. 401 Water Quality Certification—If a 404 permit is required by the Army Corp of Engineers, a
401 Water Quality Certification is necessary. Depending on the amount of impact to a stream
and/or wetland—written concurrence from this office may be required [ref.4.2.4 of the document
and Appdx. C regarding streams/wetlands on-site].

well as the Swannanoa River). This proposal is for a 2.2 mile section of the 17 miles Wilma Dykeman
Riverway corridor.
The following concerns may, or will likely,need to be addressed:
1. NPDES Construction Stormwater Permit NCG010000—This permit is issued concurrently with
an approved Erosion and Sediment Control plan to control stormwater discharges from
construction activities. Likely the proposed project will disturb greater than one acre, so an
NCG010000 permit is required.
2. 401 Water Quality Certification—If a 404 permit is required by the Army Corp of Engineers,a
401 Water Quality Certification is necessary. Depending on the amount of impact to a stream
and/or wetland—written concurrence from this office may be required. The DWQ is unsure of
the total jurisdictional waters or wetlands for the area—this should be confirmed prior to impacts
to the site.
3. Asheville and Buncombe County Phase II stormwater requirements-the City(or its consultant),
should ensure compliance with Phase II stormwater rules or additional stormwater requirements.

Asheville Regional Airport proposes to construct an additional taxiway during rehabilitation of the
existing runway. The Division of Water Quality/Asheville Regional Office had an initial meeting
September 2, 2010 with representatives of the Asheville Airport and their consultants, as well as the
Army Corp of Engineers(ALOE) regarding this project. Many of DWQs concerns regarding this project
were discussed during the meeting or have been brought as part of the 401 project currently under review
(DWQ 07-1841 V3 —Cargo Hold Expansion).
As with any major project,the following concerns will need to be addressed:
1. NPDES Construction Stormwater Permit NCG010000—This permit is issued concurrently with
an approved Sediment and Erosion Control plan to control stormwater discharges from
construction activities. The proposed project will disturb greater than one acre, so an
NCGO10000 permit is required.
2. 401 Water Quality Certification—If a 404 permit is required by the Army Corp of Engineers, a
401 Water Quality Certification is necessary. Depending on the amount of impact to a stream
and/or wetland—written concurrence from this office may be required. The Asheville Airport
has been informed that the Division would like to see their construction projects consolidated as
much as feasible(and the ACOE,reiterated this statement).
3. Phase II stormwater requirements Impervious surfaces should be 30 feet from any surface water.
The density of the project will require post construction stormwater controls (the Airport is aware
of this). The Division will work the City of Asheville to ensure that any other,more stringent,
ordinances are met. As the Division discussed with the airport,the currently proposed post
construction stormwater controls may need to be designed to accommodate this additional
impervious surface(and per the Airport's consultants, this has been done).

4. The Division's Aquifer Protection Section, along with the 401 Certifications Unit, continues to
have concerns regarding the use of ash for fill(and this has been emphasized in comments
regarding the 401, as well as other documents).

The USDA Forest Service, Pisgah Ranger District proposes to perform streambank stabilization work on
a section of Wolf Branch in Bent Creek Experimental Forest in Buncombe County.
The following concerns may, or will likely, need to be addressed (and will be requested by DWQ:
1. NPDES Construction Stormwater Permit NCGO10000—This permit is issued concurrently with
an approved Sediment and Erosion Control plan to control stormwater discharges from
construction activities. If greater than one acre is disturbed, a NCGO 10000 is required.
2. 401 Water Quality Certification—If a 404 permit is required by the Army Corp of Engineers, a
401 Water Quality Certification is necessary(likely a certainty with the project as proposed).
Written concurrence from this office will also be required. Some of the concerns that DWQ has
with the project as proposed are:
a. The project proposes to shortcut a natural process. How will long term stability be
affected during storm flows? How will structures proposed off-set the loss of habitat
from the isolated segment(ox-bow)?
b. Will the trail (Trail 666) be routed away from the ox-bow, as during storm events this
area will be hydraulically(inundated?).

c. Does the current provide more sediment to the system than current hydraulic sediment
movement flows need?
d. As with any stream restoration project, a construction sequence should be provided and
must include how work will be conducted"in the dry"and/or turbidity impacts
minimized.

The U.S.D.A. Forest Service; Pisgah Ranger.District,is proposing-to rehabilitate" of Wolf
Branch, a tributary of Bent Creek, in order to mitigate sedimenfation'froin_ari uridercut'stream bank. The
project site is located in the Bent Creek Experimental Forest in Buncombe County,North Carolina, and is
about one mile north of Lake Powhatan. This project will be known as the"Wolf Branch Streambank
Stabilization Project."Map and site photo attached.
Purpose and Need for the Proposal
At this site, Wolf Branch meanders into the toe of the valley side slope and erosion of the bank has
occurred. The eroding bank was measured to be 60 feet long with a maximum height of about.8 feet. The
potential for future erosion is high and the estimated volume of soil lost is also high, estimated at 420 ft3
per year. The purpose and need for this proposal is to reduce potential for ongoing sediment contribution
to Wolf Branch, repair existing resource damage, and decrease the potential for future large flows to
contribute sediment to Wolf Branch.
Wolf Creek Proposed Actions -
1. Lay back the eroding section of the bank to a 1:1 slope, including'the'overhanging bank. Decompact
the trail surface for about 100.feet to eliminate.surface runoff to...the bank. Several trees will be .
removed from the bank and used on site. ' '
2. Cut off the large meander bend by constructing a new channel. The bend will be left as an oxbow, a
feature having an ephemeral pool.
3. Since the new section of channel would straighten the reach and ultimately increase channel gradient,
energy dissipating structures would be employed to stabilize the channel. These structures include
those typical of a natural stream channel design, e.g. cross vane and J-hook structures made from trees
and boulders. Design channel dimensions would be taken from up and down stream reaches.
4. The site is accessible from Forest Road 491 and an existing non system road. New road construction
would not be required.
5. Disturbed soil will be seeded and mulched. Stream banks will additionally be covered with coir
matting and planted with riparian type vegetation.
6. Access to an adjacent section of non-system road currently being used as an unauthorized trail for
hiking and mountain biking would be blocked. Recreational access to the area will still be available
via the nearby Wolf Branch Trail (Trail 666),which will not be affected by this project.
Forest Plan Direction
The Land and Resource Management Plan, Pisgah and Nantahala National Forest(Forest Plan), provides
the following direction for the management of riparian areas:
• Rehabilitate active sites that are contributing visible sediment to the stream channel. Use site specific
analysis to determine rehabilitation needs that will prevent or minimize sediment from reaching the
stream channel (p III-184).

Improve habitat of wild trout streams as a first priority(p III-185).
• Maintain the natural hydraulic and hydrologic functioning of the stream channel and protect the
integrity of the stream system including channel, banks, and stream bottom(p III-187).

Progress Energy proposes to construct a 115 kV transmission line between the Asheville Generating Plant
and the Enka substation. Part of this line will run through NFS land.
Progress Energy has had on-going meetings regarding this project with interested parties, including the
Division of Water Quality(DWQ)—Asheville Regional Office.
As DWQ has stated during those meetings,the following concerns may, or will likely, need to be
addressed:

S&ME is conducting a Phase I Environmental Site Assessment for a proposed CVS Pharmacy
site located southeast of the intersection of Patton Cove Road and US Highway 70,in
Swannanoa,Buncombe County,North Carolina. The site is approximately 1.6 acres that is
currently undeveloped. The property was previously developed with a gas station,a tire store and
possibly residences. The Buncombe County GIS web site does not indicate any wetlands or
streams on the property. A site location map, a topographic map using a portion of the Oteen,
North Carolina Quadrangle of the 7.5 minute USGS topographic map, and a site aerial
photograph are attached.
The purpose of our letter is to inquire about documented past or present violations of wetland
laws or regulations on the CVS site or on adjoining properties.
