We have reviewed your request for 401 Water Quality Certification
to place fill material in 0.06 acres of wetlands or waters which are
tributary to Buffalo Creek for road maintenance located at SR 1194 in
Ashe County as described in your submittal dated 24 February 1994.
Based on this review, we have determined that the proposed fill is
covered by General Water Quality Certification No. 2745. A copy of
the General Certification is attached. This Certification is
necessary for coverage under Corps of Engineers' Nationwide Permit No.
3. This action completes DEM's review under Section 401 of the Clean
Water Act.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Subject: Nationwide Permit No. 3 for maintenance
along S.R. 1194 adjacent to a small stream which is a

Dear Mr. Thomas,
The Department of Transportation is scheduled to grade, drain
base, and pave primarily along the existing roadway of SR 1194
(Saddle Gap Rd)., in Ashe County during the 1993-1994 fiscal year.
Due to the proximity of a small stream which is a trib. to Buffalo
Ck. (Class-C-Trout) we are requesting a 404 Nationwide permit no.
3 for the 6 existing cross line drainage structures that will need
replacing, extending, or upgrading.
Attached is a straight line sketch with proposed erosion control,
stream, stream embankment, pipe crossing and construction limits.
In addition I am sending sketch of areas along the road, with
cross sections to cover same where project encroaches inside the
25 ft. trout buffer zone, and marked county map.
By copy of this letter I am asking Mr. Joe Mickey, Jr., of North
Carolina Wildlife Resources Commission District Fisheries
Biologist to comment directly to you concerning the 404 Nationwide
Permit request.
A request will be made on this project for a Temporary
Encroachment in the Trout Water Buffer Zone of Buffalo Ck. and I
am asking Mr. Mickey to comment directly to me concerning the
Trout water buffer zone encroachment.

Also by copy of this letter, I am requesting authorization to
proceed under Section 401 of the Clean Water Act from the Division
of Environmental Management.
We would like to begin construction as soon as possible. If
further information is required, please let me know. Your early
review and consideration will be greatly appreciated.

EROSION CONTROL SCHEDULE
(1) All nderinate temporary erosion control measures will be
installed before clearing and grubbing operations begin.
(2) AS construction progresses temporary and permanent
erosion control devices shall be installed in a timely
manner, according to any special permit requirements
and /or requirements get out in G.S. 113A-57.
MANDATORY STANDARDS FOR LAND-DISTURBING ACTIVITY
Piirsliant to G.S. 113A-57(3), Provisions for a ground
cover sufficient to restrain erosion must be
accomplished within 30 working days or 120 calendar
days following completion of construction or
development, whichever period is shorter, except as
provided in 15A NCAC 4B .0024(e).
DESIGN STANDARDS IN SENSITIVE WATERSHEDS
P»rsuant to G.S. 113A-57(3) provisions for a ground
cover q.mfficient to restrain erosion must be
provided for any portion of a land-disturbing
activity in a HQW zone within 15 working days or 60
calendar days following completion of construction
or development, whichever period is shorter.
(3) All siltation and erosion control devices shall be
properly maintained until no longer needed.
(4) On projects performed by D.O.T. Maintenance Forces,
req"e4t will promptly be made to the Division Roadside
Environmental Unit for stage and permanent seeding.
(5) Any removal of siltation devices will be based on they
nondition of established ground cover of that area the
device 11 serving.

1. Clear only enough area and install the downstream measures

2. Excavate the 2' base tall ditch.
