Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2735. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' General Permit No. 031. This action completes DEM's review under Section 401 of the Clean Water Act. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. In addition, approximate 50 cu is yards of riprap fill will be placed above and below each new u vert as a stabilization measure. A concrete headwall will be con ructed on t e upstream end of each new culvert, too, at all three locations. No wetlands will be impacted by the work. This project has been coordinated with the N . Wildlife Resources Commission (WRC). On January 1, 1992, we renewed general permit, Action ID No. 198200031, (copy enclosed), that authorizes the placement of fill material associated with the construction, repair, or replacement of bridges across navigable waters and waters of the United States in North Carolina, including cofferdams, abutments, foundation seals, piers, temporary construction and access fills, approach fills, detour fills, and box culvert installation, as part of work conducted by or in full compliance with the standards and specifications of the North Carolina Department of Transportation (NCDOT). Your proposed work is authorized provided it is accomplished in strict accordance with the enclosed conditions. Please read the enclosed permit to prevent an unintentional violation of Federal law. As this DA general permit does not relieve you of the responsibility to obtain any other required approvals, you should contact appropriate State and local agencies before beginning work. This work is part of a project to grade, drain, base, and pave SR 1389 Franklin Place Road in Caldwell County. In addition to the pipes being replaced in three locations as requested by Mr. Daniel D. Holderman, we are requesting authorization to extend one pipe and replace two additional pipes that carry streams. I am sending a joint application form, a roadway typical section, Bridge Maintenance Unit sketch from previous permit request, a straight line sketch with the proposed-erosion control, notes on pipe installation, and a marked map. By copy of this letter, I am requesting Mr. Chris Goudreau, N.C. Wildlife Resources Commission District Fisheries Biologist to comment directly to you concerning the modification of this permit. Also, by copy of this letter, I am requesting authorization to proceed under Section 401 of the Clean Water Act from the Division of Environmental Management. Install erosion control devices. In streams, where necessary, rock silt screens will be used. 2. Remove material and existing pipe while limiting, as much as possible, material and sediment from entering a stream and/or escaping from project. 3. Prepare pipe foundation while again taking care to limit, as much as possible, material and sediment from entering a stream and/or escaping from project. Where possible, new grade will be below existing stream bed. If needed, bedding material will be clean stone. 4. Place the new pipe and compact backfill. 5. Install slope protection on outlet and inlet ends of pipe. Also complete installation of erosion control measures and perform maintenance as needed on existing measures. 6.
