Dear Mr. Moore: I
Reference your May 10, 1993 application for Department of the Army
authorization to replace/extend 2 culverts in unnamed tributaries to the North
Toe River as part of a road paving project on S.R. 1175 (Gordon Silver Road),
near Bakersville, in Mitchell County, North Carolina. No wetlands will be
impacted by the work. This project has been coordinated with the NC Wildlife
Resources Commission (WRC).
On January 1, 1992, we renewed General Permit, Action ID No. 198200031,
(copy enclosed), that authorizes the placement of fill material associated
with the construction, repair, or replacement of bridges across navigable
waters and waters of the United States in North Carolina, including
cofferdams, abutments, foundation seals, piers, temporary construction and
access fills, approach fills, detour fills, and box culvert installation, as
part of work conducted by or in fql compliance with the standards and
specifications of the North Carolina Department of Transportation (NCDOT).
Your proposed work is authorized provided it is accomplished in strict
accordance with the enclosed conditions. Please read the enclosed permit to
prevent an unintentional violation of Federal law. As this Department of the
Army general permit does not relieve you of the responsibility to obtain any
other required approvals, you should contact appropriate State and local
agencies before beginning work.

Upon review of your request for 401 Water Quality Certification to place fill material in
0.01 acres of wetlands or waters which are tributary to South Toe River for road improvement
located at SR 1175 in Mitchell County, as described in your submittal dated 10 May 1993, we
have determined that the proposed fill can be covered by General Water Quality Certification
No. 2732 issued January 21, 1992. A copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide
Permit No. 14.
