Reference your application of January 28, 1993, for Department of the Army
authorization to replace and extend culverts and to potentially construct a
channel relocation of Arrington Branch in conjunction with the paving and
widening of S.R. 1372, Arrington Branch Road, in Mars Hill, Madison County,
North Carolina. The project will impact approximately 0.10 acres of waters of
the United States. The project has been reviewed by the N.C. Wildlife
Resources Commission (WRC).
For the purgoses of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. The discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. The permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions, and those outlined in the attached
February 22, 1993 WRC letter. This NWP does not relieve you of the
responsibility to obtain any required State or local approval. Information
regarding issuance of a Section 401 Water Quality Certification may be

SUBJECT: A review of an application by Mr. Danny Tolar of North
Carolina Department of Transportation (NCDOT), to
replace and extend culverts, install new culverts and do
a possible channel change on Arrington Branch, along SR
1372, Mars Hill, Madison County.
Dear Mr. Johnson:
The N.C. Wildlife Resources Commission (NCWRC) has reviewed
the information provided by Mr. Danny Tolar and we are familiar
with habitat values of the project area. An onsite investigation
was conducted on February 9, 1993 to further assesses potential
construction impacts on wildlife and fisheries resources. These
comments are provided in accordance with provisions of the Clean.
Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C.
661-667d.).
The applicant proposes to replace existing culverts with
extended culverts and install a new culvert. A possible channel
change is also proposed. This work is proposed as part of the
upgrade of SR 1372.
Arrington Branch is not Designated Public Mountain Trout
Water (DPMTW). This stream does offers good habitat for trout
and may support a wild trout population as well as populations of
other fish species. No federal or state listed threatened or
endangered species are know to be present at this site.
The NCWRC is concerned over potential adverse impacts to
aquatic resources in this drainage. The NCWRC will not object to
the issuance of the permit provided the following conditions are
met by the applicant:
1) Construction within the 25-foot buffer zone is prohibited
during the trout spawning period of November 1 to April 15 in
order to protect the egg and fry stages from sedimentation.
2) Waste earthen material from the project must not be placed in
any stream or wetland or within the 25-foot buffer zone of any
stream classified as "Trout" by the N.C. Division of
Environmental Management.
3) Erosion control measures should be installed prior to the
start of construction and maintained until the project site
has been stabilized.
4) Temporary ground cover (e.g. hardwood mulch, straw, etc.)
should be placed on all bare soil during construction.
Permanent vegetation in these same areas should be established
within 15 days of project completion to provide long term
erosion control.
5) The channel change should not be done. At this site there
appears to be bedrock to the pasture side of the creek, also
the land slopes uphill away from the creek at this site. To
move the creek will require a change in the slope of the creek
or require the construction of a deep channel to move the
creek into. We will need more site specific information on
this change before we approve it.
